The marketing concepts are the key topic of this thesis. Its aim is to define the point of creation of marketing concepts in the field of restaurant services. The intention here is to present the "good practice", via analysis of valued marketing concepts of chosen restaurants. The theoretical part is focused on the definition of marketing, main marketing elements and their application on tourism and hospitality. The practical part consists of three chapters featuring interview with the specialists from the field. Attention of the author is also directed towards the identification of key determinants affecting the choice of the concept and to determination of the relationship between marketing concepts and gastronomy awards.

The purpose of the study was to identify instructional leadership practices elementary principals in Blue Ribbon awarded public elementary schools in Virginia implemented to influence the instructional program. A mixed methods research design was used to collect and analyze data. Principals at eleven of the sixteen public elementary schools in Virginia who received the Blue Ribbon Award between the years 2013-2015 were interviewed. An interview protocol consisting of eleven questions was used to collect qualitative and quantitative data. From the data collected during the interview process, a list of fifty instructional leadership activities was developed by the researcher. The list of fifty activities principals performed were grouped into the following categories; teacher observation practices, providing feedback to teachers, collaborating with teachers to analyze data, implementing professional development, and promoting a positive learning environment. / Ed. Thus, we used the winner of the União Latina in 2006, DNA- O segredo da Vida, translated by Carlos Afonso Malferrari from the originally English written book DNA- The secret of life of James D. Watson. Original and translation were scanned, producing two subcorpora that were aligned in a parallel corpus. The subcorpus containing the translated text was compared with a Portuguese general corpus in terms of vocabulary size, and the results showed that this feature is much alike for both corpora. Based on the fact that a word in English that has a cognate in Portuguese can influence the translation choices, we established two categories, one that presents a direct translation for Portuguese and other that doesn t present a direct translation. A sample with 40 words, 20 of each category, was taken from the parallel corpus to check the translations used for each one. We found that the translator use a number of words in Portuguese for each one in English and that the origin of the word is indifferent to the expert translator, so that it doesn t matter which category the word in English is fit in, for he uses a very similar number of words in Portuguese for each one in English despite its nature. Thus, the results show that the expert translator is committed to the context and is not attached to fixed formulas or predetermined solutions / Este estudo teve o objetivo encontrar, de modo sistemático, características de uma tradução premiada que revelassem a expertise do tradutor. Para tanto, foi selecionada a tradução que recebeu o prêmio União Latina de 2006, DNA- O segredo da Vida, traduzida por Carlos Afonso Malferrari a partir do original em inglês DNA- The secret of life de James D. Watson. O original e a tradução foram digitalizados, dando origem a dois subcorpora que foram alinhados para formar um corpus paralelo. O corpus com o texto traduzido foi comparado com uma amostra do Banco de Português em termos de tamanho de vocabulário, mostrando que a tradução tem tamanho de vocabulário muito próximo à amostra. Baseados no fato de que uma palavra em inglês cognata de outra em português pode exercer influência na escolha da tradução, determinamos duas categorias de palavras a serem investigadas, as que apresentam uma tradução imediata para o português e as que não apresentam tradução imediata para o português. Do corpus paralelo foi extraída uma amostra com 40 palavras, 20 de cada categoria, para o levantamento das traduções. Descobrimos que o tradutor usa traduções variadas para cada palavra do original e que a natureza da palavra na língua inglesa é indiferente ao tradutor experiente, não importando a sua semelhança com o português, pois ele atribui um número de escolhas uniforme entre ambas as categorias. Assim, os resultados mostram que o tradutor experiente tem compromisso com o contexto, não se prendendo a fórmulas ou soluções prédeterminadas

本研究的主要目的，在於探討中國大陸的得獎基金之績效持續性是否存在？本研究利用晨星與理柏兩家國際專業評級機構於2004年至2012年所頒發的中國大陸得獎基金為研究樣本（前者的樣本為41檔基金，後者的樣本為53檔基金），資料來源分別為晨星資訊（深圳）有限公司及新浪網。在分別採用累計淨值報酬率、Sharpe指標作為績效衡量指標，並使用Spearman等級相關檢定、績效二分法與迴歸分析，以驗證中國大陸得獎基金在頒發前後不同期間的績效表現是否具有持續性。研究結果發現，前兩種檢定方法皆呈現基金績效在短期（三個月及六個月）具有持續性，而在長期甚至出現績效反轉的現象。而迴歸模型分析的主要發現為，在控制其他變數後，獲得晨星中國基金獎之基金在短期才具持續性，在一年時出現績效反轉。而獲得理柏中國基金奬之基金，在六個月的評估期間就可能出現績效反轉的現象。 / The purpose of this study is to investigate whether the persistence of awarded funds’ performance exist in China. This study employs awarded funds of MorningStar award and Lipper award in China as the sample provided by Morningstar website in China and Sina website. Using accumulated rate of return and Sharpe index as the measurements of awarded funds’ performance and Spearman’s rank correlation coefficient, two-way table constructed by Goetzmann and Ibbotson (1994) and regression analysis as methodologies to analyze this issue in different before-and-after periods, the primary finding of this study is that the former two methodologies show that the performance persistence of awarded funds exist only in three- and six-month periods, and performance reversal appears in the long-run. According to regression analysis, this study suggests that MorningStar awarded funds might have persistent performance in the short-run, but performance reversal after 1-year period. However, Lipper awarded funds do not have persistent performance, but performance reversal after six-month period.

For this reason, reinforce the debate around gaps and controversial issues mentioned in this law, so that the institute be applied in conformity with the federal constitution, and is increasingly solidified in the procedural system. It is worth noting that the analysis of this institute in impartiality with the judge, especially in view of the development of the international courts of human rights. In this manner, the analysis falls on the performance within the procedure of collaboration, to determine whether assurance of the judge's impartiality are violated when the judge who sentenced the case is the same one who acts in the investigation phase, and who ratifies the awarded agreement. Some alternate routes are pointed out with the purpose of constructing a better adaptation of the procedure to guarantee impartiality, by avoiding allegations of inconsistencies and illegalities. Thus, intends are to prioritize the findings and solutions that best match the principles that underlie the democratic state of law and the protection of human dignity / A colaboração premiada teve seu procedimento regulamentado pela nova Lei de Organização Criminosa – Lei 12.850/2013 – e, desde então, tem sido amplamente debatida, principalmente em razão da sua utilização, nas grandes investigações policiais, como principal meio de obtenção de provas. Por isso, salutar o debate em torno das lacunas e dos pontos controversos da referida lei para que o instituto seja aplicado em conformidade com a Constituição Federal e se solidifique no sistema processual cada vez mais. Destaca-se a análise do referido instituto diante da garantia da imparcialidade do juiz, principalmente diante do desenvolvimento traçado pelas Cortes Internacionais de Direitos Humanos. Desta forma, a análise recai sobre a atuação do juiz dentro do procedimento da colaboração para questionar se garantia da imparcialidade do juiz é violada quando o juiz que sentencia o processo é o mesmo que atua na fase da investigação e que homologa o acordo de colaboração premiada. Alguns caminhos alternativos são apontados com a finalidade de construir uma melhor adequação do procedimento à garantia da imparcialidade visando evitar alegações de inconstitucionalidades e ilegalidades. Portanto, pretende-se priorizar as constatações e soluções que melhor se coadunam com as normas principiológicas que prestigiem os fins do Estado Democrático de Direito e da proteção da dignidade humana
