“Tax evasion as a predicate offence for money laundering”

Magister Legum - LLM / This paper discusses the progress of international anti-money laundering (AML) law with regard to making tax evasion a predicate offence for the crime of money laundering (ML). This paper will focus particularly on the recent amendments that the Financial Action Task Force (FATF) made to its 40 + 9 Recommendations. The FATF Recommendations are recognised as the global AML standards. The amendments to these have resulted in tax crimes being made designated offences for ML. The aim of this paper is to reconstruct the rationale behind this change and to assess the implications of bringing fiscal crimes under the AML regime.

Observer reactions to victims: an equity theory approach

Among the many problems that victims may face in the aftermath of victimization, a commonly noted yet infrequently studied phenomenon is that of victim disregard. Victims are often ignored by the people they would normally look to for assistance. It was proposed that equity theory might provide a useful framework for understanding this phenomenon. Equity theory suggests victims are ignored because helping is sometimes equity based rather than victim-need based. According to equity theory, learning of victimization threatens an observer's sense of equity. Helping (in the present case, compensation) is only one way of reducing inequity; if other methods of inequity reduction are used (in this case, perpetrator punishment), equity may be restored without the victim being assisted. In five studies, victim compensation (the dependent variable) was hypothesized to vary as a function of perpetrator punishment. / Master of Science

Automating case reports for the analysis of digital evidence

The reporting process during computer analysis is critical in the practice of digital forensics. Case reports are used to review the process and results of an investigation and serve multiple purposes. The investigator may refer to these reports to monitor the progress of his analysis throughout the investigation. When acting as an expert witness, the investigator will refer to organized documentation to recall past analysis. A lot of time can elapse between the analysis and the actual testimony. Specific reports may also be used in court as visual aids. Not all cases make it to court, but corporate managers will still likely want to review a case report. Since digital forensics is a relatively new field and can have a high learning curve, reports may be used as a mechanism for sharing knowledge of digital forensic practices. Existing open source forensics tools are an inexpensive alternative to commercial products, but lack the functionality to generate case reports. Open source tools are more likely to be accepted by the professional forensics community with this added capability. This thesis adds case report features to the Sleuth Kit and Autopsy Forensic Browser suite of tools, the premiere open-source forensics analysis software currently available.

Bloom Filters for Filesystem Forensics

Digital forensics investigations become more time consuming as the amount of data to be investigated grows. Secular growth trends between hard drive and memory capacity just exacerbate the problem. Bloom filters are space-efficient, probabilistic data structures that can represent data sets with quantifiable false positive rates that have the potential to alleviate the problem by reducing space requirements. We provide a framework using Bloom filters to allow fine-grained content identification to detect similarity, instead of equality. We also provide a method to compare filters directly and a statistical means of interpreting the results. We developed a tool--md5bloom--that uses Bloom filters for standard queries and direct comparisons. We provide a performance comparison with a commonly used tool, md5deep, and achieved a 50% performance gain that only increases with larger hash sets. We compared filters generated from different versions of KNOPPIX and detected similarities and relationships between the versions.

The prevalence of post-traumatic stress disorder (PTSD) in school children in a black township

It was, therefore, assumed that these children would react negatively to the exposure to traumatic events. The researcher thus set out to determine the degree to which crime and other traumatic events were affecting children, particularly those living in the black townships. It was hypothesized that due to the level of violence and other traumatic events occurring in the townships on the one hand and children’s vulnerability on the other, there would be a heightened prevalence of posttraumatic stress disorder. Method 797 children from 18 schools in Sebokeng Township, south of Johannesburg, were administered questionnaires to assess the presence of PTSD. While children were selected on the basis of age and availability, selection of schools was random. Children were administered the questionnaires in groups in their classrooms. The researcher, together with an aide was present in the administration in order to help children understand and answer the questions. Findings The study revealed a higher presence and prevalence of PTSD. Significant proportion of children reported to have been suffering from all PTSD criterion groups. Although there were gender differences in the proportion of children who met various PTSD criterion groups, no gender differences existed in the scores obtained by the children. Age was shown to have no relation to PTSD. Using the ANOVA, significant differences existed across schools.
