Theft by corporate controllers

Smukler, Elana 01 1900 (has links)
The pillaging of companies by those who control them is becoming a common occurence in South Africa. The problem arises where those in control of a company are its sole shareholders and the property they are charged with stealing, though not legally belonging to them, is vested in an entity which itself belongs to them. One defence is that there can be no theft where the company consents to the appropriation of its funds. It is argued that a theft is committed only where all the criminal elements of the crime of theft are satisfied, notwithstanding the consent, or absence thereof, by the company. Case law indicates that a conviction depends on the : solvency or insolvency of the company; degree of control and victim of the appropriation. It is submitted that it is inappropriate to base a conviction on these criteria. All abuses of the corporate structure should be punished. / Mercantile Law / LL. M.

Victim-offender relationships in crimes of violence.

Simon, Leonore. January 1991 (has links)
Although societal interest in violence is not new, the lay public and legal and mental health professionals have become increasingly interested in distinguishing nonstranger and stranger violence. The importance of the victim-offender relationship is underscored by the fact that society appears to be less fearful of the nonstranger offender than it is of the stranger offender. This research explores the role of the victim-offender relationship in crimes of violence. Inmate self-report, official data, and prison infraction data were used. All data collection occurred within the Arizona state prison system and included 273 inmate subjects who committed violent offenses. The victim-offender relationship was studied in the context of the validity of offender self-report, the prison experience of inmates, criminal justice processing of offenders, recidivism of offenders, specialization of offenders, and offender's perception of victim contribution. Results suggest that the violent offender self-report is valid and reliable, and that stranger and nonstranger offenders are similar in some ways and different in others. In particular, stranger offenders have more disciplinary problems in prison; are charged and convicted of less serious crimes but are given longer sentences; have more extensive juvenile records and histories of drug abuse; are more likely to have been in prison before; do not have more extensive self-reported crime commission rates; are no more or no less likely to specialize; and are less likely to perceive victim contribution than nonstranger offenders. Conclusions and implications for public policy are discussed.

Le noyau dur des crimes internationaux (core international crimes) commis envers les individus, particulièrement contre les membres des minorités : l'une des variables de l'essor du nouveau système international / Core international crimes committed against individual, particularly against minority members : as a variable of the emergence of new international system

Kulali, Yeliz 09 June 2015 (has links)
Crimes against humanity, crimes against peace, war crimes and genocide constitute the hard core of most threatful acts to human and international security. They have been codified through the statutes of international criminal tribunals. Transnational crimes or treaty crimes are not codified in these statutes or they are narrowly codified. Examples of such crimes include the apartheid, torture, slavery, maritime piracy, and terrorism. According to the rules of international system transformation as defined by Morton Kaplan, one variable of the international system entails transformations and plays a role in the emergence of international systems. In this study, the hard core of international crimes is considered as one of the variables of the system. Thus, the bipolar system (1945-1991), the new world order (1991- 2001) and the new system after September 11 attacks are analysed. International Tribunals such as Nuremberg, Tokyo, for the former Yugoslavia, Rwanda and the International Penal Court constitute case studies.

Atrocity, Commerce and Accountability: Corporate Responsibility for International Crimes

Stewart, James Graham January 2013 (has links)
In recent decades, the prospect of holding corporations and their representatives responsible for international crimes has emerged as an important component of a number of interlinked fields. While these ideas have become widely acknowledged, the scope of the relationship between commerce and international criminal justice has remained poorly understood among theorists and seldom implemented in practice. In large part, both these phenomena result from a lack of familiarity with the diverse fields one must traverse in order to speak with any degree of confidence about the role of international criminal justice as a means of regulating globalized markets. In what follows, I introduce how my work for the JSD has explored three different but necessary areas of law that underpin these analyses. Specifically, this final essay provides a narrative of how this work emerged for me, the normative hypotheses that have informed my JSD, and the three core projects I have undertaken in international criminal law, the theory of complicity, and corporate criminal liability to move this agenda forward.
