Tekniken har historiskt sett alltid haft en stor inverkan på upphovsmän och rättighetsinnehavare vad gäller möjligheterna att såväl skydda som att förmedla sina verk. Internet och fildelningens intåg i samhället har på senare tid ställt förhållandet mellan de båda på sin spets.Fildelningen är idag ett stort problem för såväl rättighetsinnehavare som lagstiftare. Samtidigt utvecklas fildelningstekniker som gör det än svårare att stoppa spridningen av upphovsrättsskyddade verk. Dess utveckling tog sitt första språng med lanseringen av tjänsten Napster men idag är det framförallt fildelning via bittorrent som dominerar.Den svenska upphovsrätten påverkas till stor del av EU-rättsliga direktiv men också av utom-EU-rättsliga konventioner och internationella avtal. På senare år har ett flertal direktiv och avtal tagits fram i syfte att återta kontrollen över immateriella rättigheter.För Sveriges del har detta bl.a. resulterat i tämligen långtgående rättigheter för en upphovsman att ta till rättsliga medel för att skydda sin rätt. Kränks dessa rättigheter kan detta leda till straff som sträcker sig så långt som till fängelse.Trots ansträngningar som gjorts i form av ny lagstiftning är det förhållandevis få som dömts för brott mot upphovsrättslagen. Fildelningen har visat sig svår att kontrollera, inte minst på grund av svårigheterna att binda en person till brottet. Dessa svårigheter har viss anknytning till den grad av anonymitet som Internet medför. På senare tid har en användares möjlighet till vara anonym blivit i det närmaste total genom nya anonymitetstjänster på Internet.

Research shows that almost 30 per cent men and 20 per cent women at the age of 16-24 in Sweden download music on a regular basis instead of buying records. Thanks to modern technologies teenagers of today have become used to downloading music illegally from theInternet. Even though legal alternatives, such as Spotify, have become popular, the behavior of illegal download of music still persists. What do record companies do to prevent this phenomenon and why do they go to such length to stop this widespread movement? The question is, why is illegal download of music a problem – and for whom? To investigate this I’ve read books about the subject, analyzed web pages of alternative record companies and interviewed a drummer in a local band. As a conclusion I discuss the pros and cons of free download of music in Sweden.
