Foi realizado um estudo de caso descritivo acerca do desenvolvimento do processo administrativo-sanitário no serviço de vigilância sanitária da Diretoria de Vigilância Sanitária e Ambiental do Estado da Bahia, com o objetivo de descrever e discutir o desenvolvimento dos processos administrativo-sanitários estudados no âmbito deste serviço. As estratégias metodológicas consistiram na análise de 38 processos referentes aos anos de 2009 e 2010, com base nas seguintes categorias de análise: Instauração, Instrução, Decisão, Recursos e Conclusão, que constituem fases do processo administrativo-sanitário. Para a consolidação dos dados qualitativos e quantitativos, utilizou-se o programa Microsoft Office Word, versão 2007. Os processos componentes do estudo, de maneira geral, seguem os trâmites legais dispostos pela legislação em vigor. Contudo, um número significativo de processos foi interrompido antes de sua adequada conclusão, deixando, até o presente momento, de atender ao interesse público para o qual se destinaram.

In my master thesis, I have been mapping the work of regional hygiene stationswhile solving problems and providing services during exceptional situations in the methanol cause. For the practical part, I have decided to use the combination of the quantitative and the qualitative type of research. To gather the data, I have created a questionnaire that was composed of five open-ended questions. I have used an electronic way of distributing the questionnaire to all of the 14 regional hygiene stations of the Czech Republic. Unfortunately, there were only three hygiene stations that provided the needed data. The three participating hygiene stations were: KHS of South Bohemia region residing in ČeskéBudějovice, KHS of Vysočina region residing in Jihlava, and KHS of West Bohemia region residing in Plzeň. The secondary analysis of data was used to analyze and evaluate the given answers. For the needs of questionnaire examination, there has been created another questionnaire. It was composed of 14 closed questions that were mainly related to the knowledge and attitude of respondents to the given topic. All of the 206 respondents were residents of South Bohemia region. The questionnaire was posted on several internet web pages, and the research took place from March 2014 to July 2014. I have set several goals of the research. The first goal was to discover the number of incentives to be solved that were accepted by the three participating hygiene stations between the years 2008 and 2013. During the past six years, KHS of South Bohemia region, KHS ofVysočina region, and KHS of West Bohemia region experienced the growing trend in the number of incentives accepted. The lowest number of incentives accepted in KHS of South Bohemia region was in 2009, in KHS of Vysočina region in 2009 and 2010, and in KHS of West Bohemia in 2011. On the other hand, the highest number of incentives was experienced by all hygiene stations during the year 2013, and the number was significantly higher than in previous years. Another goal was to discover the number of alcohol accepted by KHS of South Bohemia during the methanol cause, the number of alcohol tested, and also the proportion of harmful alcohol that contained either methanol of isopropanol. In the South Bohemia region, there were 670 samples being tested during December 2012. Out of the 670 samples, there were 16 harmful samples, as 11 of them got over the technological limit of isopropanol contained, and 5 of methanol contained. Part of the master thesis was also to map the awareness of South Bohemia region residents of the methanol cause, and tolearn about their estimation on being able to recognize harmful alcohol by themselves without having it tested. The results have shown that 206 people which is equal to 100% of respondents were aware of methanol cause, and that they had at least basic information about it. 45 (22 %) respondents believed that they were able to recognize harmful alcohol by themselves, and 53 (26 %) respondents did not know about the possibility of having the alcohol tested by the hygiene stations. Out of all 153 well-informed respondents, only 3 (2 %) had their alcohol tested. The last goal of my master thesis was to discover the residents' opinion on hygiene stations. Concretely, I wanted to determine whether respondents would use a guide on how to report a complaint or an incentive. 100 % (206) of respondents have agreed on the fact that it would be useful if such a guide would be present on the web pages of each hygiene station. The research has also shown that 203 (99 %) respondents have answered that they assume that state administration bodies should be more helpful when giving information.Only 3 (1 %)respondents answered that the attitude of state administration is good enough.

Cette thèse traite des modes alternatifs de contentieux administratifs entre l'État et les particuliers. Il s’agit d’une étude comparée entre le système français et le système brésilien. Au Brésil, les procédures alternatives ne sont guère utilisées et les juridictions se voient submergées par des recours de plus en plus nombreux. En France, le manque d’efficience des modes déjà implantés fait que la justice administrative se retrouve également encombrée. Notre proposition est d'analyser les diverses formes alternatives de solution des litiges : conciliation, médiation et arbitrage au Brésil et en France. L'importance de cette recherche se situe essentiellement au niveau de la contribution sociale qu'elle pourra apporter à la société brésilienne et à la société française. Cette thèse se propose de présenter une nouvelle option au contentieux traditionnel : des mécanismes en dehors du juge capables de garantir une communication entre l'administration publique et les particuliers. / This thesis deals with alternative ways to administrative litigations between the State and private individuals. This is a comparative study between the French and the Brazilian system.In Brazil, alternative procedures are rarely used and therefore, courts of law are inundated with more and more appeals. In France, the lack of efficiency of already existing ways makes the administrative justice as inundated. We suggest analyzing the various alternative ways to litigations: conciliation, mediation and arbitration in Brazil and in France. The importance of this research mainly lies in the social contribution it will bring on to the Brazilian and the French society. This thesis will offer a new option to traditional litigations: mechanisms which do not require a judge and which are able to guarantee a real communication between the public Service and private individuals.

This diploma thesis deals with basic procedural rights of parties to administrative procedure. The aim of the thesis is to analyze and evaluate their current legal regulation particularly contained in the Act No. 500/2004 Coll., administrative code, as amended. The thesis is divided into an introductory chapter, five chapters and a conclusion. The aim of the introductory chapter is to introduce a reader to the issue of fair trial and basic procedural rights of parties to Czech administrative procedure. The first chapter deals with definiton of basic terms related to administrative procedure. The second chapter focuses on more detailed explanation of participation of parties to administrative procedure. The aim of the third chapter is to summarize different approaches towards the concept of fair trial and to bring a list of analyzed basic procedural rights of parties to administrative procedure. The fourth chapter deals individually with each of the fourteen analyzed basic procedural rights. Reconsideration of decisions in connection with real property formation - a study of the Administrative Procedure Act § 27 / Omprövning i samband med fastighetsbild-ning – En studie av 27 § förvaltningslagen

In Sweden, real property formation is done by the cadastral authority. Each day, using real property ordinances, despite careful handling errors arise in the decisions. One option to cor- rect errors is revision under the Administrative Procedure Act § 27. The work consists of a study of the provision in § 27 and a case study of the decision reconsidered by the cadastral authority. The aim of this work is to show the difficulties and problems in the application of the provision in § 27 especially in connection with real property formation. Reconsideration under § 27 is generally drafted to include all authorities. The authority has an obligation to reconsider a wrong decision when three conditions are met. It shall be clearly incorrect, the change has to happen quickly and easy, and the change cannot lead to a disad- vantage for the participant. Reconsideration outside § 27 can be applied under established practice, based on the decisions character. Reconsideration under § 27 is often difficult to apply for real property formation because of the occurrence of several participants and sever- al operations in each case. The cadastral authority uses the reconsideration provision somewhat broader than what can be interpreted from the statutory text and its legislative history. In 46% of the studied recon- sidered decisions it was judged that the conditions were not met. In another 11% of cases it was deemed doubtful whether conditions could be met. The provision in § 27 expresses when an obligation to reconsider exists but what can be re- considered is more unclear. The question arises whether there is a further reconsideration opportunity and what it in this case covers. The results of the survey show that there are no clear rules for reconsideration of decisions under § 27 applicable to real property formation. The legislation represents a limit on when reconsideration must be done. Then there is established practice which is the limit for what can be reconsidered. What is true in between and especially for real property formation deci- sions is less clear. Clearer rules specific to real property formation may contribute to an effec- tive process for managing the wrong decisions. / I Sverige utförs fastighetsbildning av lantmäterimyndigheten. Varje dag genomförs fastig- hetsbildningsförrättningar och trots en noggrann handläggning uppkommer fel i besluten. Ett alternativ att rätta fel är omprövning enligt förvaltningslagen 27 §. Arbetet består av en studie av bestämmelsen i 27 § FL samt en undersökning av omprövade beslut vid fastighetsbildning. Syftet med arbetet är att visa på svårigheter och problem med tillämpningen av bestämmelsen i 27 § FL särskilt i samband med fastighetsbildning. Omprövning enligt 27 § FL är allmänt utformade regler för att kunna omfatta alla myndighet- er. Myndigheten har en skyldighet att ompröva ett felaktigt beslut när tre villkor är uppfyllda. Beslutet ska vara uppenbart oriktigt, ändringen ska kunna ske snabbt och enkelt och ändring- en får inte bli till nackdel för part. Omprövning utanför 27 § FL kan tillämpas med stöd av etablerad praxis som grundas på beslutets karaktär. Omprövning enligt 27 § FL är många gånger svårt att tillämpa för beslut vid fastighetsbildning. Detta på grund av fastighetsbild- ningens karaktär av ärenden med flera parter samt flera arbetsmoment. I praktiken tillämpas omprövningsbestämmelsen inom lantmäterimyndigheten något vidare än vad som kan tolkas från lagtext och förarbeten. I 46 % av de studerade omprövningarna bedömdes det att villkoren inte var uppfyllda. I ytterligare 11 % av fallen bedömdes det vara tveksamt om villkoren kunde anses uppfyllda. Bestämmelsen i 27 § FL uttrycker när en skyldighet att ompröva föreligger, vad som däremot får omprövas är mer oklart. Frågan uppkommer om det finns en vidare omprövningsmöjlig- het och vad den i så fall omfattar. Resultatet av undersökningen visar på att det saknas tydliga regler för hur omprövning enligt 27 § FL ska tillämpas vid fastighetsbildning. Lagstiftningen utgör en gräns för när ompröv- ning måste göras. Sedan finns etablerad praxis som utgör en gräns för vad som får omprövas. Vad som gäller däremellan och särskilt för beslut inom fastighetsbildningen är mer oklart. Tydligare regler specifikt för fastighetsbildning kan bidra till en effektiv process för att han- tera felaktiga beslut.

The scope of the Administrative Procedure Code Abstrakt The Administrative Procedure Code as a code of activity of public administration is not a novelty in our legal system, but perhaps that is exactly why it is appropriate to consider how far its scope of application extends. Although the definition of the scope of the Administrative Procedure Code is regulated in the first section of the Act, a closer examination will probably reveal many ambiguities or doubts as to how far its limits extend. And it is precisely the detailed breakdown of the circumstances to which the Administrative Procedure Code is applicable and under what conditions it will apply, which I have set as my goal of this rigorosum thesis. The scope of the Administrative Procedure Code can be examined from two points of view. The first of them is the material definition of the scope of the Administrative Procedure Code, that is, the definition of public administration as such, the evaluation of individual forms of its activities, the subsequent evaluation, in which cases the Administrative Procedure Code is applicable. Since Swiss Codes also regulate proceedings before administrative courts, it treats also some aspects of the Czech judicial review (especially access to judicial protection via legal action). Regulation of insolvency law in South Africa : the need for reform.

Regulatory bodies must function properly in order for their duties to be performed. The performance of the regulatory body impacts the entire insolvency system. Academics have noted that the Master does not meet the standards of what is expected of an insolvency regulator. The Constitution requires that the power of the state be defined and regulated by the law to ensure the protection of the interests of society. State regulation must comply with the underlying values of the Constitution which also includes the protection of the interests of society. The state has a constitutional duty to protect societal interests, ensure that justice is promoted and ensure that just administrative action is achieved. The Master also has the requisite duty to protect societal interests. Academics have found that the objectives and outcomes of the regulation of insolvency law are still not in line with the Constitution and the values and principles it enshrines. Criticisms of the Master’s office include the lack of resources and institutional capacity, the lack of sufficient investigative powers and insufficient guidelines for the Master when applying their administrative discretion when appointing provisional insolvency practitioners. The lack of regulation of insolvency practitioners in South Africa has also been criticised which has a negative impact on the performance of the insolvency industry. Academics have proposed suggestions to reform the regulation of insolvency law in South Africa. However, none of these suggested proposals have been implemented as yet. The most recent development is the draft policy on the regulation of insolvency practitioners that has been submitted to NEDLAC in 2012. The policy aims to provide guidelines relating to the appointment of provisional insolvency practitioners. The policy also includes a code of conduct which insolvency practitioners must adhere to in order to be appointed as a provisional insolvency practitioner. The policy has the potential to provide sufficient guidelines to the Master when appointing insolvency practitioners. The precise guidelines in the policy reflect the need for transformation of the industry and the need for administratively fair decision making. Thus, the provisions of the proposed policy will be effective in countering the criticisms and transforming the insolvency industry and profession. Foreign jurisdictions have also encountered the problem of lack of regulation of insolvency practitioners. To circumvent this problem some foreign jurisdictions have made the recent development of adopting (or considered adopting) self-regulation or co-regulation of insolvency practitioners. In comparison to South Africa, they have made more progress towards improving the regulation of insolvency practitioners. The result of this is that South Africa is out of step with foreign jurisdictions. A presente dissertação tem por objetivo analisar os processos administrativos antitruste sancionadores, associados às atividades do Conselho Administrativo de Defesa Econômica (CADE), Secretaria de Direito Econômico do Ministério da Justiça (SDE) e Secretaria de Acompanhamento Econômico do Ministério da Fazenda (SEAE). O foco do trabalho diz respeito a duas questões: a) o direito positivo brasileiro fornece o instrumental necessário e adequado para que CADE, SDE e SEAE possam desenvolver suas atividades segundo métodos e procedimentos pré-determinados? Em caso de resposta positiva b) existe algum déficit quanto à efetivação da processualidade/procedimentalidade no dia-a-dia dos diversos órgãos administrativos envolvidos na missão de defender a livre concorrência no Brasil? O primeiro capítulo será dedicado à origem e base legal do processo antitruste; o segundo cuidará de seus aspectos mais gerais, salientando a inevitabilidade de atuação processualizada dos órgãos. O terceiro capítulo da dissertação percorrerá a fase inicial do processo, incluindo considerações sobre a instauração, citação e intimação dos representados, o conceito de parte no processo antitruste sancionador, e a questão relativa à existência de litisconsórcio passivo ou de conexão em processos voltados à investigação das condutas tidas por horizontais. O quarto capítulo envolverá a fase instrutória, salientando-se a produção de provas. O estudo da fase decisória estará contido no quinto capítulo; serão mencionadas, dentre outros temas, todas as formas pelas quais o processo antitruste sancionador pode ser encerrado: emissão de decisões terminativas (com ou sem julgamento de mérito), incidência de prescrição e celebração de termos de compromisso de cessação. No sexto capítulo, analisa-se em linhas gerais o Projeto de Lei n. 3937/2004 (e de seu apensado Projeto de Lei n. 5877/05), em trâmite no Congresso Nacional, visando reformar a atual Lei Antitruste. A conclusão da dissertação busca responder às questões inicialmente formuladas: se não faltam instrumentos legais no País prevendo os mecanismos para o funcionamento do processo antitruste sancionador, são freqüentes reclamações quanto às falhas e incertezas verificadas na prática processual de CADE, SDE e SEAE. Ainda assim, existe uma razoável expectativa que essas sejam corrigidas ao longo do tempo (na mesma velocidade do amadurecimento institucional desses órgãos). / The purpose of the present essay is to analyze the administrative antitrust procedures connected to the investigation of anticompetitive practices and related to the activities of the Administrative Council for Economic Defense (CADE), the Secretariat of Economic Law of the Ministry of Justice (SDE), and the Secretariat of Economic Supervision of the Ministry of Finance (SEAE). The issues that constitute the focus of this paper involve two basic questions: a) the Brazilian legal system provides for the necessary rules in order that CADE, SDE and SEAE may develop their respective activities according to pre-determined methods and procedures? In case of a positive answer b) is there any deficit in the implementation of procedural rules in the daily activities of the several bodies involved in the enforcement of antitrust Law in Brazil? Chapter one examines the legal basis of the antitrust procedure; chapter two will analyze the general aspects of the procedure, stressing the inevitability that antitrust agencies perform their activities respecting procedural rules. Chapter three deals with the initiation of the procedure, including an analysis of how the procedure can be invoked, the summoning of the undertakings concerned, the concept of defendant and the matter concerning the defendants compulsory joinder or connection in investigations concerning horizontal practices. Chapter four examines the investigation stage, with emphasis in the production of evidence. The analysis of the final stage of the procedure is included in chapter five; among other issues, all of the possible outcomes of the procedure will be reviewed: issuance of final decision (with or without a ruling on the merits), application of the statute of limitations and the settlement of the case. Chapter six provides for an overall review of Bill n. 5877/05, under analysis in the Brazilian Congress, which aims to modify the Brazilian antitrust law. The conclusion of this essay aims to answer the questions posted above: there are plenty of legal rules to be applied in connection to the antitrust procedure in Brazil, but it is still common to hear complaints about failures and lack of certainty concerning CADE, SDE and SEAEs activities. Still, it is reasonable to expect that such procedural issues will be corrected over time (in the same pace of the institutional development of each of those administrative bodies).
