Procederemos a um estudo do uso e ocupação do solo na região na segunda metade do século XIX, mais precisamente entre 1855 e 1888. Pretendemos uma análise por meio de uma prospecção feita no Registro de Terras Públicas e Escrituras de compra e venda de imóveis. O trabalho consiste num levantamento das localidades presentes na região e a distribuição das propriedades entre elas, num estudo que analisa a natureza dessas propriedades em relação ao tamanho, produção e presença de bens móveis e imóveis, aqui entendidos também como os meios de produção. Por fim, o trabalho analisa o inventário referente a uma das maiores propriedades da região. / The purpose of this study is the agricultural and landholding structure of the border area located in the city of Ponte Nova, in the state of Minas Gerais. A study of occupation and use of this region during the second half of the nineteenth century, more precisely between 1855 and 1888, will be carried out. The analysis will be performed through research of Registro Paroquial de Terras Públicas and Escrituras de Compra e venda (purchase and sale agreements of real estate). The study is a survey of the border area and its distribution of property, a study that analyzes the nature of these properties regarding size, production and movable or immovable assets, which are considered means of production. Finally, the study examines the inventory associated with the largest properties in this region.

O objetivo geral da pesquisa reside na análise das experiências históricas do Assentamento Normandia e do Acampamento na Fazenda Papagaio - ambos localizados na região Agreste do estado de Pernambuco -, nas quais procuramos identificar as determinações sociojurídicas que conduziram, na primeira, ao reconhecimento da função social da propriedade rural e, na segunda, ao impedimento à sua efetivação enquanto condição que possibilita a expansão da justiça social, ainda que nos marcos de uma sociedade capitalista. Nessa perspectiva, fizemos a opção metodológica pela pesquisa bibliográfica e documental com abordagem qualitativa. Inicialmente, dedicamo-nos ao estudo das principais obras dos autores clássicos do pensamento social brasileiro com a finalidade de compreender os fundamentos históricos da estrutura agrária do Brasil e os níveis elevados de concentração fundiária que a caracterizam. Em seguida, investigamos a regulamentação do conceito de função social da propriedade rural nas cartas magnas brasileiras e no plano jurídico infraconstitucional, bem como os principais debates travados a seu respeito. Construído o quadro teórico, pudemos desenvolver, com maior consistência, a última etapa da presente dissertação, na qual realizamos uma pesquisa documental com base nos processos administrativos e judiciais relativos a cada uma das citadas experiências. Ao final, a pesquisa nos permitiu concluir que o próprio texto constitucional sofre diferentes interpretações, podendo ser instrumentalizado para atender aos interesses da elite agrária brasileira. Assim, se, por um lado, a experiência do Assentamento Normandia revelou a inserção da dimensão social e política do conflito por terra no debate jurídico e o reconhecimento da função social da propriedade rural como instrumento que possibilita a efetivação de um conjunto de direitos fundamentais, por outro, a experiência do Acampamento Papagaio demonstrou a limitação do debate sobre a reforma agrária a uma discussão exclusivamente técnica relativa à (im)produtividade da terra, acabando por gerar uma leitura do dispositivo constitucional que regula a função social da propriedade rural funcional à reprodução da lógica segragacionista imposta pelo direito de propriedade em seu aspeto mais tradicional. / The social function of rural property, as related to rights, principle and guaranty stated in the Federal Constitution of 1988, forms the basis for the central concept of this master degree thesis and its approach had as basement the counter hegemonics version of human rights, here recognized as an instrument of transformation and overcoming in a radical and democratic way of conflicts for land in Brazil. The general aim of this search is the analyses of historic conflicts in Normandia settlement and encampment on Papagaio farm.- both located in rural area of the state of Pernambuco - where we sought to identify the social and juridical determinations that drove, in the first, to the acceptance of social function of rural property and second, to the obstruction to its execution while condition that enables the expansion of social justice, even though in the marks of a capitalist society. Based on these facts, we made the methodological choice of bibliographical and documentary with qualitative approach. Initially, we devoted to the study of the major works of classical authors of the social Brazilian thought with the objective to understand the historical basement of agrarian structure of Brazil and the high levels of landholding concentration that features it. Then, we explored the regulation of the concept of social function of rural property in Brazilian magna-letter and the infra constitutional judicial plan and also the main debates that happened regarded to it. Built the theorist chart, we developed with more consciousness the last stage of this present thesis, in which we got the direction to have a documental search based on judicial and administrative proceedings related to each of the mentioned experiments. Finally, the search let us to deduce that the constitutional text itself admits different interpretations, it can be exploited to attend the interests of Brazilian agrarian elite. So, if by one side the experiment of Normandia settlement revealed the insertion of social dimension and the political conflicts for land in judicial debate and the recognition of social function of rural property as an instrument that enables the execution of a set of fundamental rights, on the other side, the experiment of Papagaio encampment showed the restriction of debate about agrarian reform to an exclusive technical discussion related to the poorness of the land, leading to create a reading of the constitutional apparatus that regulates the social function of functional rural property to the reproduction of logical segregation imposed by the rights of property in its more traditional aspect.

Exploring agricultural structure as a determinant for social and aesthetic functions of agricultural production

Diese Dissertation untersucht verschiedene soziale sowie landschaftsästhetische Funktionen der Landwirtschaft in strukturell gegensätzlichen Agrarsystemen. In der Untersuchung wird hierfür stets ein von kleinen Familienbetrieben dominiertes System mit einem stärker großstrukturierten, gewerblichen System verglichen. Die Arbeitszufriedenheit der Landwirte sowie ihre soziale Vernetzung mit der lokalen Gemeinde wurden im Vergleich zwischen dem kleinbäuerlichen Schweizer und dem großbetrieblichen nordostdeutschen System analysiert. Mittels Choice Experimenten wurden in der Schweiz und in Süddeutschland (d.h. kleinbäuerliche Systeme) sowie in Ostdeutschland (d.h. großstruktiertes, gewerbliches System) zudem Bevölkerungspräferenzen für Agrarlandschaften und damit die ästhetische Funktion der Landwirtschaft untersucht. Unter Berücksichtigung der Betriebsstruktur (z.B. Betriebsgröße) sind Schweizer Bauern zufriedener mit ihrer Arbeit als nordostdeutsche. Das Betriebseinkommen ist für nordostdeutsche Bauern signifikant wichtiger für die Arbeitszufriedenheit als für die Schweizer Kollegen. Besonders für Schweizer Bauern spielt die Betriebsdiversifizierung eine positive Rolle für die Zufriedenheit, z.B. die Vielfalt der Produktionszweige oder nicht-landwirtschaftliche Betriebszweige wie Agrotourismus. Auch haben Schweizer Bauern und solche kleinerer Betriebe mehr Bezug zu ihrer lokalen Gemeinde durch lokal fokussierte soziale Netzwerke. Betriebsleiter größerer Betriebe sind hauptsächlich außerhalb der Gemeinden vernetzt und fühlen sich diesen weniger zugehörig. Zudem stärkt ein biographischer Bezug zum Hof die Verbindung mit der Gemeinde. Die Mehrheit der befragten Schweizer und Ostdeutschen ist zudem für qualitative Veränderungen der Agrarlandschaften (d.h. mehr Weiden zur Freilandhaltung, Streuobstwiesen und höhere Biodiversität). Waldrückgange sowie Schlaggrößenveränderungen landwirtschaftlicher oder forstlicher Flächen werden nahezu einheitlich abgelehnt. / This dissertation investigates different social functions of agriculture as well as landscape aesthetics in farming systems of different agricultural structures. Throughout the whole project farming systems dominated by small family farms and large-scale farming systems dominated by commercial non-family farms (e.g. cooperatives) were compared. Farmers’ work satisfaction and their connection to the local community were examined in the small-scaled Swiss system and in the larger scaled Northeast (NE) German one. Public landscape preferences were derived using choice experiments in Switzerland and South Germany, representing small-scale systems, as well as in East Germany, representing a large-scaled one, to explore agriculture‘s aesthetic function. Swiss farmers are more satisfied with their agricultural work if for effects of farm structure (e.g. farm size) is controlled for. Farm income plays a significantly more important role for the work satisfaction of NE German farmers than for that of Swiss ones. Especially for Swiss farmers, farm diversification plays an important role, for example through a diversity of production lines or through non-agricultural activities like agrotourism. Further results show that Swiss farmers and farmers of smaller farms are more connected to their local communities through more locally focused social networks. Farmers of larger farms have their networks farther away from the farm and a weaker sense of belonging to their local community. A biographical bond to the farm also strenghtens the connection to the local community. Concerning public landscape preferences the majority of the Swiss and East German respondents generally prefers qualitative changes to landscapes (i.e. meadows for free range animal husbandry, meadow orchards and more biodiversity). Forest loss or changes in plot sizes of agricultural land and forests are nearly uniformly rejected in all regions.
