1 Thesis abstract Settlement of the community property of spouses focused on the settlement of the rights and obligations to joint housing. Community property of spouses is a specific type of property partnership, which can exist only between spouses. The community property of spouses origins and terminates together with the marriage (with the exceptions). The termination of marriage needs to be followed by the settlement of the property. The settlement of the common property is always made on the basis of some legal institute as agreement, judgment or legal presumption. The settlement of the community property of spouses and the settlement of the rights and obligations to joint housing is the main topic of my thesis. The thesis is composed of 5 chapters, each of them dealing with different aspects of the community property of spouses: Chapter One is introductory and generally deals with the marriage. Chapter two called community property of spouses is subdivided into five parts. First part characterizes community property of spouses in general. The purpose of my thesis entitled ,,Formation and termination of marriage with regard to the proprietary aspects" is the analysis of institutions of marriage and the community property. These institutions are characterized in terms of their formation, existence and termination. The thesis is composed of six chapters, for of them dealing with formation and termination of the marriage and two of them dealing with community property. Besides these six chapters the paper also contains the introduction and the conclusion. Chapter number one contains the formation of the marriage in terms of civil law, which is analyzed marriage, bethrothment, assumptions of marriage and nuptials (eligibility for marriage, wedding statement and celebration of a betrothal), proceedings before marriage (application and documents, certificates), special ways of marriage (formation of marriage by agent, formation of marriage abroad, formation of marriage in direct danger to life fiance) and legal consequences of nuptials. Common property rights and indigenous fishing practices in the inland openwater fisheries of Bangladesh: the case of the Koibortta fishing community of Kishoregonj

Bangladesh contains one of the richest and largest inland fisheries in South Asia and the third highest inland capture fisheries in the world and has a long history, which continues to the present, of conflict and cooperation between fishers and other diverse fishing interests over access to a range of fishing environments managed under a variety of leasing and tenurial arrangements. Several fishing communities are of ancient origin and over a long period of time have developed and adapted their indigenous fishing knowledge, including technologies, fishing practices and knowledge of diverse fishing environments to manage fisheries in a variety of environmental and ecological conditions. This thesis provides a detailed ethnographic account of one such community, the Koibortta fishers of Krishnapur village in the northeast flood plain region of Bangladesh, focusing on their management practices and indigenous fishing knowledge in selected inland common property fisheries. It examines, using documentary and oral historical sources, the ways in which they have adapted aspects of their indigenous fishing knowledge to changing economic and environmental circumstances over the past 50 years. It also examines, using case studies of three water bodies, how they were able to gain short-term and insecure access to selected water bodies, partly by drawing on traditional social networks at village and multivillage levels to mobilise fishers in negotiations with leaseholders. / The thesis argues that these social networks and fishers’ capacity to adapt aspects of their fishing knowledge to new circumstances were insufficient to gain long term, secure and direct access to productive water bodies as fishers lacked strong government commitment to their long term security. The thesis concludes with a discussion of the capacity of Krishnapur fishers to manage fish resources equitably and sustainably.

Santuokos sudarymu sukuriami šeimos teisiniai santykiai: vyras ir moteris įgyja specifinį teisinį statusą – tampa sutuoktiniais, o kartu perima asmenines neturtines ir turtines teises ir pareigas. Sutuoktinius, įgyvendinant turto valdymo, naudojimosi ir disponavimo teises, sieja glaudūs tarpusavio priklausomybės, artimi santykiai, kurie iš esmės sudaro jų teisinių santykių turinį. Santuoką sudariusių asmenų turtinių santykių aiškumas tampa ypač aktualiu klausimu užtikrinant bei apsaugant tiek pačių sutuoktinių, tiek trečiųjų asmenų interesus, kadangi, nesudarius vedybų sutarties, bet koks susituokus įgytas turtas tampa bendrąja jungtine nuosavybe. Sutuoktinių nuosavybės teisės į individualią įmonę , kaip turtinį kompleksą, ją įkūrus po santuokos sudarymo, ir yra šio darbo objektas. Viena kylančių problemų susijusi su neapibrėžtumu, tarpusavyje lyginant Lietuvos Respublikos Civiliniame kodekse ir LR Individualių įmonių įstatyme įtvirtintas normas: remiantis CK formulavimu, santuokos metu įsteigta įmonė priskirtina bendrajai jungtinei nuosavybei, tuo tarpu IĮ įstatyme reglamentuojama, kad IĮ steigėju ir savininku gali būti tik vienas fizinis asmuo, šiuo atveju – vienas iš sutuoktinių. Šio darbo tikslas - išanalizuoti, ar IĮ gali turėti kelis savininkus. / Family relations are established by conjugnality of a man and a woman: they come into position of a husbant and a wife and obtains personal property and non-property rights and interests. Wedded persons are bond by close interdependence ties that make the essence of their legal relations. The clarity of property relations of wedded persons is very important to secure and protect not only their, but also the interests of third parties, i. e. creditors, because in the absence of wedding contract, property acquired during the marriage is automatically presumed to be owned jointly by both spouses. The ownership of a company organized as a sole proprietorship that is established by one of the spouses while being in marriage is the object of this work. The problem of interdetermination arises while seeking to determine the ownership rights of spouses to a SP: Lithuania‘s Civil Code sets the rule that company established during the marriage is presumed to be an object of community property, whereas the Statute of Sole Proprietorships‘ allows a company organized as SP to be owned by a single person, in this instance – one of the spouses. The issue of this work is to analyse if a company organized as SP may have a few owners.

Magistro darbe atskleidžiamos bendrosios dalinės nuosavybės teisės daugiabučiuose namuose problemų kilimo priežastys ir prielaidos, nagrinėjamos dažniausiai pasitaikančios problemos šios nuosavybės valdymo, naudojimo ir disponavimo ja procese, siūlomi problemų sprendimo būdai. Bendrosios dalinės nuosavybės teisės daugiabučiuose namuose įgyvendinimo problemų yra visuose šios teisės įgyvendinimo etapuose. Šios problemos yra sąlygotos tiek objektyvių, tiek subjektyvių veiksnių: tai didelis daugiabučių namų skaičius bei ženkli juose gyvenančių gyventojų dalis, nuosavybės teisę į butus ir kitas patalpas turinčių asmenų nevienodas teisinis statusas, didesnės dalies daugiabučių namų senas amžius bei prasta būklė; taip pat finansinis didelės dalies gyventojų nepajėgumas, skirtinga namo gyventojų socialinė padėtis ir poreikiai, teisės aktų netobulumas. / This master’s degree thesis reveals causes and assumptions of common partial property right in the blocks of flats problems, analyzes the most common problems, which occur in the process of property management, use, and disposal, and also provides solutions. Problems occur in all steps of common partial property right in the blocks of flats implementation. These problems are caused by objective and subjective factors: the large number of apartment houses and significant part of residents, unequal legal status of people, who have the property right of apartments and other premises, poor condition of majority of the apartments; also financial incapability of many residents, different social situation and needs of a building residents, and imperfection of legal acts.

The conservation of biodiversity inside and outside protected areas

In recent decades there has been a push to try and include communities in natural resource conservation initiatives. This thesis uses a multidisciplinary approach and a series of case studies in the Ecuadorian Amazon to look at the role that common property regimes can have in conservation initiatives. Results show that community managed forests can have positive conservation outcomes. Local communities, however, will often integrate into local market economies creating significant tradeoffs between livelihoods, local management decisions and natural resource conservation. Nonetheless, resource scarcity can drive the evolution of local resource management institutions and communities have the potential to accurately monitor changes in natural resources. These results suggest that local communities have the potential to play an important role in conservation practices but that local economic incentives can affect the way in which communities manage their resources.

As a result of the profound influence of theories of collective action such as The Tragedy of the Commons, The Prisonerâ s Dilemma Game, and The Logic of Collective Action, policy analysts have recommended external management, either by government control or market participation, as the most efficient option to govern common pool resources. However, due to the repeated failure of the external intervention, a new alternative has been considered, the common property rights. Due to their long term interaction with the resources, local users have developed mechanisms, rules, and institutions that can be used to favor the sustainable management of the resources. Recognizing these benefits in places where the government has nationalized the resources, it has started a process of decentralization of property rights of natural resources to local users. The purpose of this paper is twofold, to analyze the potential benefits that a common property right regime has in the management of the environmental resources, and to evaluate which are the key factors for this arrangement to succeed. Measuring Natural Resource Scarcity Under Common Property Environment and Uncertainty: An Interpretive Analysis

The issue of natural resource scarcity has so far been addressed in the literature on the basis of various measures such as the unit cost of production, the relative market price, and the shadow price of a resource. Although it has been recognized that there exists some kind of jointness (sometimes inseparable) between an extractible resource and its surrounding environment, none of the measures, either theoretically or empirically, have included this concern. In order to extract and use a natural resource (e.g., coal) the environment (air, water, etc.) must also be used as a repository of the discharged wastes (e.g., sulphur oxides, nitrous oxides, particulates, etc.) . Moreover, if there is a mandated level of the environmental resource (e. g., clean air) that has to be maintained, then certain additional costs must be borne by society (firms utilizing the resource). Thus, in evaluating the scarcity of an extractible resource, the relative position of the environmental resource also must be evaluated. The present study has incorporated such jointness in the evaluation of the measure of resource scarcity. The theoretical model has been developed in an optimal control framework. It has been analytically shown that this new measure of resource scarcity would indicate a different trend compared to earlier ones. The measure of resource scarcity developed in this study captures previous measures as special cases. In an uncertain world, when the impacts of use of an extractible resource on the environment is not known the stock size of the environmental resource becomes uncertain. It has been analytically shown that in a situation of uncertain environmental stock the scarcity indicator would indicate a relatively slower extraction compared to that of a deterministic world. Empirical investigations in this study suggest that coal in use might be becoming relatively scarce if one considers the use of it in the electricity industry as the major use, compared to a situation where no environmental concerns are in effect.

The topic of this Master thesis is Matrimonial property law, that is encoded within the Act no. 89/2012 Sb., Civil Code. The aim of this thesis is to analyze and describe current matrimonial property law regime, mainly the community property regime. The focus is on defining the legal framework of the community property regime and its modification options, such as community property contract or court decision. It also provides a look at the possibilities of protection and defense of the so called debt- free spouse. The text of the thesis is divided into seven chapters, introduction and conclusion. The first chapter provides a definition of some basic terms, such as the matrimonial property law and community property regime. The second chapter focuses on the legal provisions of the community property regime, meaning the general regime. It describes the scope of the community property regime, the assets and liabilities within and out of the scope of the community property.
