This politic, present in Brazil since 1921, is in the drug laws adopted at the international level, through treaties and conventions. The discourse of these laws resonance in the media, which through mechanisms of persuasion, connected to create a genuine atmosphere of war against drugs and the drug dealer, confer legitimacy to the public discourse. The association's official discourse to the discourse mediatic causes sedimentation of criminal stereotype, which is identified as an enemy to be destroyed. Moreover, this association discursive, through procedures of exclusion and limitation of discourse does not allow the emergence of contrary or refractory discourses. Holders of marginal discourse are therefore eliminated the voice, because there is a stereotype about them created. One of the most important tools that are worth the state to implement the public discourse is the process. In the course of proceedings, there is the encounter of the individual with the stereotype that it was created by the official politic and reaffirmed by the media. Has the meeting of representations about the trafficking. Despite that meeting, the marginal discourse, even in cases of criminal absolution, does not appear, because the influence of the same mechanisms of exclusion and limitation of discourse, specially, the disqualification discursive of the person involved in judicial proceedings, always collected from lower layers society. It has been the mismatch of representations on trafficking. Results of research that criminal politic about drugs, both in Brazil and at the international level, was built on a discourse given efficient mechanisms for maintenance. Even when that discourse do not concreted, with the criminal condemnation of someone accused of illegal trafficking of drugs, there is no cracks in its structure. The person involved with judicial proceedings does not invalidate the predominant discourse. He simply got the "detachment" of his image to the stereotyped image of the smuggler, contributing, at the final, with the strengthening of that stereotype. Thus, if in principle the criminal acquittal may mean the collapse of public discourse, it is shown that, far from it happening, the criminal acquittal is the reaffirmation of this discourse. / A política sobre (ou anti) drogas adotada pelo Brasil está calcada em um discurso de intolerância, unidimensional e de exclusão, responsável pela criação de estereótipos humanos sobre os quais recaem medidas de normalização e controle. Essa política, presente no Brasil desde 1921, é consentânea às legislações sobre drogas adotadas no plano internacional, através de tratados e convenções. O discurso que a informa encontra ressonância na mídia, que por meio de mecanismos de persuasão, ligados à criação de um verdadeiro clima de guerra contra a droga e contra o traficante, conferem legitimidade ao discurso oficial. A associação do discurso oficial ao discurso midiático provoca a sedimentação do estereótipo criminoso, que passa a ser identificado como inimigo a ser destruído. Além disso, essa associação discursiva, por meio de procedimentos de exclusão e de limitação do discurso, não permite o florescer de discursos contrários ou refratários. Os portadores do discurso marginal ficam, portanto, alijados de voz, porque sobre eles há o estereótipo criado. Uma das mais importantes ferramentas de que se vale o Estado para aplicar o discurso oficial é o processo. No curso do processo, tem-se o encontro do indivíduo com o estereótipo que lhe foi criado pela política oficial e reafirmado pela mídia. Tem-se o encontro de representações sobre o tráfico. Apesar desse encontro, o discurso marginal, nem mesmo nos casos em que houve absolvição, não aparece, por força dos mesmos mecanismos de exclusão e limitação do discurso, em especial, em razão da desqualificação discursiva do indivíduo processado, sempre coletado das camadas mais baixas da sociedade. Tem-se o desencontro de representações sobre o tráfico. Resulta da pesquisa que a política criminal sobre drogas, tanto no Brasil como no plano internacional, foi erigida sobre um discurso dotado de eficientes mecanismos de manutenção. Mesmo quando esse discurso não se afirma concretamente, com a condenação de alguém acusado de tráfico ilícito de drogas, não se observa fissuras em sua estrutura. O indivíduo processado não procura infirmar o discurso predominante. Limita-se a buscar o descolamento de sua imagem à imagem estereotipada do traficante, contribuindo, ao final, com o fortalecimento desse estereótipo. Assim, se em princípio a absolvição criminal pode significar a ruptura do discurso oficial, fica demonstrado que, muito longe disso acontecer, a absolvição criminal representa a reafirmação deste discurso.

The subject matter of my Master's degree thesis is the issue of divorce proceedings. The main aim of this thesis is to put an interpretation on the currently effective legislation on divorce proceedings and divorce itself as it follows mainly from Act No. 292/2013 Coll., on Special Judicial Proceedings and Act No. 89/2012 Coll., the Civil Code. Divorce is the only legally permissible way in the Czech Republic how to terminate marriage within both spouses' lives. It leads to severe legal consequences affecting not just spouses themselves but alternatively their legitimate children as well. Therefore it requires a set of special rules and special proceedings so that courts may ascertain the presence of the irretrievable breakdown of marriage which only justifies allowing divorce and decide spouses' personal and property relations in connection with divorce. This thesis is divided into five parts which all bear certain relation to divorce proceedings. The first part provides an overview of divorce regulations throughout Czech history up to now. The second part firstly addresses the relation between substantive law and procedural law regarding divorce. Subsequently, it focuses on substantive legislation on divorce in the Czech Republic. Case law influence on Czech national and international arbitration Proceedings Abstract Arbitration proceedings represent, besides civil judicial procedures, one of the methods for solution of material disputes in private-law relations. Arbitration proceedings have been used for quite a long time. In our territory they were used already under the rule of Charles IV. For example, Jakub Krčín and Štěpánek Netolický, who were well-known artificial lake engineers, belonged among highly appreciated arbitrators. Significant development of arbitration proceedings was registered after 1949, when the Steady Arbitration Court was established at the Czechoslovak Chamber of Commerce in May 1949 and exists up to now under the name "Arbitration Court attached to the Czech Chamber of Commerce and the Agricultural Chamber of the Czech Republic". Legal regulation of arbitration proceedings was undergoing various changes. This diploma thesis "Disturbed possession" deals with the theme of possession and its protection against disturbing. Possession as one of the basic institutes of law has seen several changes in its legal concept on the territory of the Czech Republic in the history. The Civil Code no. 89/2012 Coll. has brought the concept of possession and its protection which is based on the concept of the doctrine of law science from the First republic. As this "new" concept is discontinous with the previous concept of the Civil Code no. 40/1964 Coll. interpretation and application of this new concept will be rather complicated. This thesis firstly tackles the theoretical concept of possession - i.e. what the object of possession is, how the possession is acquired, lost and retained, what qualities there are of lawful possession, who can be the subject of possession. The second part of the thesis describes the historical development of the concept of possession. The last part of the thesis focuses on how possession is described in Civil Code no. 89/2012 Coll. In this part of the thesis characteristic features and nature of trespass are described. This problematics is also mentioned in the view of the Austrian civil law. A voz do trabalhador ocupa, ainda, um lugar secundário na interlocução capital x trabalho. Sua manifestação lingüística em instâncias de caráter oficial/institucional ocorre apenas nos momentos de maior tensão entre os interlocutores, em especial durante os processos trabalhistas, visando à validação/obtenção de um direito. Tal representatividade não se dá de forma direta, mas através da voz do advogado trabalhista, aqui chamado de locutor-advogado, porta-voz legitimado socialmente, que busca dirigir a argumentação no contrafluxo da voz predominante no universo do trabalho - a voz do capital. Esta pesquisa tem por objetivo mostrar como a voz do trabalhador é representada no discurso jurídico trabalhista e quais os significados dessa representatividade no mundo do trabalho. O escopo teórico utilizado é fruto do diálogo interdisciplinar entre as teorias do texto e do discurso (em particular a semântica global e seu conceito de interdiscurso, e a semântica argumentativa, com seus conceitos de polifonia e direção argumentativa) e as disciplinas direito trabalhista e sociologia do trabalho. A análise lingüístico-discursiva dar-se-á a partir de corpus composto por textos (orais e escritos) próprios a esse discurso e extraídos de um processo trabalhista típico. Os textos orais (não oficiais) produzidos no processo se constituem a origem discursiva dos textos escritos (oficiais e legais). Na transposição do oral para o escrito, a voz do trabalhador ganha estatuto diverso, porque passa a ser dirigida pela voz do locutor-advogado. Nesta pesquisa, verificar-se-á como nos textos escritos emergem, apagam-se ou permanecem de forma residual índices da voz do trabalhador. A pesquisa pretenderá ainda mostrar como é possível ao pesquisador lingüista encontrar pistas lingüísticas de heterogeneidade em discursos pretensamente homogêneos, como é o discurso jurídico trabalhista, contribuindo com subsídios de sua especialidade para a construção de um quadro do que é, ou está se tornando, o mundo do trabalho nas sociedades ocidentais modernas, nas quais o Brasil se espelha. / The worker´s voice still plays a secondary role in the interaction capital x labor. Its linguistic manifestation, of an official/institutional nature, occurs only in moments of maximum tension between interlocutors, particularly in judicial proceedings, in the area of labor relations, targeted at the authorization or obtention of a legal right. The worker´s voice is not directly represented in such processes, but rather through a specialized lawyer´s voice, herein named the locutor-lawyer, a socially sanctioned speaker, who addresses his or her arguments to a hegemonic voice in the discursive world of labor, namely the voice of capital. This research explores the representation of the worker´s voice in judicial proceedings discourse in the area of labor relations and deals with the question of the meanings attached to this kind of representation within the world of labor relations. The theoretical framework for this research is found in the interdisciplinary dialogue between theories of text and discourse (particularly global semantics with its concept of interdiscourse, and argumentative semantics with its concepts of polyphony and argumentative direction), as well as in the disciplines Law, in the area of Labor Relations, and the Sociology of Labor. The linguistic-discursive analysis focusses on a corpus of oral and written texts within the domain of Legal Discourse in the area of Labor Relations and is taken from a typical judicial proceeding in this area. The (non-official) oral texts produced in the course of the judicial proceedings constitute the discursive source for the written texts (in this case, both official and legal documents). In the transposition from the oral to the written proceedings, the worker´s voice acquires a different status, as it is now under the locutor-lawyer´s supervision. This research explores the ways in which the worker´s voice emerges, is deleted or leaves traces in the written texts that constitute the judicial proceedings. Another aim of the research is to demonstrate how the linguist–researcher may find linguistic clues of heterogeneity in discourses (as the legal discourse in the area of labor relations) which are, at first sight, homogeneous. Thus, the linguist–researcher, drawing on linguistic-discursive tools, may contribute to an understading of how representations of labor relations in contemporary Western societies, including Brazil, are being shaped.

Virtualização processual e a reestruturação organizacional do Poder Judiciário do Rio Grande do Sul

Com a implementação do programa de virtualização dos processos no Poder Judiciário do Rio Grande do Sul pretendemos analisar as adaptações pertinentes na estrutura organizacional das unidades judiciais do 1º grau de jurisdição e o impacto nas atividades dos servidores e dos juízes. Torna-se necessária uma revisão das práticas tradicionais a fim de preparar e adaptar as unidades jurisdicionais à nova realidade, especialmente no que diz respeito à distribuição das atividades. O programa de virtualização permite a unificação em apenas uma equipe integrante da unidade judicial, dispensando a tradicional divisão entre o cartório e o gabinete. Logo, diante da eliminação dos tempos mortos de tramitação do processo, torna-se imperioso o reforço da equipe de assessoria do magistrado em relação ao pessoal de cartório, mesmo porque a tendência no futuro é de unificação das estruturas cartorárias para atender a todos os juízes da comarca ou, no mínimo, drástica redução e alteração das atividades mecânicas cartorárias. Nesse contexto, na tentativa de auxiliar na elaboração de um cenário dos demais Tribunais brasileiros, além de facilitar as tomadas de decisões cabíveis, a partir de uma metodologia qualitativa baseada em estudo comparativo e entrevistas, foi organizada uma síntese e apresentadas proposições viáveis no que tange à estrutura organizacional do 1º grau de jurisdição do Poder Judiciário, visando sempre maior eficiência e qualidade na prestação jurisdicional. / Regarding the virtualization process of legal proceedings in the lower State Courts of the State of Rio Grande do Sul, this dissertation intends to analyze the necessary organizational structures adjustments and how those affect the activities of such court’s employees and judges. In order to prepare and adapt the jurisdictional units to this new reality, a review of the traditional practices becomes necessary, especially regarding the distribution of the activities of the court’s employees. The virtualization program allows a merge of the court office and the chamber’s employees, dismissing the usual activities division currently existent between them. So, in face of the reduction of the lawsuit delay time, it becomes even more necessary increasing the number of judge’s clerks and other assistant rather than other employees of the court. This is particularly necessary because the trend is that courts’ office structures will be unified in order to serve all judges of a given jurisdiction or, at least, to drastically reduce and change the manual duties of the courts’ offices. In this context, with the intent to help create a scenario of all Brazilian courts, in addition to assist in the courts’ decision making, through a qualitative methodology based on comparative studies and interviews a summary of viable proposals was organized and provided with respect to the organizational structures of the lower courts for more efficiency and quality in the provision of jurisdictional public services.
