Recognizance of a debt The thesis aims to provide overview of judicial and doctrinal solutions of particular issues regarding the recognizance of a debt (as governed by the Czech Commercial Code) and to discuss to what extent the generally accepted solutions could stand up once the Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the "New Civil Code") becomes effective. Following the general introduction the recognizance of a debt is described together with similar legal instruments. Then the thesis focuses on particular issues associated with the instrument of recognizance of a debt, such as methods of identification of the debt being recognized, relationship between recognizance of a debt and set-off, ways of explicit and implicit recognizance of a debt etc. The thesis emphasizes the judicial solutions of these issues and the respective doctrinal scrutiny. The commercial law regulation (as governed by the Act No. 513/1991 Coll., the Commercial Code) is of the main importance. If appropriate, the civil law regulation (as governed by the Act No. 40/1964 Coll., the Civil Code) is used. This essay inquires of retirement system in Slovakia. In the first theoretical part author brings the retirement system in, its evolution and character. Also inform about genesis of reform and introduce its legislative basic. In the second part of essay author analyses period of time when the government was changed twice. Every government set up the pension system according to its ideas. The main target of this essay is to recalculate that changes and point at real impact in form of deficit, public debt or in form of saver.

Diplomová práce se zabývá analýzou vývoje mandatorních výdajů, zejména sociálních transferů v období po vstupu České republiky do Evropské unie. V první části detailněji analyzuje vývoj a strukturu mandatorních a quasi mandatorních výdajů a krátce se věnuje i teoriím růstu veřejných výdajů. Ve druhé kapitole je podrobněji rozpracován jejich vývoj v období 2004 -- 2008 s důrazem na schválená legislativní opatření společně s jejich důsledky. Závěrečná kapitola se věnuje vývoji nejvýznamnějších položek mandatorních výdajů se vztahem k lidskému kapitálu, zejména dávkám důchodového pojištění.

Tato diplomová práce je rozdělena do 4 hlavních kapitol. První kapitola popisuje teoretický vývoj a náhled na deficitní financování veřejných rozpočtů. Druhá kapitola je zaměřena na popsání vývoje státního dluhu v období 1997-2006. Hlavní část práce je věnována analýze mandatorních výdajů se zaměřením na důchodový systém. V závěrečné kapitole jsou nastíněny možné varianty řešení státního dluhu.

The thesis deals with the impact of fiscal policy on economic development and is divided into theoretical and analytical part. The theoretical part of the thesis describes macroeconomic performance indicators, the operating principles of state economic policy and economic cycle including its phases and his possible causes. Next part deals with the functioning of fiscal policy including its types, measures and problems associated with it. There is also outlined the issue of the formation of the state budget and the public debt. The analytical part is primarily monitored developments in the gross domestic product, unemployment and inflation rates within the reporting period. The following section provides an analysis of state budget and public debt of the Czech Republic, especially in the connection with the development of the budget balance and structure of expenditure and revenue side of the budget. Examined topic is given in correspondence with the fiscal measures undertaken. The thesis is also a comparison of domestic development with neighboring countries and the EU average. Finally there is a synthesis of the ascertain results.

The creditor protection law within corporate debt financing Abstract In this paper I have dealt with the protection of a creditor in debt corporate financing, where the debtor is a capital company. In this case, there are relatively specific conflicts of interest between creditors on one hand and shareholders on the other. This is due, in particular, to the characteristics of a capital company where the shareholders are not liable for the liabilities of the company (or they are limited in their liability) and are not responsible for their decisions, while the assets of the company are separated from the assets of the shareholders. Shareholders and creditors thus make competition for company assets. While the shareholders want to realize their investment as quickly as possible, they stand in an imaginary queue as residual creditors of the company at the end. This may lead to their attempt to overtake fixed creditors. This motivation culminates especially in situations where the company is in financial difficulties. Shareholders are aware of the fact that in case of insolvency, no company assets will be distributed to them. Svoji diplomovou práci jsem zaměřil na problematiku spojenou se státním dluhem. Práci jsem rozdělil do tří kapitol. První část obsahuje ekonomickou teorii vztahující se ke státnímu dluhu a veřejným financím jako celku. Poté následuje vývoj státního dluhu mezi roky 1993-2005. Po úvodní kapitole následuje část věnovaná řízení státního dluhu a transformačním institucím. V této části najdeme informace o struktuře státního dluhu, způsobech financování státního dluhu a také o možných rizicích týkajících se státního dluhu. Dále jsou zde informace o poskytnutých státních garancích a činnosti České konsolidační agentury. Následuje třetí kapitola. Na začátku kapitoly je provedena predikce budoucího makroekonomického a demografického vývoje. Na tuto predikci navazuje část věnující se mandatorním výdajům a jejich budoucímu růstu pod tlakem stárnutí populace. Jako další jsou zde vyčísleny celkové náklady transformace české ekonomiky a to mezi roky 1991-2004. Následuje část věnující se problematice rozpočtové disciplíny a také chování politiků při rozpočtovém procesu.

Práca sa zaoberá problematikou financovania akvizícií metódou LBO. Popisuje podstatu financovania akvizície úverovou pákou, rozoberá motívy pre zrealizovanie LBO ako aj prínosy a možné riziká vyplývajúce z LBO transakcie. Práca charakterizuje úrovne a druhy akvizičného dlhu (Prioritný dlh, Mezanínový dlh) a popisuje celkový proces štrukturovania LBO transakcie. Rozoberá prístup banky k akvizičnému financovaniu a pojednáva o základných technikách financovania LBO prostredníctvom banky. Práca zahrňuje praktické príklady LBO transakcií a obsahuje vývoj na trhu LBO a trendy financovania LBO.

This thesis dedicates the introductory section to definitions of basic terms of the chosen topic. Here is clarified the issue of public finance and budgets, functions of the state budget and the revenue and expenditure sides. This thesis is focused on drafting of the causes of the public debt, together with the effects of debt and the possibilities to reduce it. Public sector structure is presented within its categorization, including the national debt, government debt and public debt. The second part of this thesis examines the development of public debt in the Czech Republic along with the development of the national debt and government debt. The conclusion is dedicated to the evaluation analysis of mutual conditionality of public debt and selected variables along with recommendation to reduce the debt of the Czech Republic.

Práce analyzuje vývoj stavu a struktury zahraničního zadlužení u nových členů EU a vyspělých států západní Evropy. Zadlužení analyzuje ve vztahu k vývoji struktury běžného účtu platební bilance. Jednotlivé země srovnává na základě několika nejdůležitějších ukazatelů zkoumajících solventnost a likviditu. Data srovnává s ekonomikami jižní Asie a Jižní Ameriky. V teoretické části práce definuje zahraniční zadlužení, jeho vazbu na výkazy vnější pozice země a jeho možné příčiny a důsledky.
