The role of community in youth offender panels in England and WalesCruz da Fonseca Rosenblatt, Fernanda January 2013 (has links)
The primary aim of this thesis is to reach a better empirical and theoretical understanding of what ‘community involvement’ means and what work it does in restorative justice. A case study approach was adopted to examine the involvement of the community in one selected practice of restorative justice, namely youth offender panels in England and Wales. Data collection comprised 127 interviews with key stakeholders involved in youth offender panels, as well as observation of 39 panel meetings, and analysis of related documents (e.g. panel reports and contracts). The role of ‘community’ in youth offender panels is argued to be more ‘theatrical’ (or rhetorical) than real: community panel members do not have a real say in the type or extent of reparation the offender should undergo, they do not clearly benefit from this reparation, and they do not support the reintegration of offenders into the community. The experience of youth offender panels suggests that the greater involvement of lay members of the community – or their changing role from mere witnesses/juries to facilitators – does not help to fully incorporate community harm into criminal justice practice. The English and Welsh experience also suggests that restorative justice advocates have placed unreasonably high expectations on the benefits of lay involvement. For example, this study found that lay members of the community do not have better ‘local knowledge’ than professionals. All in all, a key lesson from the experience of youth offender panels is that – while ignoring the kind of community that features in contemporary, urban contexts – restorative justice programmes run the risk of paying lip service to genuine community involvement. In conclusion, it is argued that restorative justice programmes need to start from a more concrete and up-to-date notion of community. While operationalizing community involvement, they need to acknowledge, all at once: the importance of place; the importance of family links, friendship and other social ties; and the importance of similar social traits and identities.

The perceptions of diverted female youth sex offenders regarding the factors that contributed to their offendingDa Costa, Gloria Elizabeth January 2014 (has links)
A comprehensive literature review indicated that there is a dearth of research
focusing on female youth sex offenders and even less is known about the
perceptions of female youth sex offenders regarding the factors that contributed to
their offending. This study explores the perceptions of female youth sex offenders
regarding their reasons for offending. The female youth sex offenders in this study
indicated that various factors as discussed below contributed to their offending.
The empirical findings of this study confirmed that female youth sex offenders are of
the opinion that certain problems within their families possibly contributed to their
offending behaviour. Some of these characteristics include factors such as divorce,
poor parenting skills, domestic violence, substance abuse and lack of basic care and
safety, just to mention a few. Female youth sex offenders’ lack of assertiveness, low
self-esteem and identity issues were other factors that most probably contributed to
their sexual offending. When taking into account that the majority of the participants’
parents were unemployed, poverty was another factor that most likely played a
contributory role. Due to poverty in the household some of these youth were forced to
relocate to Girls’ Homes, change schools or drop out of school. In order to curb
female youth sex offending one would need to address these factors in a
multidisciplinary and holistic manner. This study reports an in-depth qualitative
understanding of the perceptions of female youth sex offenders regarding factors that
contributed to their offending. In addition the last objective of this study will be the
formulation of recommendations to address female youth sex offending more

A therapeutic programme for the rehabilitation of youth offendersNieman, Annelien 06 1900 (has links)
The judicial system is moving away from a retributive justice system to a more rehabilitative,
restorative justice system. Diverting youth offenders from the justice system by alternative
sentencing options such as diversion programmes is one way of doing this. Jt was found that a
need exists for the development of a therapeutic programme for the rehabilitation of youth
offenders in South Africa. The purpose of the study was to detennine the content of
therapeutic rehabilitation programme and subsequently to develop a provisional therapeutic
programme for youth offenders.
The first part of the literature study summarized a number of theories used to explain the
incidence of youth offence. The second part of the literature study discussed various risk
factors that could lead to youth offence. Thirdly, the juvenile justice system in South Africa
was discussed. Finally, the characteristics of effective rehabilitation programmes were
discussed and a number of international and South African rehabilitation programmes were
evaluated in tenns ofthese characteristics. In the literature study certain aspects for inclusion
in a rehabilitation programme were identified. A list of topics that should be addressed by a
rehabilitation programme was drawn up.
A provisional therapeutic programme was compiled using the information gained from the
literature study and the needs for a programme as identified by staff members at the facility
where the programme was to be conducted. The programme was based on experiential learning. lt included a number of activities that addressed the topics identified by the literature
study. The provisional programme was evaluated in tenns of its short-term effectiveness and
adjustments to the programme were made.
The adjusted programme was conducted at two other facilities and evaluated in tenns of its
short-term effectiveness by the researcher, the staff at these facilities and the youth who took
part in the programme. Staff at the two facilities where the empirical study took place were
asked to complete questionnaires to identify their needs with regards to a rehabilitation
programme as well as background questionnaires on the youth who were taking part in the
