Household Income Mobility and Dowry: Evidence from India

This paper examines the impact of dowry on household income mobility in Indian context. Dowry has many adverse effects in the society. Dowry, a key component of the extravagant wedding celebrations that are part of Indian culture, may act as a hindrance on efficacy of poverty alleviation programs. We utilize the two rounds of Indian Human Development Survey (IHDS) data to evaluate if dowry expenditure on a daughter’s marriage can explain the income mobility and possibly if it forces some households into poverty trap. Regression results suggest that dowry expenditure constitutes a significant financial burden to high income households contrary to the anecdotal belief that it more adversely affects lower income households.

Domestic Violence Within Asian-Indian Communities: Does Acculturation Affect The Rate of Reported Domestic Violence?

The present study examined acculturation among Asian-Indians, residing in the United States and Canada, and explored: (1) whether acculturation can predict reporting of domestic violence, (2) how acculturation between Asian-Indians immigrants and US/Canadian born Asian-Indians is related to reporting domestic violence, and (3) how traditional practices such as arranged marriage and/or dowry influence the relationship between acculturation and domestic violence. Participants (N=100) were administered the Acculturation Scale for Asian Indians (ASAI; Parekh, 2000) and the Revised Conflict Tactics Scale (CTS2; Straus, 1996). Results demonstrated that acculturation was not found to be a good predictor of physical assault or psychological aggression and that acculturation was not significantly related to physical assault or psychological aggression. Significant results were found for birth status and acculturation. Traditional arranged marriage and dowry could not be addressed due to the low number of participants that could be classified into these variables. Therefore, a qualitative analysis was conducted. Factors influencing these results and limitations of the present study were offered.

This study examines what effects dowry has on the gender relations in the Savar area outside of Dhaka, Bangladesh. The collection of data was made through fieldwork on sight in Savar, with the help of ADESH, during a two month period, in the spring of 2012. Almost twenty interviews were made out in villages with female members of ADESH who told me of how dowry and their participation in ADESH’s activities affected their lives. A few interviews were also made in ADESH’s own office with employees to gain a deeper understanding of the women’s life situation and the work of ADESH. The focus of this thesis is on analysing how dowry affects different aspects of the society in Savar and how this affects the gender relations. In this thesis I will also examine how ADESH is conducting their work and what activities they offer their members. The conclusion of my study is in short that dowry seems to have a large impact on many aspects of the women’s lives and that the actions that are taken to decrease and remove gender differences might not always work as intended, this does however not mean that they are without effect.

Around the world, scholars and politicians are engaged in a passionate debate concerning the universality of Human Rights. The problem of inequality between men and women concerning property rights is also part of this dispute. The transposition of human rights in another cultural context may create conflicts with new fundamental values. In a cultural context that differs from the western one, those rights don't always have their place or they may be reinterpreted accordingly with different cultural visions of what is a just society. / In order to get a better understanding of this problem, this research is proposing an analysis of the relation of Indian women with the courts regarding dowry death cases, especially in Maharashtra. The increasing number of those death cases are a contemporary manifestation of inequality. The apparition of this very Indian crime is linked with the augmentation of the frequency of the dowry practice despite the Dowry Prohibition Act (1961). Through the study of jurisprudence, ethnographies and some interviews conducted with Indian women living in Montreal, it is possible to identify factors influencing the relationship of women with respect to their rights and the Indian legal system. / The proposed study shows that case analysis, combined with other research techniques, is an essential tool for understanding the dynamics between laws and practices. All findings lead to the following conclusion: legal anthropology can bring light into the debate concerning the universality of Human rights.

Dans ce travail, une étude analytique comparative sur la notion du mahr (don nuptial) dans le droit islamique selon les différentes écoles juridiques est réalisée. Les écoles en question sont; ḥanafite, mālikite, šāfiʿite, ḥanbalite, imāmite, zaydite et ibāḍite. Tout d’abord, une présentation de la genèse de cette notion et aussi les difficultés de sa traduction est faite. A travers les enseignements de ces écoles, la notion de mahr et son importance dans le contrat de mariage sont analysées. Les points d’accords ainsi que ceux de divergences à travers une confrontation passionnante de sources classiques du fiqh sunnite, chiite et ibāḍite, sont ainsi développées. Cette recherche couvre la période entre Ier et VIIème siècle de l’hégire, ce qui correspond avec VIIème et XIVème siècle de l’ère chrétienne. L’aspect juridique du mahr, le montant, la nature et les différentes sortes de celui-ci sont des questions que nous allons tenter de répondre dans le présent travail. Nous traitons également des notions telles le mahr musamma ainsi que mahr al-miṯl. Cette étude a été réalisée en considérant le mahr dans toutes les situations juridiques : mariage, répudiation (ṭalāq), ẖulʿ et dissolution du mariage (fasẖ). / This work aims to illustrate a comparative analytical study of the concept of mahr (marriage gift) in Islamic Shari’a according to different schools of fiqh: hanafī, maliki, shafi'i, hanbali, ja'fari, ibadi and zaydi. At the beginning, the genesis of the concept of mahr and the difficulties of its translation are presented and discussed. Through the directions of these schools, the concept of mahr and its importance in the marriage contract is analyzed. The points of agreement and the divergence are demonstrated and based on the interesting confrontation of the various conventional sources of sunni, shi’i and ibadi fiqh. The research covers the period between first and seventh century of Hegira, which corresponds to the VII and XIV century of the Christian era. The legal aspect of mahr, its amount, nature and the different kinds are the questions explained in the thesis. The concepts of the mahr musamma and mahr al-mitl are extensively discussed. This study is carried out by considering mahr in all legal situations: the marriage, the divorce (talaq) ẖul' and the dissolution of marriage (faskh).
