The topic of this diploma thesis is a crime of robbery which is an offence under title two of chapter one of the special part of the Criminal Code as a crime against liberty (section 173 of Act No. 40/2009 Coll). Despite being one of the oldest delicts on our territory, its high severity and frequency in application render this topic particularly relevant. Not only does this thesis focus on the crime of robbery itself, as defined in section 173 of the Criminal Code, but it also addresses other legal provisions of the Criminal Code which are related to this topic. All compulsory elements of the facts of the criminal offence of robbery are scrutinized in detail - its object, objective side, perpetrator and subjective side. This thesis does not only analyze the basic form of robbery defined in subsection 1 of section 173 of the Criminal Code, but also the circumstances in which more severe penalties might be applied, as defined in other subsections of this section. Furthermore, the development stages of robbery and the participation in this crime are described and a comparison between the crime of robbery and a selection of other crimes is made. Ethical rules of conduct of judges in the Czech Republic This master thesis deals with ethical rules of conduct of judges in the Czech Republic. I chose the topic because in this area there is lack of scientific literature given to the topic of professional ethics in general and even less literature directly addressing the professional ethics of judges. The main objective of this thesis is to provide the most comprehensive picture of the professional ethics of judges in the Czech Republic and the resources on which it puts. The topic is brought to the reader within five chapters. The first chapter introduces the reader to the topic of ethics and its relation with morality and law and brings the view from the perspective of philosophy and legal theory. The second chapter deals with professional ethics and professional ethical codes, presents to the reader what the professional ethical code should be like. The content of the third chapter is in the first place to introduce the reader to the character and personality of the judge, his status in the legal system and, above all, the analysis of the professional ethics of judges. Approved for public release, distribution is unlimited / Presently, the uniform linear array (ULA) is the most commonly used antenna system for a sectorized cell system like the commercial cellular systems. However, in many omni-directional cell communication systems, such as the ground-based military communications, interest in using the uniform circular array (UCA) has greatly increased. This thesis examines the use of an equally-spaced circular adaptive antenna array at the mobile station for a typical coded direct sequence code division multiple access (DS-CDMA) communication system. This thesis analyzed the performance of a randomly orientated adaptive UCA in the forward channel (base station to mobile station) of a coded multi-cell DS-CDMA system. Using a 3- and 4-element UCA, the ca-pacity and performance of different cellular systems under a range of shadowing conditions, with and without an-tenna sectoring at the base station, and various user capacities were simulated using the Monte Carlo simulation. Approved for public release, distribution is unlimited / This thesis examines a circular adaptive antenna array used at the mobile station for a typical Direct Sequence Code Division Multiple Access (DS-CDMA) cellular mobile communications system. The primary objective is to reduce co-channel interference of a wideband CDMA cellular network under a multi-path fading environment. We analyzed the performance of a randomly positioned mobile terminal with a randomly orientated adaptive antenna array in the forward channel (base-station to mobile) of a multi-cell DS-CDMA system and established four performance boundaries. A single complex circular adaptive weight in each element channel of a circular adaptive array sufficiently processes narrowband signals. However, in order to process broadband signals, a tapped-delay line (transveral filter) is required. This tapped-delay line is employed because it can adjust the frequency dependent amplitude and phase. The performance of a DS-CDMA cellular system with a mobile terminal equipped with a circular array and a tapped-delay line is analyzed. It has been demonstrated that the optimization process has been extremely computationally expensive and hence minimum taps should be used for practical considerations. The results illustrated that, in general, for a four-element circular array system, a two tapped-delay line would be sufficient to equalize the broadband signal while providing a similar performance level to that of a narrow-band adaptive array system. / http://hdl.handle.net/10945/1080 / Major, Republic of Singapore Air Force

Legacy programs are used for many years and experience many cycles of use-maintenance-use-maintenance-use-etc. Source code or source code functionality is frequently replicated within these programs when it is written, as well as when it is maintained. Over time many different developers with greater or lesser understanding of the source code maintain the source code. Maintenance developers, when they have limited time or lack understanding of the program, frequently resort to short cuts that include cutting and pasting existing code and re-implementing functionality instead of refactoring. This means a specific functionality is often repeated several times, sometimes using different source code. Blocks of replicated source code or source code functionality are called code clones. Removing code clones improves extensibility, maintainability, and reusability of a program in addition to making the program more easily understood.
It is generally accepted that four types of code clones exist. Type-1 and Type-2 code clones are comparatively straightforward to locate and tools exist to locate them. However, Type-3 and Type-4 code clones are very difficult to locate with only a few specialized tools capable of locating them with a lower level of precision.
This dissertation presents a new methodology that discovered code clones by studying the functional behavior of blocks of code. Code Clone Discovery based on Functional Behavior (FCD) located code clone by comparing how the blocks of code reacted to various inputs. FCD stimulated the code blocks with the same input patterns and compared the resulting outputs. When a significant portion of the outputs matched, those blocks were declared to be a code clone candidate. Manual analysis confirmed that those blocks of code were code clones. Since FCD discovered code clones based on their black-box behavior, the actual source code syntax was irrelevant and manual inspection further confirmed FCD located code clones that included Type-3 and Type-4 code clones which are frequently excluded from code clone detection tools. FCD recognized the code clones regardless of whether or not they use identical code, similar code, or totally dissimilar code. This new technique allows for an improvement in software quality and has the potential to significantly reduce the cost of software over its lifetime.

Functional and Optimality-Theoretic Analyses of English-Arabic Code-switching in Religious Settings in the USAlnafisah, Mutleb Yossef 01 May 2019 (has links)
The majority of scholars’ work on code-switching within the sociolinguistic approach of Arabic has been mainly concentrated on the interaction of the Standard variety with other regional dialects in indigenous communities (Albirini, 2011; Bassiouney, 2006; Saeed, 1997; Soliman, 2008). Their work also extends to include the interaction of Arabic with other languages in informal and highly interactional settings (Abalhassan and Alshalawi, 2000; Safi, 1992; Sayahi, 2014). When it comes to the religious settings, their work has been solely devoted to Standard Arabic and Dialectal Arabic in Arabic countries and among Arabic native speakers (Albirini, 2011; Bassiouney, 2006; Saeed, 1997; Soliman, 2008). This thesis, in turn, investigates CS between Arabic and English in highly formal religious settings in the United States and among American Islamic preachers, non-native speakers of Arabic. It aims to enumerate the social functions of CS between English and Arabic and provides the internal optimal bilingual grammar of these speakers. To achieve these goals, two analyses have been conducted, the functional analysis and the optimality-theoretic analysis. The results of the first analysis revealed that preachers chiefly switch from English to Arabic for eight functions: (1) to use formulaic expressions; (2) to introduce direct quotations; (3) to show a level of education in the Islamic studies; (4) to show a level of education in the Arabic language; (5) to evoke Muslimness and Islamic affiliation; (6) to mark emphasis; (7) to stress the importance of a speech segment; and (8) to introduce rhyming stretches. On the other hand, they switch from Arabic to English mainly to fulfill two functions: (1) to translate the previous Arabic stretch; and (2) to simplify, explain, and clarify a segment that was previously mentioned in Arabic. The result of the optimality-theoretic analysis showed that the internal optimal bilingual grammar of American preachers is {FAITH, FACE} >> PERSPECTIVE >> {SOLIDARITY, POWER}.

However, interacting with individuals from other cultures face to face is always the best way to learn and it is favourable to travel as much as possible to other cultures in order to learn about them.
