Contributory intend as a defence limiting or excluding delictual liability

“Contributory intent” refers to the situation where, besides the defendant being at fault and causing harm to the plaintiff, the plaintiff also intentionally causes harm to him- or herself. “Contributory intent” can have the effect of either excluding the defendant’s liability (on the ground that the plaintiff's voluntary assumption of risk or intent completely cancels the defendant's negligence and therefore liability), or limiting the defendant’s liability (where both parties intentionally cause the plaintiff's loss thereby resulting in the reduction of the defendant’s liability). Under our law the "contributory intent" of the plaintiff, can either serve as a complete defence in terms of common law or it can serve to limit the defendant's liability in terms of the Apportionment of Damages Act 34 of 1956. The “Apportionment of Loss Bill 2003” which has been prepared to replace the current Act provides for the applicability of “contributory intent” as a defence limiting liability, but it is yet to be promulgated. / Criminal and Procedural Law

This diploma thesis focuses on economy and accounting of contributory organizations using a specific example: primary school. The first part mentions the general specifications of contributory organizations, their establishment and their founders. The legal regulations governing these subjects are also thoroughly discussed. Then the thesis addresses the salaries paid out to personnel within the school system. Also is introduced the Základní škola a mateřská škola Stehelčeves. The incomes and costs of contributory organizations are analysed using specific data from the subject in the following chapters. The last chapter is theoretical and discusses the accounting specifications of the contributory organizations and schools.

Characteristics and contributory causes associated with fatal large truck crashes

Master of Science / Department of Civil Engineering / Sunanda Dissanayake / One-ninth of all traffic fatalities in the United States (U.S.) in the past five years have involved large trucks, although large trucks contributed to only 3% of registered vehicles and 7% of vehicle miles traveled. This crash overrepresentation indicates that truck crashes in general tend to be more severe than other crashes, though they constitute a smaller portion of vehicles on the road. To study this issue, fatal crash data from the Fatality Analysis Reporting System (FARS) was used to analyze characteristics and factors contributing to truck-involved crashes. Driver, vehicle, and crash-related contributory causes were identified, and as an extension, the likelihood of occurrence of these contributory causes in truck-involved crashes (with respect to non-truck crashes) was evaluated using the Bayesian Statistical approach. Likelihood ratios indicated that factors such as stopped or unattended vehicles and improper following have greater probability of occurrence in truck crashes than in non-truck crashes. Also, Multinomial Logistic Regression was used to model the type of fatal crash (truck vs. non-truck) to compare the relative significance of various factors in truck and non-truck crashes. Factors such as cellular phone usage, failure to yield right of way, inattentiveness, and failure to obey traffic rules also have a greater probability in fatal truck crashes. Among several other factors, inadequate warning signs and poor shoulder conditions were also found to have greater predominance in contributing to truck crashes than non-truck crashes. By addressing these factors through the implementation of appropriate remedial measures, the truck safety experience could be improved, which would eventually help in improving overall safety of the transportation system.

The contributory factors in drug errors and their reporting

The aim of this thesis is to examine the contributory factors in drug errors and their reporting so as to design an enhanced reporting scheme to improve the quality of reporting in an acute hospital trust. The related research questions are: 1. What are the contributory factors in drug errors? 2. How effective is the reporting of drug errors? 3. Can an enhanced reporting scheme, predicated on the analysis of local documentary and interview data, identify the contributory factors in drug errors and improve the quality of their reporting in an acute hospital trust? The study aim and research questions reflect a growing consensus, articulated by Boaden and Walshe (2006), that patient safety research should focus on understanding the causes of adverse events and developing interventions to improve safety. Although there are concerns about the value of incident reporting (Wald & Shojania 2003, Armitage & Chapman 2007), it would appear that error reporting systems remain a high priority in advancing patient safety (Kohn et al 2000, Department of Health 2000a, National Patient Safety Agency 2004, WHO & World Alliance for Patient Safety 2004), and consequently it is the area chosen for intervention in this study. Enhancement of the existing scheme is based on a greater understanding of drug errors, their causation, and their reporting.

Topic of the diploma thesis is the position of nonprofit and contributory organizations in czech formal and informal education. The theoretical part describes the position of nonprofit organizations in formal and informal education. Attention is paid to definition of the terms non-profit and contributory organization, the concepts of formal and informal education and the laws regulating the action of non-profit and contributory organizations in the field of education in the Czech Republic. In the practical part, the qualitative survey is realized, focused on the position of nonprofit and contributory organizations in the field of formal and informal education from the perspective of their directors. The research based of semi- structured interviews with directors of the nonprofit organizations finds what positive an negative effects influences activities of the stated organizations in formal and informal education and how is the cooperation with state authorities. Among the most important findings is, that the nonprofit sector is fully established in both formal and informal education in the Czech Republic, the availibility of grants is good, although the administrative burden is very high.
