Cette thèse est structurée en trois parties : La première analyse l’interdiction judiciaire, mesure encore utilisée en Roumanie. L’analyse prend en considération la prodigalité, une situation de profusion de volonté réelle mais, depuis longtemps, interdite en droit, et continue avec les motifs de l’évanescence de l’interdiction judiciaire en droit français. La deuxième partie montre nos apports personnels à l’évolution du droit roumain. Après une analyse linguistique, historique et méthodologique de la capacité, nous avons analysé l’opportunité de maintenir la terminologie des incapacités. Nous faisons aussi un exposé de l’évolution d’un régime roumain intermédiaire entre l’incapacité générale d’exercice et le régime de la capacité. Nous montrons son évolution et expliquons ses limites de l’âge et pourquoi l’émancipation a disparu en Roumanie. Après, nous expliquons l’évolution de trois situations, dans le droit roumain et français, quand : la volonté devient juridiquement efficace malgré l’application d’un régime d’incapacité générale d’exercice (1), la situation où les règles juridiques ne prennent pas non plus de la volonté réelle d’un majeur protégé (2) et la situation ou la volonté juridiquement efficace ne peut pas se prononcer pour l’avenir (3). La troisième partie de la thèse prend en considération le droit international privé et le droit international des droits de l’homme. Les concepts de capacité, en droit international privé, et dans la Convention Relative aux Droits des Personnes Handicapées, semblent être marqués par une homonymie terminologique. Nous décrivons aussi comment rendre sa volonté juridiquement efficace par un autre système juridique. / We have structured this thesis in three parts : The first analyzes the interdiction as a protection measure still used in Romania. The analysis takes into consideration the prodigality, a situation of a profusion of nonjuridical will, for a long time forbitten to form an intend, and continues with the reasons for the vanishing of the 〝interdiction judiciaire〞 in French law. The second part shows our contributions to the evolution of Romanian law. After a linguistic, historical and methodological analysis of legal capacity, we analyzed the opportunity to maintain the terminology of the incapacities. We also discuss the evolution of an intermediate Romanian regime between general incapacity of exercise and the capacity regime. We show its development and explain its limits of age and why the emancipation has disappeared in Romania. After, we explain the evolution of 3 situations in Romanian and French law : the case where the will becomes legally efficient, despite the application of a system of general incapacity of protection (1), the case where the legal rules do not take into consideration the real will of a protected adult (2) and the situation where the legally validated will cannot prepare for the future (3). The third part of the thesis takes into consideration the private international law and international human rights law. The concepts of capacity, in private international law, and the Convention on the Rights of Persons with Disabilities, seem marked by a terminological homonymy. We also present how can one’s will be made legally-efficient by another legal system.

Analysis of budget for interdiction on multicommodity network flowsZhang, Pengfei, Fan, Neng 01 March 2016 (has links)
In this paper, we concentrate on computing several critical budgets for interdiction of the multicommodity network flows, and studying the interdiction effects of the changes on budget. More specifically, we first propose general interdiction models of the multicommodity flow problem, with consideration of both node and arc removals and decrease of their capacities. Then, to perform the vulnerability analysis of networks, we define the function F(R) as the minimum amount of unsatisfied demands in the resulted network after worst-case interdiction with budget R. Specifically, we study the properties of function F(R), and find the critical budget values, such as , the largest value under which all demands can still be satisfied in the resulted network even under the worst-case interdiction, and , the least value under which the worst-case interdiction can make none of the demands be satisfied. We prove that the critical budget for completely destroying the network is not related to arc or node capacities, and supply or demand amounts, but it is related to the network topology, the sets of source and destination nodes, and interdiction costs on each node and arc. We also observe that the critical budget is related to all of these parameters of the network. Additionally, we present formulations to estimate both and . For the effects of budget increasing, we present the conditions under which there would be extra capabilities to interdict more arcs or nodes with increased budget, and also under which the increased budget has no effects for the interdictor. To verify these results and conclusions, numerical experiments on 12 networks with different numbers of commodities are performed.

Maritime interdiction in the war on drugs in Colombia : practices, technologies and technological innovationGuerrero Castro, Javier Enrique January 2017 (has links)
Since the early 1990s, maritime routes have been considered to be the main method used by Colombian smugglers to transport illicit drugs to consumer or transhipment countries. Smugglers purchase off the shelf solutions to transport illicit drugs, such as go-fast boats and communication equipment, but also invest in developing their own artefacts, such as makeshift submersible and semisubmersible artefacts, narcosubmarines. The Colombian Navy has adopted several strategies and adapted several technologies in their attempt to control the flows of illicit drugs. In this research I present an overview of the ‘co-evolution’ of drug trafficking technologies and the techniques and technologies used by the Colombian Navy to counter the activities of drug smugglers, emphasizing the process of self-building artefacts by smugglers and local responses by the Navy personnel. The diversity of smugglers artefacts are analysed as a result of local knowledge and dispersed peer-innovation. Novel uses of old technologies and practices of interdiction arise as the result of different forms of learning, among them a local form of knowledge ‘malicia indigena’ (local cunning). The procurement and use of interdiction boats and operational strategies by the Navy are shaped by interaction of two arenas: the arena of practice - the knowledge and experience of local commanders and their perceptions of interdiction events; and, the arena of command, which focuses on producing tangible results in order to reassert the Navy as a capable counterdrug agency. This thesis offers insights from Science and Technology Studies to the understanding of the ‘War on Drugs, and in particular the Biography of Artefacts and Practices, perspective that combines historical and to ethnographic methods to engage different moments and locales. Special attention was given to the uneven access to information between different settings and the consequences of this asymmetry both for the research and also for the actors involved in the process. The empirical findings and theoretical insights contribute to understanding drug smuggling and military organisations and Enforcement Agencies in ways that can inform public policies regarding illicit drug control.

Existem alguns assuntos que mesmo tendo relevância do ponto de vista jornalístico muitas vezes não fazem parte dos noticiários. Por interesses ideológicos, econômicos ou políticos ocorre um processo de silenciamento sobre temas que passam a não figurar em reportagens ou mesmo em pequenos textos noticiosos nas páginas dos jornais. Por meio desta pesquisa de dissertação, procurou-se investigar especificamente os conteúdos relacionados ao sistema prisional brasileiro publicados nas primeiras páginas dos jornais Folha de S. Paulo e O Globo. Durante um período de três anos consecutivos, todas as capas foram analisadas, bem como suas respectivas matérias jornalísticas das páginas internas que faziam referência ao esse sistema. A partir daí foi possível identificar ausências, lacunas ou omissões de tópicos importantes para a compreensão e contextualização da complexidade do universo que compõe os procedimentos legais de investigação, julgamento e execução penal, tanto quanto as condições em que isso é realizado. Tal identificação se deu através do cruzamento das informações contidas nas matérias analisadas com as informações, na íntegra, das fontes de domínio público que eventualmente fizeram parte desses textos. / There are some issues that even having a journalistic relevance are often not part of the news. By ideological, economic or political interests, a process of silencing takes place on subjects that do not appear in reports or even in small news texts on the pages of newspapers. Through this dissertation research, we sought to investigate specifically the contents related to the Brazilian prison system published in the first pages of the newspapers Folha de S. Paulo and O Globo. During a period of three consecutive years, all the covers were analyzed, as well as their respective journalistic articles of the internal pages that made reference to this system. From that point on, it was possible to identify absences, or omissions of important topics for understanding and contextualizing the complexity of the universe that makes up the legal procedures for investigation, prosecution and criminal execution, as well as the conditions in which this is done. Such identification took place through the crossing of the information contained in the analyzed material with the information of the sources of public domain that occasionally became part of these journalistic texts.

This study is an optimization approach to the rectilinear interdiction problem by locating a line barrier.
Interdiction problems study the eect of a limited disruption action on operations of a system. Network interdiction problems, where nodes and arcs of the network are susceptible to disruption actions, are extensively studied in the operations research literature. In this study, we consider a set of sink points on the plane that are being served by source points and our aim is to study the eect of locating a line barrier on the plane (as a disruption action) such that the total shortest distance between sink and source points is maximized. We compute the shortest distances after disruption using visibility concept and utilizing properties of our problem. The amount of disruption is limited by imposing constraints on the
length of the barrier and also the total number of disrupted points. The suggested solution approaches are based on mixed-integer programming and a polynomial-time algorithm.
