DIPLOMA THESIS A comparison of the legal regulation of the Central Bank in the CR and selected countries of the European Union Abstract The aim of this thesis is to analyze and evaluate the central bank legislation in the Czech Republic and in selected countries of the European Union. Major focus is on banks' degree of legal independence from the executive power and from potential negative impact of executive power representatives on governance of the institution as well as on monetary policy decision making. The issue of independence is closely linked to monetary stability, especially to level of inflation, where the politicians' excessive influence may result in undesirable fluctuations in the state's economy. The thesis results in a comparison of the banks' legislation and in a positive assessment on the question of selected banks' affiliation within the category of most appropriately regulated institutions. Initial hypotheses about the privileged status of the central bank of the Federal Republic of Germany and its suitability as a template for banks of central Europe's transition economies in the Nineties of 20th century are also positively evaluated. Der Einigungsvertrag vom 31. 8. 1990 (BGB I. II, 889 hat bis auf weiteres die zur Jahresmitte 1990 als neuer Abschn. 5a in das Bundesbankgesetz eingefügten Bestimmungen - §§ 25a-25d - sowohl zur Organisation als auch zu Währungspolitischen Befugnissen und zum Geschäftskreis der Bundesbank (damals noch in der (fremden) DDR, heute in den »neuen Bundesländern«) aufrecht erhalten. Der Beitrag nimmt diese Modifizierungen der Regelungen zum Anlaß, sowohl die neuen als auch die alten Vorschriften des Rechts der deutschen Währungs- und Notenbank genauer in das System des nationalen (deutschen) Verfassungs- und Verwaltungsrechts einzuordnen.

RESUMÉ - THE STATUS AND THE ROLE OF CENTRAL BANKS IN THE EU This diploma thesis compares the Czech National Bank, the Slovak National Bank, the Bundesbank and the European Central bank. Central banks play a significant role in every state and they have big influence on economy of each state. Therefore, their legal regulation as well as precise definition of their competencies are essential. The thesis focuses on their establishment, legal base and legal form, organisation and independence (institutional, financial, personal and functional). Its aim is also to compare tasks, monetary policy, issuance of banknotes and coins, banking and financial regulation and supervision. Establishment of a central bank depends significantly on the historical background of the given state (or union). All of the described banks are settled in regulations of the highest legal importance on the particular state (or union), which is not usual, and also in many other legal acts. Members of the highest body are selected after the agreement of the legislative and executive powers. The Czech National Bank is an exception, since the members of its Bank Board are appointed by the president without a counter signature. The budgets of the central banks are separated from the states' budgets and they are approved by the central banks....
