Sharī'a has never ignored the need of and the function of judge. This institution, as developed in the early age of Islam, aimed to establish the rule of God on earth, to decide and explain the law according to the Islamic Law. It appears that anybody could be appointed as a judge but he was required to adopt certain criteria laid down by the fuqahā' based on the Qur'ān, Sunna. Ijmā and Oiyās. The requirements needed to be a judge in this Islamic approach are discussed widely in this study. This study also attempts to show and demarcate the limits of the power of judges in Sharī'a Courts in Kedah, Malaysia. It also shows how Islam established its system of justice in Malaysia. Some questions or hypotheses are examined, the first concerns whether or not people who lack capabilities should be allowed to be appointed judge. The second concerns whether or not the Islamic judicial system follows the Sharī'a in terms of punishment and procedure. The historical and theoretical settings in every age since the pre-Islamic to the 'Abbasid period are also presented. The situation of judge in Sharī'a Court in Kedah, Malaysia is also emphasised, beginning with the developments of the Sharī'a Court and the powers and duties of a judge according to the Malaysian constitutional system. Finally the subjects which have been discussed in separate chapters are actually related to each other. The whole important discussion is brought together, analysed and a conclusion drawn concerning the various problems raised.

Contesting seclusion : the political emergence of Muslim women in Bhopal, 1901-1930

This study examines the emergence of Indian Muslim women as politicians and social reformers in the early years of the twentieth century by focussing on the state of Bhopal, a small Muslim principality in Central India, which was ruled by a succession of female rulers throughout the nineteenth and early twentieth centuries. The last Begam of Bhopal, Nawab Sultan Jahan Begam (1858-1930, r. 1901-1926), emerges as the main figure in this history, though a substantial effort has also been made to examine the activities of other Bhopali women, whether poor, privileged or princely. Special significance has been attached to their changing attitudes to class, gender and communal identities, using the veil as a metaphor for women's expanding concerns. Their connections with wider movements of social reform have also been emphasized in an attempt to show that the emergence of women in Bhopal was representative of a broader development occurring amongst Muslim women, both within India and throughout the Islamic world. The importance of this study lies in its treatment of the 'daughters of reform,' the first generation of Muslim women who contributed to the reformist discourse, particularly at the regional level, as complex subjects in possession of a history. It is also significant in that it redresses the paucity of academic literature on the princely states of India, highlighting the differences between states and the changes that occurred over time, rather than simply dismissing the princes as frivolous reminders of a by-gone age. The main theme that arises is the importance for early Muslim female activists of balancing continuity and innovation. By operating within the framework of Islam, Bhopali women were able to build on traditional norms in order to introduce incremental change. As many of their achievements were unforseen, however, their story is as much one of paradox, as of progress.

Tahmid : a literary genre? : a study of the Arabic laudatory preamble, with a focus on the Fatimid-Tayyibi tradition

This thesis follows the emergence and development of Tahmid, the Arabic laudatory preamble, as a literary genre in the Arabic tradition: a genre that imaginatively presents the distinct worldview (weltanschauung) that its author embraces and a genre that not only features as a standard introduction for an infinite number of texts, but is also, in and of itself, a rich source of meaning. The dissertation proposes a literary approach for unearthing its depths of knowledge, termed the 'relational approach'. This approach identifies and focuses on the various relations and associations, highlighted and evoked by a Tahmid despite its usual conciseness, which are the source of its vitality. Drawing upon a broad range of samples, the study also delineates the common characteristics and trends of the Tahmid tradition as a whole, and focuses on its distinctiveness and significance in Fatimid-Tayyibi literature ('Fatimid-Tayyibi' refers to Ismili Musta'lian Tayyibi Shiites in Fatimid Egypt as well as their spiritual successors in Yemen and India, commonly known as the Da'udi Bohras). Following the introduction, the thesis is structured on a chronological basis in three parts. Section-I (chapters 1-3) traces the development of Tahmid from its origins to maturity as a distinct genre in Arabic prose. Section-II (chapter-4), building on the literary-history presented in the previous section, presents a methodology for the analysis of Tahmid and applies it to a selection of examples. Section-III (chapters 5-7) focuses on the unique characteristics of Fatimid-Tayyibi Tahmids and presents an analysis of a number of examples. The section ends with a case-study of a Tahmid in one of the Fatimid-Tayyibi Da'i Syedna Taher Saifuddin's (d. 1385/1965) risalahs. The question posited in the title of this thesis, 'is the Tahmid a literary genre?' is answered in the Conclusion. An appendix of Tahmids referred to in the thesis and illustrative samples, especially from the Fatimid-Tayyibi manuscripts, accompanies the dissertation in a separate volume.

Velayat-e Faqih: Innovation or Within Tradition

abstract: The concept of Velayat-e Faqih as a type of Shi’ite Islamic government gained popularity three decades ago, after the Islamic revolution in Iran. The new constitution of the Islamic Republic of Iran was based on Velayat-e Fagih, proposed by the Imam Khomeini many consider him as the leader of the Islamic Revolution and the founder of the Iranian Islamic Republic. What is Velayat-e Faqih? Who can be the Vali Faqih? Why wasn't this idea proposed before Islamic Revolution in 1979? Did all the Shi’ite religious scholars endorse this idea or the Vali Faqih himself? All of these questions ultimately lead us to ask whether this concept has been drawn from Shi’ite Islamic discourses or it may perhaps be considered a novelty: a secularization of religion. These questions are increasingly discussed in academia and in the large public arena. Moreover, this discourse has divided Shi’ite Muslims into three groups: supporters of the Velayat-e Faqih, its opponents, and the silent group. It is important to analyze the position of all those groups including the silent group who did not publicly endorse or reject the theory. The theory of Velayat-e Faqih has emerged from the Imamate doctrine, which constitutes a cornerstone of Shi'ite sect of Islam. It is necessary to understand this political doctrine in relation to the context within which this concept of leadership had emerged. In order to overcome the ambiguities surrounding the relationship between Velayat-e Faqih and the position of Islamic jurist as a source of guidance and imitation (Marje Taqleed), it is necessary to discuss the various dimension of guardianship in the absence of the infallible Imam.
