The Trade, Investment and Labour Mobility Agreement (TILMA): an analysis of politics, processes and provisions

This thesis examines the comprehensive Trade, Investment and Labour Mobility Agreement (TILMA) that was signed in 2006 by the governments of Alberta and British Columbia. The central objective is to examine why two successive Saskatchewan governments chose not to sign the TILMA. This thesis also examines the TILMAs influence on subsequent developments in internal trade policy reform in Canada. The three central research questions are: What is the TILMA, and how does it fit within the existing internal trade regulatory regime established under the Agreement on Internal Trade (AIT)? Why did Saskatchewan not sign the TILMA? What effect, if any, has the TILMA had on establishing a new model or paradigm for internal trade policy in Canada? The key findings are that Saskatchewan did not sign the TILMA because Alberta and British Columbia would not accede to its demands to make exemptions for the procurement practices of municipalities and the subsidiaries of crown corporations. Another factor was the decision by the Saskatchewan government to launch a public consultation process before ratifying the agreement. The public consultation process provided the opponents of the agreement (i.e., municipal government, labour and non-governmental organizations) with an opportunity to organize and express their opposition to the agreement. Their strong opposition to the agreement during those consultations led both the NDP Government and subsequently a cautious Saskatchewan Party Government, which only had a slim majority in the legislature to walk away from what was being portrayed in the media as a very contentious policy decision. Their choice stands in contrast to that of the Liberal and Conservative Governments of British Columbia and Alberta respectively, that chose to sign the TILMA prior to undertaking consultations with the public and community stakeholders. In 2010 the Saskatchewan Party government would sign the New West Partnership Trade Agreement that included almost all of the provisions of the TILMA without public or stakeholder consultation. This thesis reveals that the TILMA has had modest but important effects on establishing a new model or paradigm for internal trade policy in Canada by enhancing the utility and scope of binding enforcement mechanisms and comprehensive interprovincial agreements. It was more comprehensive in scope than interprovincial agreements that had been signed previously to supplement the AIT. Contrary to what some had envisioned or proclaimed, the TILMA did not have substantial transformative effects either in addressing internal trade barriers in Canada or in supplanting the existing framework of internal trade policy established under the AIT.

Comércio externo e interno do Brasil e das suas macrorregiões: um teste do teorema de Heckscher-Ohlin. / Domestic and international trade of brazil and its macror regions: a test of the heckscher-ohlin theorem.

O objetivo deste trabalho foi avaliar, com base no padrão de comércio externo e interno brasileiro, se a especialização da produção no Brasil e nas macro-regiões encontra-se de acordo com a dotação relativa de fatores, ou se há outras questões que expliquem a localização da produção. A fundamentação teórica veio do teorema de Heckscher-Ohlin, mais especificamente da abordagem da qualificação da mão-de-obra e do comércio intra-indústria. O teorema de Heckscher-Ohlin foi confirmado para os trinta tipos de comércio externo observados no trabalho, e pôde-se verificar um comportamento semelhante entre os resultados obtidos para o Brasil, como um todo, e aqueles conseguidos para as suas regiões. No comércio observado entre o Brasil e as regiões e a Ásia, os Estados Unidos, a União Européia e o resto do mundo, a dotação de fatores constatada foi de mão-de-obra não qualificada. Considerando apenas o comércio do Brasil e das regiões com o Mercosul, pôde-se verificar que o Brasil e as regiões apresentaram abundância relativa de mão-de-obra qualificada. Com relação aos resultados para o comércio intra-indústria, dos 30 dimensionamentos efetuados para o comércio exterior, apenas em três casos o comércio interindústria não foi observado: no comércio do Brasil, do Sudeste e do Sul com o Mercosul. Pode-se sugerir, então, que, na relação entre o Brasil e as macrorregiões e seus principais parceiros comerciais no mercado mundial, o comércio interindústria foi observado na maior parte dos casos, confirmando, assim, os resultados verificados no teorema de Heckscher-Ohlin. Na análise dos testes do teorema de Heckscher-Ohlin realizados para o comércio interno entre as regiões do Brasil, pôde-se verificar que a validade do teorema foi confirmada para quatro das cinco regiões consideradas. Somente para o comércio verificado entre o Nordeste e as demais regiões o teorema não foi constatado. A região Sudeste foi considerada como relativamente abundante em mão-de-obra qualificada, enquanto as demais regiões se apresentaram como relativamente abundante em mão-de-obra não qualificada. O comércio intra-indústria somente foi observado, no mercado doméstico, entre macrorregiões, para as relações comerciais do Nordeste com o Centro-Oeste. Com base nos resultados verificados para o teorema de Heckscher-Ohlin, pode-se sugerir que a dotação diferenciada de fatores foi importante determinante da especialização da produção, no Brasil e nas regiões, para o comércio no mercado mundial e doméstico. O dimensionamento do comércio intra-indústria confirma os resultados observados do teorema de Heckscher-Ohlin para a quase totalidade dos casos analisados. Cabe destacar que, na revisão bibliográfica realizada para a elaboração deste estudo, não se observou trabalhos que já tivessem testado a validade do teorema de Heckscher-Ohlin para os comércios externo e interno, considerando as macrorregiões. O que se verificou foram trabalhos que consideravam o Brasil como um todo. Esses testes regionais somente foram possíveis de serem realizados em função do modelo inter-regional que foi construído por Guilhoto et al (2003), bem como das informações detalhadas sobre importação e exportação, publicadas pelo Ministério do Desenvolvimento da Indústria e do Comércio - MDIC - (Brasil, 2003) e pelos microdados da Pesquisa Nacional por Amostra de Domicilio - PNAD - (IBGE, 1999a). / The aim of this study was to evaluate, based on the trade procedures for the external and internal Brazilian trade, if the production especialization in Brazil and in macro-regions is according to the relative allotment of factors, or if there are other questions that explain the production localization. The theoritical basis came from Hecksscher-Ohlin, more specifically, from the assessment of the labor qualification and from the trade intra-industries.The theorem of Heckscher-Ohlin was confirmed for the 30 (thirty) kinds of external trade observed, at work, and it was noticed a similar behavior among the results obtained for Brazil, as a whole, and the ones obtained for its regions. In the trade evidenced among Brazil and regions of Asia, the United States, the European Union and the rest of the world, the allotment of factors establihed was the one of non-qualified labor. Considering Brazil’s trade and of the regions with MERCOSUL alone, it was noticed that Brazil and the regions offer relative abundant qualified labor. Regarding the results abtained from for the trade intra-industries, of the 30 outlinings for the external trade, only in three cases the intra-industry trade was not observed: in the Brazilian market, of the South and Southeast with the MERCOSUL. It can be suggested, then, that in the trade analyzed between Brazil and the macro-regions and their main business partners in the international market the trade intra-industries was observed in most cases, therefore, confirming the results verified in the theorem of Heckscher-Ohlin. In the test analysis of the theorem of Heckscher-Ohlin, carried out for the domestic market among ther egions in Brazil, it was noticed that the validity of the theorem was confirmed for four out of the five regions considered. Only between the Northeast and the other regions, the theorem was not evidenced. The Southeastern region was considered relately rich in qualified laborforce, whereas the other regions presented as relatively abundant in non-qualified labor. The intra-industry trade was only observed, in the domestic market among macro-regions, for the business relations of the Northeast and the Midlle-west. Based on the results obtained for the theorem of Heckscher-Ohlin, it can be suggested that the different allotment of factors was an important determiner of the production especialization, in Brazil and in the regions, either for the domestic as for the international markets. The outlining of the intra-industry trade confirms the results observed of the theorem of Heckscher-Ohlin, for almost all of the cases analyzed. It is worth pointing out that in the bibliographic review carried out in order to do this study it was not observed studies which had tested the validity of the theorem of Heckscher-Ohlin for the internal and external trade, considering the macro-regions. What was evidenced were the studies done considering Brazil as a whole. These regional tests were only possible to be carried out for the regions making use of the inter-regional model which was constituted by Guilhoto et al (2003), as well as of the detailed information about importation and exportation, published by the Ministery for the Development of the Industry and Commerce -MDIC- (Brasil, 2003) and by the microdata of the National Research by Domicile Sample - PNAD- (IBGE, 1999a).

Sistema de información para automatizar el proceso de aprendizaje en línea para las MIPYMES del sector industrial y comercio interno / Information System to automate the online learning process for MSME’s in the Industrial and Internal Trade sector

En un país de Sudamérica, el tejido empresarial formal está conformado en un 99,6% por las MIPYME. Este segmento reúne agentes económicos que dinamizan y contribuyen al desarrollo económico del país. Parte significativa de la población y de la economía dependen de la actividad y el desempeño de este segmento debido a su reconocida capacidad para generar empleo y su participación en la producción. En efecto, las MIPYME aportaron con el 30,7% del valor agregado nacional y generaron el 89,1% del empleo en el sector privado en el 2018.1 Debido a esta situación y a la importancia de las MIPYME, es de vital importancia que se dediquen esfuerzos para fortalecer la capacidad de las mismas, a través del conocimiento que se puede impartir a sus representantes legales, gerentes(as), trabajadores(as), entre otros, con la finalidad de incrementar su productividad. Estas actividades son responsabilidad del Viceministerio de MIPYMES del Ministerio de la Productividad de este país, es así que, para cumplir los objetivos y metas planteadas, una de las principales funciones del subsector en mención es la ejecución de capacitaciones a nivel nacional a las MIPYME del sector industrial y comercio interno, en distintas materias que permitan desarrollar y mejorar su potencial. Estas actividades representan un gran esfuerzo para el VMYPE y sus dependencias internas, ya que actualmente se desarrollan de manera presencial, es así que, los especialistas de cada área deben viajar a nivel nacional para poder brindar el servicio de capacitaciones. Adicionalmente, los costos asociados a este proceso son elevados, pues deben realizarse compras de pasajes para los capacitadores, se deben otorgar viáticos para la estadía y alimentación de los encargados y finalmente, en algunos casos, se pueden precisar de alquiler de locales y demás logística necesaria para las capacitaciones. Este proyecto propone la implementación de un Sistema de Información que permita la automatización del proceso de aprendizaje en línea hacia las MIPYME del sector industrial y comercio interno, a fin de que se puedan optimizar los recursos necesarios para su ejecución. Esta plataforma será de tipo E-Learning y permitirá la generación y alojamiento de cursos y sus materiales vinculados. / In a South American country, 99.6% of the formal business fabric is made up of MSMEs. This segment brings together economic agents that energize and contribute to the economic development of the country. A significant part of the population and the economy depend on the activity and performance of this segment due to its recognized capacity to generate employment and its participation in production. Indeed, MSMEs contributed 30.7% of the national added value and generated 89.1% of employment in the private sector in 2018. Due to this situation and the importance of MSMEs, it is of vital importance that dedicate efforts to strengthen their capacity, through the knowledge that can be imparted to their legal representatives, managers, workers, among others, in order to increase their productivity. These activities are the responsibility of the Vice Ministry of MYPES of the Ministry of Productivity of this country, thus, in order to meet the objectives and goals set, one of the main functions of the subsector in question is the execution of training at the national level to the MSMEs of the industrial sector and internal trade, in different matters that allow to develop and improve their potential. These activities represent a great effort for the VMYPE and its internal dependencies, since they are currently carried out in person, therefore, specialists from each area must travel nationwide to be able to provide the training service. Additionally, the costs associated with this process are high, since ticket purchases must be made for trainers, travel expenses must be granted for the stay and meals of those in charge and finally, in some cases, rental of premises and other logistics may be required necessary for training. This project proposes the implementation of an Information System that allows the automation of the online learning process towards MSMEs in the industrial sector and internal commerce, so that the necessary resources for its execution can be optimized. This platform will be of the E-Learning type and will allow the generation and hosting of courses and their related materials. / Tesis

El presente proyecto de investigación, tiene como objetivo el impulsar el comercio interno de alimentos de origen orgánico, cultivados por pequeños agricultores del país que no cuentan con una llegada a su público objetivo y por ende no pueden impulsar sus ventas. Así mismo, buscamos brindarles a nuestros consumidores, productos de la más alta calidad con el fin de satisfacer sus demandas y cumplir con sus expectativas. Bajo esta primicia, fue que desarrollamos una plataforma web con el fin de comercializar nuestros productos de origen orgánico y además, con el fin de formar parte de la vida de nuestros usuarios, nos basamos en un plan de suscripción en donde nuestros clientes podrán seleccionar cada cuanto tiempo desean recibir uno/s de nuestros packs. Con relación a la sustentación del presente proyecto, iniciamos definiendo y segmentando a nuestro público objetivo, personas de entre 20 a 45 años de edad, de Lima Metropolitana residentes de la zona 7 y que consumen productos orgánicos con frecuencia o que se encuentran incursionando en el mundo de la comida saludable. Seguido a ello, iniciamos con las validaciones respectivas por parte de usuarios y expertos con relación a la problemática que se desea resolver y con ello brindarles la solución idónea. Así mismo, elaboramos experimentos con el fin de validar la viabilidad del presente proyecto y la solución presentada al problema. En una siguiente etapa, se realizó una planificación de concierges con el fin de recabar información relevante que nos permita validar nuestro modelo de negocio. Finalmente, realizamos el plan financiero correspondiente al proyecto, con el fin de conocer si el mismo es rentable y viable en el futuro. / The following investigation has as a primary objective to develop and impulse the internal commercialization of organic products cultivated by small Peruvian producers scattered along the Peruvian territory where they don’t have the knowledge of the many tools they can use to reach the final customer. However, we also want to bring top of the line products for our customers, keeping the quality and nutrients that the different products bring. Expectations from our clients are kept in mind while selecting every single product so we can fulfill the client’s needs. Regarding this, we took the whole state of the organic products production in our country to develop a web page so we could sell the previously selected products that come from an organic origin. On the other hand, to become part of our client’s life we decided to develop a service where clients can decide if they want to receive our products on a weekly or monthly basis. Regarding our project presentation and viability, first we had to define and do a segmentation process to identify our target audience; we found that our target audience could be found in between the age range 20 to 45 years old living on Metropolitan Lima, residents of the zone known as “Zona 7” that consume organic products frequently or that are starting to explore the world of healthy and organic type of products. Following our process in creating a service that could fulfill our clients needs we had to validate the viability of our business by gathering information from users and experts that could be potential clients about the problematic we wanted to solve by sharing with them our ways to do so. So far, we had the idea validated by our potential targets but there was a need to investigate further by doing different experiments to confirm the viability of our project and check if our solution to the problem would be accepted by the customer. Following the process, there was a planification for our concierge card with the objective of having planning’s for the upcoming phases of our business model, having costs, strategies, and steps that we should follow that would also validate our whole project. After all this was finished, the final step was to develop a financial plan so we could complete the final step to validate our project, having indicators that would tell us how our project would be viewed in the eyes of an investor and being viable in the future. / Trabajo de investigación

L'élimination des barrières non tarifaires au commerce interprovincial et l'Accord sur le commerce intérieur du Canada

L'Accord sur le commerce intérieur est un accord de libre-échange pancanadien visant l'abaissement des barrières non tarifiaires au commerce interprovincial. La notion de barrières au commerce interprovincial, en soi, suscite maintes controverses. Aucun consensus n'existe à savoir quelles sont les barrières au commerce, quelles en sont leurs coûts, mais surtout, s'il faut les abaisser. La grande majorité des experts concoivent que beaucoup de ces barrières non tarifaires au commerce se retrouvent dans le secteur des produits agroalimentaires. À ce titre, ce domaine est, depuis plusieurs décennies, traditionnellement protectionniste et constitue donc un marché des plus difficiles à intégrer. Cette réalité prévaut tant au niveau international qu'interprovincial. Au Canada, l'outil privilégié après des années de négociations constitutionnelles infructueuses fut l'Accord sur le commerce intérieur. Cet accord, aux allures de traité international, vise l'intégration graduelle du marché interne canadien. La volonté de devenir un marché intégré et compétitif au niveau mondial se heurte à la détermination des provinces de protéger leur souveraineté législative. Ainsi, l'outil d'ouverture du marché que constitue l'Accord sur le commerce intérieur, qui navigue entre ces positions antagonistes, fut rédigé de manière assez complexe et peu accessible. Le contexte politique et constitutionnel particulier dans lequel se sont inscrites les négociations de cet accord a ainsi teinté le texte de l'accord et sa rédaction. En plus de sa simplification, plusieurs solutions intervenant sous plusieurs facettes de l'Accord sur le commerce intérieur permettraient à ce dernier de se voir plus efficace dans sa mission d'intégration du marché interprovincial canadien, en plus d'augmenter sa notoriété, sa crédibilité et de permettre une meilleure mise en œuvre. / The Agreement on Internal Trade of Canada is a free trade agreement to reduce internal non-tariff barriers to trade. The concept of barriers to internal trade itself is controversial. There exists no consensus as to what are barriers to trade, what are their costs, and more importantly, whether they should be eliminated. The vast majority of experts are of the view that many of these nontariff barriers to trade are in the food processing industry. For many decades, this industry has been traditionally protectionist and is therefore a more difficult market to integrate. This situation may be observed at both the international and the internal level. In Canada, the tool of choice after years of failed constitutional negotiations was the Agreement on Internal Trade. This agreement, which bears a resemblance to international treaties, aims toward the gradual integration of the internal market in Canada. The desire to become an integrated and more competitive player in the global market conflicts with the provinces' intense desire to protect their legislative sovereignty. Thus, the tool chosen to open the Canadian market, the Agreement on Internal Trade, was drafted in a rather complex and inaccessible manner in order to strike a balance between those conflicting positions. The constitutional and political context in which the negotiations of this agreement took place coloured the text of the agreement itself and its drafting. In addition to its simplification, there exist several solutions involving various facets of the Agreement on Internal Trade, which should increase the effectiveness of the latter with respect to the integration of the Canadian interprovincial market, in addition to increasing its notoriety and its credibility and facilitating its implementation.
