Agency Employment Abstract My diploma thesis is focused on the agency employment. The institute of agency employment was integrated to our system of the legal regulations in 2004 and nowadays it is a very popular alternative of traditional employment. Employers perceived it as an institute that enables them to react quickly and effectively to the changes which take place on the labour market and therefore gain the needed employees in the right time. I decided to write about this topic mainly because agency employment is very interesting issue with great business opportunities, but unfortunately the Czech regulation isn't as complex and clear as it could be. Therefore, I find this topic quite intriguing. The thesis is divided into introduction, conclusion and six more chapters. First chapter introduces the term and origin of the institute of agency employment within the Czech system of legal regulations. Next chapter focuses on the legal regulation of agency employment. Firstly, I mention very briefly history of the agency employment legislation, then I focus on the international legislation of the agency employment and last but not least I also give a short excursion into European legislation. Problem: Antalet bemanningsföretag har ökat genom åren. De passar in på dagens önskan om mer effektivisering och en snabbare anpassning till marknadens efterfrågan. Men hur påverkas egentligen företagskulturen och känner korttidsanställda gemenskap och samhörighet med de fastanställda? Syfte: Syftet med vår studie är att öka förståelsen kring korttidsanställdas arbetssituation, hur de ser på frågan om samhörighet på arbetsplatsen och om de är en del av företagskulturen. Metod: Studien utgår från en kvalitativ metod med telefonintervjuer med tio respondenter från ett bemanningsföretag. Slutsatser: Sammanfattningsvis hamnar många korttidsanställda utanför företagskulturen och känner ingen samhörigheten med de fastanställda inom företaget

Private Employment Agencies and Agency Employment Abstract The main topic of this thesis is the effect of private employment agencies on the Czech labor market and legal regulation of their activities, especially of the agency employment. This thesis also focuses on the problems associated with the agency employment. The labour law is variable depending on social and economical changes not only in our country but also worldwide. It is related to the employment which should reflect the actual situation mostly on the labor market. In this situation there are a lot of people who can not find work and who must search for some alternative options. One of opportunities which are offered is the agency employment. This is the point of accent on quality legislation to minimize the risk of abuse and discrimination of the agency employees. Title: Analysis of employment agencies Objectives: The aim of this thesis is to explore employment agencies on Czech labour market and find out its functionality and credibility from the side of job seeker. One of the constitutive aim was also using the marketing method Mystery client. The term functionality of employmenet agencies was evaluated as attitude and ability of employment agency to mediate good job for job seekers. Methods: To obtain data, that allows to final evaluation, was used special technique of market research called Mystery client. This method represents hidden observation during job interview. The research was completed with question survey of selected staff consultants. Results: The results of the research indicated that employment agencies are mainly focused on outsourcing and are usually mediating short-term job for young and less educated people. The research also indicated that employment agencies are not able to mediate appropriate job in reached level of education. In spite of these problems, there were recommended three employment agencies that are properly able to communicate and react for job supply and demand. The main purpose of this thesis is to introduce the concept of temporary agency work and assess the implementation of theoretical and practical knowledge. The main part is focused on analyzing the issues of legal regulation of temporary agency work. Then the triangular relationship between the private employment agency, user firms and agency workers is described and elaborated on. The analysis followed the implementation of recruitment agency workers, including financial analysis of costs and revenue that are spent on the project in Idea Agency Ltd. The final chapter outlines the advantages and disadvantages of temporary agency work for all parties involved, i.e. agency workers, users firms and private employment agencies. The conclusion summarizes the findings and proposed recommendations for improving the use of forms of agency work.

The aim of this diploma thesis is to offer a complete overview of the institute of temporary agency work. Temporary agency work is an institute that brings to the user undertakings the possibility to quickly adapt to the increase or decrease in demand for their products by changing the number of employees. The first part of the diploma thesis presents a brief excursion into the history of temporary agency work with focus on the most important historic moments and includes the explanation of its impacts. This chapter emphasises Czech history of temporary agency work, but it takes a quick glance at the history of temporary agency work in other states. The institute of temporary agency work was introduced to the Czech legal system as late as 2004. This point is very important to understand the uneasy position of agency employment on our labour market. The main part of this diploma thesis concerns current legal status of temporary agency work. It analyses obligations of the Czech Republic arising from the C181 and directive 2008/104/ES. The purpose of this paper is to highlight the issue of preferential rights in relation to the increased practice of hiring temporary staff. The object is illuminated from a diversity perspective by seeing what a circumvention of the preferential rights may have consequences for vulnerable groups on the Swedish labor market.   The question of preferential rights to reinstatement is controlled in  The Employment Protection Act. The preferential right is for the protection of workers made redundant due to redundancy. The use of agency workers has increased significantly in the Swedish labor market since the industry's legalization in 1993. This has created some problems in terms of preferential rights.   To a circumvention of the law, shall exist requires that the measures constitute circumvention is justified, measures should have been sought to circumvent the law and been unfair in view of the particular case. Hiring of staff is not considered as a new employment, which is the requirement to invoke preferential rights, thus causing it to staff hiring is legitimate action under the preferential time.   To reduce the abuse of the right of priority, I believe that the application of law should be changed so that it takes into account the triangular available on today's labor market.

As the modern business environment becomes increasingly dynamic, businesses have had to become more responsive to changes in the marketplace. This has led to the increasing prominence of employment agencies which is organizations that help businesses manage their shifting labor requirements by sourcing labor based of their clients’ needs. Consultant managers work for employment agencies to manage both the sourced labor the agency provides and the labor needs of the client organization. Managing the dual stakeholder interests of these two groups is an integral part of the consultant manager’s role. The purpose of this study is to analyze the role of a consultant manger and to identify if conflicts exist because of the dual interests of the two stakeholder groups and if so what these conflicts are and how consultant managers handle them. This study is qualitative and semi-structured, interviews were conducted with five consulting managers who are working in three different employment agencies in Stockholm. To analyze the empirical material Sennett’s (2000) theory about flexibility, parts of Goffman's (2009) dramaturgical perspective and the concept of "dual commitment" has been used as analytical tools. The result of the study has mainly shown us that consultant managers find it difficult to effectively manage the needs of their contracted labor force due to the separation of workplaces. We have also identified that it is hard for consultant managers to manage both of the interests of the clients and the workers since they sometimes conflict with each other. The study shows that in incidences of conflicts of interests, resolution is in most case biased towards the interest of the client organization to the detriment of the contracted labor.
