The master thesis first deals with definition of business contractual relationship (sources, formation, freedom of contract) and indicates ways of resolving disputes arising from it within the Czech legal code. Through defining the concept of cross-border element the master thesis attains on how to resolve business disputes over contractual obligations at the EU level. Core topic of thesis deals with jurisdiction in commercial matters, the law applicable to contractual obligations, alternative dispute resolution as well as the recognition and enforcement of judgements or of different rulings. The last part of the thesis deals with a practical procedure which shows how to resolve dispute between domestic businessman and foreign businessman via legal proceedings.

Soudní tlumočení pro děti a nezletilé / Court Interpreting for Children and MinorsVorlická, Kateřina January 2019 (has links)
The masterʼs thesis, divided into theoretical and empirical parts, deals with court interpreting for children and minors. After a short introduction to history, it describes the characteristic of court interpreting with the emphasis on children and minors involved in judicial proceedings. Following chapters focus on court interpreting in the Czech republic, expanding on its description, the related legal framework, required qualification and training of court interpreters. Subsequently, the thesis draws a comparison with training and education of other professionals taking part in proceedings with minors. Furthermore, the state of the art in the Czech republic is also compared to the situation in Belgium where the project CO-Minor-IN/ QUEST was launched and carried out. To our knowledge, it is the first international project on cooperation among major professionals involved in interpreted criminal proceedings with minor participants. The thesis presents a summary of findings concerning communication with children and minors, laying stress on particular patterns of behaviour and conduct that are likely to occur in little and school-age children. Previous issue date: 2010-07-01 / In Brazil, through social rights were recognized, in parallel, the civil and political rights. Even at authoritarian times, social rights have been formally recognized, given that the Federal Constitution of 1988 gave them enormous attention. However,
realization of social rights requires, beyond the state action, the commitment of workers and their unions, occupying Article 8., III CF/88 position of prominence in this particular, by allowing the union, as a procedural substitute, to file lawsuits in defense of collective rights (especially of a certain workers class) and homogeneous individual rights of its members. This ensures isonomic access to justice to the members of the class (especially professional), and also decrease the excessive amount of individual claims and increase the number of workers protected. Finally, the most frequent activities of the union as a procedural substitute for workers, beyond strengthening the ties between them, will reduce the low rate of spontaneous compliance of the constitutional and legal norms which enshrine social rights by employers, also reducing, as a result, judicial cases and relieving the Labor Courts. / No Brasil, através dos direitos sociais, foram consagrados, de forma paralela, os direitos civis e políticos. Mesmo em períodos autoritários, os direitos sociais foram reconhecidos formalmente, sendo certo que a Constituição Federal de 1988 deu a eles enorme destaque. Contudo, a concretização dos direitos sociais, além de prestações do próprio Estado, requer o empenho dos trabalhadores e de seus sindicatos, ocupando o artigo 8º., III da CF/88, neste particular, posição de destaque, ao possibilitar que o sindicato, na condição de substituto processual, ajuíze ações em defesa dos direitos coletivos (da categoria profissional, enquanto tal) e dos direitos individuais homogêneos de seus membros. Isso garante aos integrantes da categoria (notadamente profissional) isonomia no acesso à justiça, além de diminuir a quantidade excessiva de reclamações individuais e aumentar o número de trabalhadores tutelados. Por fim, a atuação mais freqüente do sindicato como substituto processual dos trabalhadores, além de fortalecer os laços entre eles, aumentará o baixo índice de cumprimento espontâneo pelos empregadores das normas constitucionais e legais que consagram os direitos sociais, reduzindo também, via de conseqüência, os processos judiciais e desafogando a Justiça do Trabalho.

The dissertation thesis "Relationship of parents to minors with regard to the specifics of domestic violence" focuses in particular on judicial proceedings in cases of custody of minors where family relationships are affected by domestic violence. It attempts to explain why it is necessary for the courts to take into account this fact and to adopt such measures within their decisions to provide sufficient protection to persons at risk and at the same time to stop violent behaviour. Domestic violence as a dangerous social phenomenon is described in detail; information on its individual appearances and forms is brought; briefly mentioned are also other scientific disciplines whose knowledge is important not only for the recourse of offenders and the protection of victims but also for creation of a strategy of effective prevention. Negative impacts on mental state of minors are stressed, who must be viewed in all cases of domestic violence as its victims, i.e. also when the violent behaviour is not immediately directed against them. The thesis brings interpretation of the current legislation with reference to the most important changes in the legislation in the last decade. Au XVIe siècle, nous assistons à deux types de récits criminels : dans la presse, les faits divers, produits sous la forme de « canards », et dans la littérature, les histoires tragiques, forme narrative brève essentiellement véridique et à tonalité pathétique. Lorsque Pierre Boaistuau, appelé aussi Launay, publie Les Histoires tragiques, il sélectionne six récits parmi les Novelle de Matteo Bandello. Le travail de Boaistuau ne se limite pas à la traduction de ces textes mais également à la fondation d’un genre qu’est l’histoire tragique. François de Belleforest, son ami, en poursuit la traduction et en varie les sources ; il publie entre 1559 et 1582 sept volumes d’histoires tragiques. Notre étude porte sur la justice, un thème clé pour comprendre les textes de ces deux auteurs. En effet, leurs récits révèlent un intérêt particulier pour les différentes formes de justice (humaine, naturelle et divine), pour le procès judiciaire et ses protagonistes. Nous analysons tous ces points ainsi que le thème de la transgression à travers différents crimes, principalement les crimes de paillardise (« macquerellage », rapt, viol et adultère). Notre réflexion porte également sur le châtiment et ses fonctions ainsi que sur le comportement du condamné au moment de son exécution. Enfin, nous nous intéressons aux stratégies discursives déployées par nos auteurs notamment à la rhétorique judiciaire et à la rhétorique délibérative. Les enjeux soulevés à travers l’étude du discours rhétorique permettent d’explorer les liens entre le discours judiciaire et le discours politique et donc entre justice et politique. Somme toute, la dernière partie de notre travail permet de cerner les rapports entre rhétorique, justice et politique. / In the sixteenth century, two types of criminal narratives predominate: short news items in the press, printed separately as canards, and brief narrative literary forms that constitute the tragic story genre, combining truth with a tone of pathos. When Pierre Boaistuau, also called Launay, publishes Les Histoires tragiques, he selects six stories from Matteo Bandello’s Novelle. Boaistuau's work is not limited to the translation of these texts but also establishes the tragic story genre. His friend François de Belleforest continues the translation and varies the sources; between 1559 and 1582 he published seven volumes of tragic stories. My thesis focuses on justice, a key theme for understanding the texts of these two authors. Indeed, their stories reveal a particular interest in the different forms of justice (human, natural and divine), in the judicial process and in its protagonists. I analyze all these points as well as the theme of transgression through an examination of various crimes, mainly crimes of debauchery ("macquerellage" –sex trafficking–, abduction, rape and adultery). I also consider the different functions of punishment as well as the behavior of the convicted person at the time of execution. Finally, I am interested in the discursive strategies deployed by these authors, including judicial rhetoric and deliberative rhetoric. The issues raised through the study of rhetoric make it possible to explore the links between judicial discourse and political discourse and therefore between justice and politics. The summative, final part of our work further elucidates the relationships between rhetoric, justice and politics.
