Sustentamos que o órgão não é uma burocracia insulada, mas sim um órgão que pode, como qualquer outra instituição, assimilar interesses políticos e ideológicos dos governantes do momento e atuar em função destes. Argumentamos que isso vale também para seu comportamento nos anos de institucionalização do regime ditatorial no Brasil. Procuramos compreender como o Ministério se comportou analisando três processos principais: o expurgo realizado no órgão, a formulação da política externa do novo regime e o esforço de legitimação internacional do mesmo por meio da diplomacia. Para avaliar nossa hipótese, utilizamos a literatura especializada, os principais documentos oficiais do período e duas bases de dados exclusivas: a primeira, dos diplomatas brasileiros (1889 a 2010) e, a segunda, de eventos de política exterior (1930 a 1985). Com isso, a dissertação nos ajudará a compreender como o Itamaraty reagiu frente a mudanças do regime governamental e as consequências disso para a própria organização diplomática. / This dissertation examines the role of the Brazilian Ministry of Foreign Affairs (MREItamaraty) after the March 1964 coup d’État, specifically during the administrations of Castelo Branco (1964-1967) and Costa e Silva (1967-1969). We argue that the Ministry is not an insulated bureaucracy, but rather an organ that can, as any other government agency, assimilate the political and ideological interests of the ruling groups and act based on them. We argue that this holds true for its behavior during the institutionalization of the dictatorial regime in Brazil. We tried to understand how the MRE behaved through the analysis of three main processes: the purge carried out in the institution, the foreign policy formulation of the new regime, and its effort to gain international legitimacy through diplomacy. In order to evaluate our hypothesis, we used the specialized literature on the subject, the main official documents of the period, and two exclusive databases: the first, a database on Brazilian diplomats (from 1889 to 2010); the second, a database on foreign policy events (from 1930 to 1985). By doing so, this dissertation will help us understand how Itamaraty responded to regime changes and the consequences for the diplomatic organization itself. / Este trabajo aborda el papel del Ministerio de las Relaciones Exteriores (MRE-Itamaraty) con posterioridad al golpe de Estado de marzo de 1964, específicamente durante las gestiones Castelo Branco (1964-1967) y Costa e Silva (1967-1969). Trata-se do estudo da casuística internacional sobre as violações cometidas pelos Estados Unidos da América contra o artigo 36 da Convenção de Viena sobre Relações Consulares de 1963. A Corte Internacional de Justiça e a Corte Interamericana de Direitos Humanos interpretam, regulamentam e aprimoram o direito de informação sobre assistência consular para preso estrangeiro, que deixa de ser visto como um direito puramente inter-Estatal por ambos os tribunais. Abordamse questões de Direito Internacional Público, como a força vinculante das decisões da Corte Internacional de Justiça, e sua íntima relação com o direito interno do Estado parte do tratado, inclusive com relação aos Estados terceiros ao litígio internacional, como o Brasil. Em sendo um componente do pacote das garantias do devido processo legal, o prejuízo causado ao réu estrangeiro pela falta de informação sobre o direito de assistência consular pode ensejar o reconhecimento de nulidade processual penal absoluta. / This is the study of international cases relating the violations committed by the United States of America against the article 36 of the Vienna Convention on Consular Relations of 1963. The International Court of Justice and the Inter-American Court of Human Rights have the opportunity to interpret, regulate and enhance the right to information on consular assistance to foreign detainee, who is no longer seen as a purely inter-State law by both Courts. The study addresses issues of Public International Law, as the binding force of decisions of the International Court of Justice, and its close relationship with the Domestic Law of the State party to the treaty, including with respect to third states to the international dispute. Considered a human right, part of the package of guarantees of due process, the demonstrated prejudice caused to the foreign defendant for lack of information about his right to consular assistance may cause the recognition of absolute nullity of criminal procedure.

This thesis deals with the diplomatic and consular privileges and immunities - first theoretically and then with the application by the International Court of Justice in the "Case concerning diplomatic and consular stuff in Tehran." The thesis emphasises the importance of an observation of these privileges and immunities by the international community and its relevance within the public international law. The thesis is divided into the introduction, 5 main chapters and the conclusion. First chapter is focused on the diplomatic and consular privileges and immunities in general. It deals with basic concepts as well as with a list of diplomatic and consular privileges. The Part about immunities according to Vienna convention on Diplomatic and Consular relations is included here too. This chapter also focuses on obligations of the diplomatic and consular stuff in relation to the receiving state. Second chapter states obligations of the receiving state in relation to the diplomatic mission, consular post and their stuff and also certain rights that the receiving state is authorized to demand. M. Tech. Language Practice / This study seeks to investigate intercultural communication between employees at a French-speaking West African embassy in Pretoria. Thirty (30) research participants were selected by means of convenient and voluntary sampling techniques. The study followed a qualitative case study research approach, and used three instruments to collect its data: observation, recording and interviews. It analysed its data through conversational and content analyses. The findings of this study aimed to improve intercultural communication interaction between French and non-French-speaking employees in order to promote a friendlier intercultural environment.

James Keenan served as United States consul to Hong Kong for eight years beginning in 1853. Keenan's career demonstrated the difficulties faced by United States consuls in the Far East. Many of the problems Keenan faced during his career resulted from the juxtaposition of a man predisposed to controversy with one of the most ambiguous posts in United States consular service. Keenan's career involved him in difficulties with a United States naval commander, British authorities in Hong Kong, a United States commissioner to China, his temporary successor in Hong Kong, and even the State Department. During his career, Keenan anticipated legislative changes regarding United States consuls. Nevertheless Keenan's colorful career won him many British and American friends. However, his predeliction for controversy damaged his effectiveness as United States consul.

Tout au long de son histoire, le réseau des chambres de commerce et d’industrie s’est révélé être un acteur majeur du soutien aux entreprises et du développement économique de leur territoire. Conscient des profondes mutations de l’environnement des entreprises, il s’est engagé depuis plusieurs années dans un important mouvement de réformes qui a abouti à la loi du 23 juillet 2010 relative aux réseaux consulaires, au commerce, à l’artisanat et aux services. Censée rationaliser le fonctionnement du réseau des chambres de commerce et d’industrie, cette loi est le fruit d’un difficile compromis. La réforme reste « au milieu du gué », avec son lot de difficultés et d’incohérences. A l’heure de la modernisation de l’action publique, il semble que le réseau des chambres de commerce et d’industrie n’a pas souhaité s’attacher davantage à poursuivre plus en avant les concepts de mutualisation ou de fusion. Or, nombre de nos voisins européens ont déjà opté pour une stratégie de regroupement rationnel de ces structures consulaires - chambres de commerce et d’industrie, chambre de métiers et de l’artisanat, chambres d’agriculture - en une seule et unique structure. Par conséquent, la présente thèse s’interroge légitimement sur la pertinence d’une telle réforme en demi-teinte. / Throughout its history, the network of the Chambers of commerce and industry has demonstrated its capacity to support the enterprises and the economic development of territories. Aware of the profound changes of their environment, the Chambers of commerce have been part of an important reforming process for years, completed with the passage of the Act of July 23, 2010 regarding Chambers of Commerce and Industry, Trade, Crafts and Services. Anyhow, the Act of July 23, 2010, expected to be rationalizing the functioning of the Chambers of commerce and industry network, is a compromise borne out of difficult and complex negotiations. The reform remains incomplete, with its share of difficulties and inconsistencies. At the time of the streamlining of global public policies, the fact that the consular network has been unwilling to pay greater attention to the concepts of mutualizing or merger could appear to be detrimental. Indeed, many of our European neighbors have already adopted a rational consolidation strategy of these consular structures - the Chambers of Commerce & Industry, the Chambers of Trades and Crafts and the Chambers of Agriculture - in a single structure. Therefore, it seems fair to question the relevancy of such an unachieved reform.

I compare their position with the position of the career consular offices and officers. Among main variables which I follow in my thesis belong the rights and the immunities, the functions and the distinctions in the essence of two consular classes of officers. To achieve my goal I used beside traditional methods also questionnaire designed for honorary consuls of the Slovak republic.

O foco desta tese é a relação comercial entre três pólos principais: Brasil, Portugal e Hamburgo. Em dois momentos distintos, antes da abertura dos portos, quando o Brasil é uma colônia portuguesa e, posteriormente, quando se torna um país autônomo. O fluxo comercial de Hamburgo com o Brasil, através de Portugal, é intenso a partir de 1796, ano em que as balanças de comércio o registram regularmente. Sendo mesmo Hamburgo, ao contrário do que se costuma pensar, o principal importador de efeitos coloniais brasileiros e, por decorrência, seu principal consumidor e distribuidor na Europa do Norte e Oriental. Depois da abertura dos portos, o movimento se retraiu, mas se recuperou nos anos seguintes a paz na Europa após a queda de Napoleão, voltando a ter papel significativo com a proclamação da Independência brasileira em relação a Portugal. Os principais produtos nesse estratégico comércio e importação hamburguesa era, sobretudo, o açúcar, couros e algodão. As fontes para o estudo foram as Balanças Gerais de Comércio de Portugal com seus Domínios e Nações Estrangeiras, as Balanças Comerciais de Hamburgo e os relatórios e as cartas consulares. / The present work focus on the commercial relationship among the tree key poles Brazil, Portugal and Hamburg in two distinct moments: before the opening of the ports, when Brazil was a Portuguese colony, and afterwards, when Brazil became an independent country. The commercial flow from Hamburg to Brazil, through Portugal, is intense from 1796, the year when the trade balance started to register it regularly. In fact, contrary to what one may think, it was Hamburg the main importer of the effects from Brazil colony and therefore its major consumer and distributor along Northern and Oriental Europe. After the opening of the ports, the flow had retread but the peace recovered it on the following years, especially after Napoleons fall when the flow had played a major role with the proclamation of the Brazilian Independence from Portugal. Sugar, leather and cotton were, above all, the principal products in this strategic trade and in the Hamburguese importation. The source of the study was the General Balance of Trade between Portugal and his Colonies and Nations, Hamburgs Balance of Trade, reports and consular letters.
