This thesis is an analytical study of the legal and political aspects of the Strait of Hormuz. It involves an evaluation of the policies of the Gulf States towards the applicable legal regime of passage through the Strait of Hormuz and their reactions towards both the 1958 and 1982 conventions on the Law of the Sea. Special attention is made to the practice of the States bordering the Strait of Hormuz as contained in their national laws. Our analysis of the applicable legal regime of passage through the Strait of Hormuz is conducted in the light of the prevailing international rules governing passage through international straits. Extensive discussion is devoted to the principal sources of threats to the Gulf’s security and to the safety of navigation through the Gulf Sea lanes, including the Strait of Hormuz. / Law, Peter A. The Effect of Mechanical Characteristics of Basal Decollement and Basement Structures on Deformation of the Zagros Basin

<p>Two fundamental structural elements, basement architecture and basal decollement, play a significant role in the evolution of a tectonically active region. Using different approaches (field data, literature review and analogue models) this thesis demonstrates that these two elements affected the deformation style in the Zagros fold-thrust belt during Mesozoic extensional and Cenozoic contractional episodes. </p><p>Reassessment of available data suggests a new configuration for the basement to Zagros basin that consists of basement faults with three different trends. Complicated interrelationships of these basement faults divide the Zagros basin into two major basement blocks, active and passive. This model associated with geological evidence suggests that deformation in the basement due to the convergence between Arabia and Iran is not restricted to the Zagros Mountains but already involves a considerable part of the Arabian platform. However, deformation in the cover units is not only governed by the deformation in the basement, which are decoupled from each other by the Hormuz salt in many parts in the Zagros fold-thrust belt. </p><p>Geological evidence shows that there is a clear relationship between activity of the Hormuz structures and the basement faults in the Zagros basin. Extended analogue models indirectly show how Hormuz types of basal decollement associated with the opening of Neo-Tethys can control the distribution, number, width and geometry of faults, penetrative strain, and diapirism. Analogue models shortened from one-end show that the spatial distribution of the Hormuz salt in the Zagros belt map viscous and frictional decollements to the thin-skinned deformation. Shortening of the cover results in formation of partitioning of strain into transpressional zones, different topographic wedges and differential sedimentation of growth sediments along the Zagros belt. Model results supported by geological and geophysical data sets suggest that some of the faults previously attributed to basement could have developed above the initial lateral boundaries between viscous and frictional basal decollements.</p>

O presente trabalho tem por objetivo analisar o papel do estreito de Ormuz nas dinâmicas de competição no Golfo Pérsico. Ormuz é um estreito geograficamente estratégico, uma vez que é a única via marítima entre o Golfo Pérsico, o Golfo de Omã e o Oceano Índico e encontra-se em uma área rica em hidrocarbonetos. Em vista disso, o primeiro capítulo busca analisar o conceito e as características que qualificam a relevância que alguns estreitos possuem para o Sistema Internacional, caracterizando-os como Pontos de Estrangulamento e, nesse sentido, averiguar as razões que definem o estreito de Ormuz como o principal ponto de estrangulamento marítimo no mundo. Já o segundo capítulo tem como foco o estudo da Competição Estratégica, estabelecida entre Estados Unidos e Irã (2003-2013), que somente tornou-se possível graças às características de Ormuz (e, à assimetria de capacidades). Por fim, o terceiro capítulo procura averiguar o papel do estreito na escalada das rivalidades entre Arábia Saudita e Irã que deflagram a Guerra Proxy, e o seu transbordamento para outros pontos de estrangulamento do Oriente Médio. Espera-se como resultado oferecer uma melhor contextualização e compreensão sobre o tema de Ormuz em particular, bem como dos pontos de estrangulamento, contribuindo dessa forma para a instrumentalização dessas categorias no estudo das Relações Internacionais contemporâneas. / This study aims to analyze the Strait of Hormuz role in the competition dynamics in the Persian Gulf. Hormuz is a strait geographically strategic, since it is the only maritime way between the Persian Gulf, the Gulf of Oman and the Indian Ocean and is located in an area rich in hydrocarbons. In view of this, the first chapter analyzes the concept and characteristics that qualify the relevance of some straits to the International System, characterizing them as Choke points and, accordingly, find out the reasons that define the Strait of Hormuz as the main maritime choke point in the world. The second chapter focuses on the study of the Strategic Competition, established between the United States and Iran (2003-2013), which only became possible because of the characteristics of Hormuz (and because of capacity asymmetry). Finally, the third chapter seeks to ascertain the strait role in escalating rivalries between Saudi Arabia and Iran that trigger the Proxy War and its spillover to other bottlenecks in the Middle East. It is expected as a result provide better context and understanding of Hormuz particular theme and bottlenecks, thus contributing to the exploitation of these categories in the study of contemporary international relations.

Le golfe Persique est depuis toujours le carrefour du commerce mondial. Cette mer est aujourd’hui la voie vitale de l’approvisionnement énergétique mondial. Selon les statistiques, chaque jour 18 millions baril de pétrole passent par cette mer et le détroit d’Ormuz. Parmi les pays côtiers du golfe Persique le rôle de l’Iran est le plus important en raison de sa position géographique. L’Iran, avec ses 1200 kilomètres de côte, possède le plus large littoral dans le golfe Persique et est également l’un des deux États riverains du détroit d’Ormuz, la seule voie de communication maritime du golfe Persique avec le monde entier. C’est pourquoi la politique maritime de l’Iran et sa législation concernant le droit de la mer sont déterminantes dans la région et c’est la question que nous nous sommes proposé d’aborder dans la présente thèse. / The Persian Gulf has always been the crossroad of world trade. The Persian Gulf is today the vital corridor of global energy supply. According to statistics 18 million barrels of oil pass through this sea and the Strait of Hormuz every day. Among the coastal countries of the Persian Gulf the role of Iran is crucial due to its geographical location. Iran, with 1200 km, has the widest coastline on the Persian Gulf, it is also one of the two coastal states to the Strait of Hormuz wich is the only shipping route of the Persian Gulf to the rest of the world. This is why Iran's maritime policy and its law of the sea legislation are critical in the region. This thesis tries to explore these policies and legislations of Iran.
