A cada transiÃÃo de governo e de seus dirigentes, observam-se interrupÃÃes de obras, projetos e programas devido à mudanÃa de gestÃo. Assim, pretende-se com o presente trabalho, analisar a continuidade orÃamentÃria no Estado do Cearà nas Ãreas de saÃde, educaÃÃo e agricultura na mudanÃa de governo LÃcio AlcÃntara para o de Cid Gomes. Para este fim, a alternÃncia entre os dois perÃodos de governo foi analisada, utilizando-se dos valores de empenho mÃdio, das funÃÃes e subfunÃÃes estatisticamente significantes, atravÃs do mÃtodo da âDiferenÃa em DiferenÃaâ. Com base nessas informaÃÃes, conclui-se que nÃo houve uma descontinuidade orÃamentÃria entre o governo de LÃcio AlcÃntara e o de Cid Gomes, nas Ãreas de saÃde, educaÃÃo e agricultura. / The administrative continuity is often reported in the media as being one of the most striking features in the Public Administration. With every change of government and its leaders, are observed interruptions works, projects and programs due to the change of management. In this sense, it was intended, with this study, analyze the budget continued in the state of Cearà in health, education and agriculture in changing government Lucio Alcantara for the Cid Gomes. For this purpose, the change between the two periods of government was analyzed, using the average values of commitment, functions and subfunctions statistically significant, through the "Difference in Difference" method. Based on this information, it is concluded that there was no budget discontinuity between the government of Lucio AlcÃntara and the Cid Gomes, in health, education and agriculture.

The Immunity Clause in the Statute of the 'African Criminal Court' and Its Impact in the Exercise of the Courts' Jurisdiction over the Crimes

Magister Legum - LLM (Criminal Justice and Procedure) / In June 2014, the AU adopted a Protocol which included in its annexe a Statute of the African Court of Justice and Human and Peoples' Rights. The Protocol proposes to expand the jurisdiction of the African Court of Justice and Human and Peoples' Rights (ACJHPR) by vesting it with criminal jurisdiction. The ACJHPR will comprise of three sections, namely, a General Affairs Section, a Human and Peoples' Rights Section and an International Criminal Law Section. The Malabo Protocol, therefore, confers the proposed ACJHPR with criminal jurisdiction over international and transnational crimes. Although the Malabo Protocol and its Statute are not yet in force, the fact that in Africa there is a possibility of having the 'African Criminal Court (ACC)' deserves a critical analysis.

Les changements de la politique de santé en Suède : Comparés avec la politique de santé en France, avec l'exemple de l'indemnité journalière

<p>After the elections in 2006 there was a change of government in Sweden, when the Moderate Party with the right block took over the power from the Social democrats. The politics of the new government is more liberal than the politics of the Social democrats, which implied several changes of the Swedish social security system, in particular some important changes of the sickness benefit.</p><p>The objective of this essay has been to examinate the changes of the system, as well as the reasons for the changes, and also to compare the system in Sweden to the one in France, who has another structure.</p><p>The methods used are archive and corpus crossings in terms of collecting information from literature and websites of the social insurance offices in Sweden and in France. Further a qualitative method has been carried out in shape of an interview with the administrative official responsible of the sickness benefit at the social insurance office in Växjö.</p><p>The result has shown that there are several reasons for the changes in the Swedish system. It seems as if the most important reason is the big number of individuals on the sick-list which causes economical problems, since the employment rate is too low compared to the retired quotient of the population. The economical crises might have an influence on the changes of the systems, but not the present recession. Despite the rather big changes from a social system towards a more liberal one, the Swedish scheme has still kept its basic characteristics.</p> / <p>En 2006, la Suède a eu un changement de gouvernement. Les sociaux-démocrates ont été remplacés par l'alliance entre les partis à droite. Le nouveau gouvernement mène une politique plus libérale que les sociaux-démocrates, et ils ont introduit plusieurs changements dans le système de santé et particulièrement dans le règlement de l'indemnité journalière.</p><p>Ce mémoire a pour but d'examiner les changements dans le système, ainsi que les raisons de ces changements.</p><p>Les méthodes appliquées sont l'archive et le corpus, puisque j'ai étudié les ouvrages relatifs à la santé ainsi que les sites Internet des institutions responsables de l'indemnité journalière en Suède et en France. J'ai aussi eu un entretien avec un employé de la Caisse de Sécurité sociale à Växjö qui s'occupe particulièrement de l'indemnité journalière.</p><p>Les résultats de cette étude montrent qu'il y a plusieurs raisons à l'origine des changements dans le système suédois. Il semble que la raison la plus importante soit le nombre croissant de personnes en arrêt maladie ce qui génère des difficultés économiques, de même la proportion de la population active par rapport aux retraités est au cœur de la problématique. Enfin, les crises économiques peuvent influencer le système, mais la crise actuelle ne semble pas avoir eu une influence importante sur les changements.</p><p>Malgré les changements assez bouleversants vers un système plus libéral en Suède, qui tend à se rapprocher légèrement du système français, le système suédois reste plus social que le système français.</p>

Effects of Disasters on Local Climate Actions: Climate Change Mitigation and Adaptation Actions

This dissertation investigates the effects of natural disasters and political institutions on municipalities' climate change policies. Although most theoretical frameworks on policy adoption highlight the roles of extreme events as exogenous factors influencing policy change, most studies tend to focus on the effects of extreme events on policy change at the national level. Additionally, the existing theoretical frameworks explaining local policy adoption and public service provision do not pay attention to the roles of extreme events in local governments' policy choices. To fill those gaps, this dissertation explores the roles of natural disasters and political institutions on municipal governments' climate change policies. It does this by applying the theory of focusing events to local climate mitigation and adaptation actions. Based on the policy change framework, the political market model, and the institutional collective action frameworks, this dissertation develops and tests hypotheses to examine the effects of natural disasters and political institutions on municipalities' climate mitigation and adaptation policies. The dissertation uses 2010 National League of Cities (NLC) sustainability surveys and the 2010 International City/County Management Association (ICMA) sustainability survey to test the hypotheses. Analytical results show that floods and droughts influence local climate change policies and suggest that local governments can take advantage of extreme events when initiating a policy change. The results also suggest that political institutions can shape the effects of natural disasters on municipalities' climate mitigation and adaptation actions.

The carbon tax as a market-based enforcement mechanism to ensure compliance with environmental law and address pollution

This study emanates from the worldwide issue of climate change, as well as the need for all nations to make an effort to reduce their carbon emissions and move towards greener economies. It delves into South Africa's current command-and-control environmental enforcement regime and highlights the pitfalls that allow major air polluters to avoid sanction of any form in many instances. This poor environmental enforcement and compliance effectively means that South Africa is unlikely to be capable of meeting targets set under international agreements. The study confirms that environmental enforcement is inadequately addressed in South Africa. This is attributable to the inherent shortcomings of command-and-control approaches, including that they are inflexible and offer few incentives for firms to modify behaviour to reduce emissions. Poor enforcement of environmental legislation results in negative externalities caused by air pollution being borne by people who did not create such pollution. The study therefore advocates the use of market-based mechanisms as an alternative to traditional command-and-control approaches to environmental enforcement. In light of the South African government's recent publication of the Draft Carbon Tax Bill, carbon taxes as a subset of market-based environmental enforcement mechanisms have the potential to better enforce the polluter pays principle. Mexico, arguably the most forward-thinking developing nation in terms of climate change mitigation, has taken numerous steps towards meeting international commitments, including the implementation of a carbon tax. While South Africa's proposed carbon tax does differ from Mexico's in some respects, the basic premise remains the same and some comparisons can be made in this regard, with accompanying lessons to be learned. Such lessons include that it is imperative that the carbon tax must be set at a high enough rate to meet international commitments whilst at the same time avoiding adverse economic effects, maintaining social welfare and stabilising economic output levels. The proposed carbon tax, while unable to achieve this on its own, is a good place to start and should be utilised in conjunction with the Draft Climate Change Bill to effectively and efficaciously bring about the required change. The proposed carbon tax undoubtedly has the potential to better hold major air polluters responsible for their CO2 and other GHG emissions. / Private Law / LL. M.
