Issues are raised concerning the validity and reliability of background checks. Information on the status of the individual states is provided by means of a chart and a discussion ensues regarding the rationalization for requiring background checks and fingerprinting. Finally, questions and recommendations are posed regarding making background checks a requirement for licensure and/or entry into nursing schools.

Effective Hiring Process Background Check Strategies

Job applicants often falsify information in their application materials. Using the disparate impact theory as the conceptual framework, the purpose of this multiple case study was to identify strategies Human Resource professionals use to complete effective background checks while maintaining compliance with federal regulations. I collected data by interviewing executives of 3 organizations located in the Southwest region of the United States, who had successful strategies for performing background checks to identify falsified information in the application process. I assured the validity and reliability of the data by reviewing organizational documents and member checking of the interpretation of the data. Through the thematic analysis process, 6 themes emerged: employment verification, education verification, professional reference checks, criminal background checks, the cost of background checks, and background check guidelines and policies. Leaders adapting the above findings could enhance communications within their organizations, and improve the perceived transparency, profitability, and sustainability of a company. Implication for positive social change include leaders' opportunity to preserve organizational sustainability and improve the economic climate in communities in which the organization operates, resulting in corporate transparency, fair hiring practices, and a reduction of recidivism in criminal activities.

Belastningsregister : En balansgång med den personliga integriteten

At the time of the study, there is no law to prevent an employer from doing criminal background checks. Employers for School and childcare have to do criminal background checks before hiring but the background checks have increased significantly in other industries as well. The aim of this thesis is to analyze and explain what interest employers may have in jobseekers history and how it can affect people’s privacy. To do this I have used right dogmatic approach combined with four interviews with different employers to get their perspective on the subject. What the results tell us are that employers generally don't deliberate the purpose of using criminal background checks. Instead they do it mechanistically without much thought. Jobseekers personal integrity then gets pushed aside for. Theory says that criminal background checks become a major obstacle for ex-offenders in their getting back to life of law-abiding. Therefore it would be better if employers wrote down their reasons for background checks in some kind of policy documents. Most likely many employers will then realize that using other methods can fulfill their interest. / Vid studiens tidpunkt finns det inget lagligt hinder för att arbetsgivare får begära utdrag ur belastningsregistret ifrån arbetssökande. Inom skol och barnomsorg är detta ett krav på arbetsgivare men registerkontroll har ökat kraftigt även i andra branscher. Denna uppsats syftar till att beskriva och analysera intresseavvägningen mellan arbetsgivarens intresse av registerkontroll och arbetssökandes personliga integritet. För att besvara studiens frågeställningar har rättsdogmatisk metod tillämpats och kompletterats av fyra intervjuer med arbetsgivare ifrån olika yrkesbranscher. Vad som framgår av både teori och empiri är att arbetsgivare lägger förvånansvärt lite tanke på hanteringen av registerkontrollen. Studien resulterar i en stark uppmaning till att arbetsgivare som i dagsläget kräver utdrag ur belastningsregister se över sitt syfte med registerkontroll. Ifall där finns ett gediget syfte bör dessa antecknas i någon form av policydokument, men stor chans är att arbetsgivarens intresse kan tillgodoses på annat vis. Vi vet nämligen att registerkontroll utgör ett stort hinder för före detta kriminella att komma tillbaka till ett lagligt liv.

Vilken roll spelar sociala medier vid rekrytering? : En undersökning om bakgrundskontroller via sociala medier ur ett arbetsgivarperspektiv

I dagsläget har sociala medier fått en större roll i rekryteringsprocessen. Genom en induktiv ansats fokuserade denna forskning på att urskilja vilken roll sociala medier spelar då arbetsgivare bakgrundsgranskar arbetssökande. Undersökningen inriktade sig mot vad arbetsgivare tittade på samt i vilken utsträckning de lät sig påverkas av informationen i sina beslutsfattanden. Totalt intervjuades åtta personer inom personalyrket. I resultatet lyftes bland annat ett etiskt perspektiv med olika dilemman så som generationsskillnader och människosyn samt egen kritisk förmåga. Det visade sig att skillnaderna var stora i både tillvägagångssätt och värderingen av information tillgänglig online. De flesta informanterna uttryckte att de ville stämma överens informationen med vad som framkom via ansökan och intervjuer.Många uttryckte även att de samlade frågor inför en intervju, med hjälp av sociala medier.Informanterna uppvisade en stor medvetenhet gällande både den källkritiska och självkritiska förmågan. Med vissa undantag då exempelvis nyfikenheten tog över och underminerade den kompetensbaserade rekryteringen. Informanterna uttryckte att rekryteringsprocessen är underständig utveckling. Sociala medier kunde enligt informanterna ses som ett komplement till denna komplexa process men värderades inte lika högt som mötet med den arbetssökande.Den kritik som riktas mot sociala medier som verktyg kunde i slutänden istället riktas mot användaren av verktyget, det vill säga rekryteraren.

This work is intended to evaluate President Obama’s gun control policies by determining whether stricter federal gun control laws should apply within theUnited States. This paper examines whether setting legal standards at a national level would effectively reduce gun related violence and mass shootings on a local and state level. These include events such as Sandy Hook Elementary inNewton,Connecticut, the Virginia Polytechnic school shootings, and theAuroraTheatershooting inDenver,Colorado. Specifically, could executive orders proposed by the president, such as assault weapon bans, rigorous background checks on gun sales, submission of mental health records to the FBI Databases, and increased aid between states and mental health care institutions effectively reduce horrific incidences of gun related violence. Using gun control data from past and present as our research, we will determine whether stricter gun control policies have deterred violent crimes, murder rates, suicides and mass shootings. Since our research focuses on policy solutions as an alternative to reduce mass shootings, not the psychological make ups and environmental factors of mass shooters, we will omit America’s gun culture as a variable within our study: such as the effects violent video games and movies could have on the psyche of troubled individuals. After carefully analyzing gun date related to gun violence and crime, this work will attempt to suggest whether or not President Obama’s gun control policies will pass in Congress and which legislation will be the most effective in limiting gun violence and mass shootings.
