The cost of credit in the micro-finance industry in South Africa

This thesis analyses the cost of credit in the micro-finance industry in South Africa. The study situates micro-lending agreements within the law of contract, beginning with an examination of contractual fairness in terms of the common law: the fundamental principle of freedom of contract that underpins the common law of contract; the principle that agreements contrary to public policy should not be enforced; and the impetus given by constitutional values that inform public policy. In regard to moneylending transactions, common law usury law will be explained. The study then goes on to trace the origins and rapid growth of the micro-finance industry which was made possible by its exemption in 1992 from the Usury Act 73 of 1968. The upshot of this development was that registered micro-lenders have for nearly 14 years charged excessive interest rates, and continue to do so. The dire socio-economic impact of these high interest rates on individual consumers and lowincome communities is then demonstrated: how borrowers of small loans soon become over-indebted; the loss of billions of rands every year to low-income communities in the form of interest on micro-loans. The study then shifts to the legislative response to the need for consumer protection in regard to consumer credit. The extensive credit law review process is explained, resulting ultimately in the National Credit Act 34 of 2005, which allows the Minister to prescribe limits on interest rates and fees in all sectors of the consumer credit market. The prescribed limits on the cost of credit in the micro-finance sector are thoroughly explained and analysed, with particular reference to the implications of each element of the credit costing structure, and the combined impact of the total cost of credit on different types and sizes of loans. The envisaged maximum interest and fees will markedly alter the positions of micro-lenders and consumers, and receive careful analysis. The study closes with a summary of findings in the thesis, which includes suggested amendments to the National Credit Regulations and a review of possible legal challenges to the high cost of credit on smaller loans.

A Criminological study of non-compliance with selected licensing conditions of tavens

(Criminology)) -- University of Limpopo, 2015 / The study was aimed at analysing the non-compliance of tavern operators with selected licensing conditions of taverns in Mankweng Area, Limpopo Province. Tavern operators were randomly sampled for the study. A quantitative research approach was used and questionnaires were administered for data collection. The findings revealed that tavern operators do not comply with the licensing conditions as stipulated in the Liquor Act, no 27 of 1989. The most contravened conditions include trading beyond stipulated times and allowing minors into the licensed premises. However, there is a need to study the perceptions of the tavern operators with regard to the licensing conditions of taverns. The researcher recommended that the community should co-operate with the Liquor Board in the effective prevention of the non-compliance of the tavern operators.

Retention of black employees at Metropolitan

Thesis (MBA)--University of Stellenbosch, 2011. / Metropolitan, like all companies in the insurance sector, would like to limit attrition to ensure that the institutional knowledge is retained. At the time when the employee has already tendered a resignation letter, most companies conduct an exit interview. The researcher feels that at this stage, it is rather late. It is important therefore to understand in advance, the reasons why employees would consider leaving the organisation and put corrective measures in place to prevent that. Retention of key employees is a highly topical subject and an important dilemma that many companies have to deal with. It requires leadership attention and scientific understanding of the causes of attrition. In South Africa, the concept of retention of specifically Black employees has a broader significance in that it contributes to higher BEE scores and opportunities to do business with government for those companies that have such interests. The purpose of this study is to firstly understand the phenomenon of retention as it applies to the Black employees of Metropolitan. Black employees with skills and experience are arguably the most attractive group on the labour market due to the lack of such skills. Because of this, companies are struggling to retain their Black employees. This study explores what Metropolitan should take into account when designing retention measures for Black employees. It asks the Black employees themselves, what they consider as important that would help in retaining them. Furthermore, it will help the company to investigate which characteristics or variables to consider when formulating its retention strategies. The questions that the study endeavours to explore are: What mechanisms should Metropolitan use to retain especially Black employees? If current employees are considering leaving the company, what are the main reasons for wanting to leave or looking for a job elsewhere? What are the characteristics that employees consider most important that would make them want to stay at Metropolitan. The subject matter investigation involved a survey which was sent to Black employees in the company and the results which were analysed. The results shed some understanding on the reasons why employees would consider applying for a job outside of Metropolitan. It gives the company an understanding of how many of its current Black employees are looking for jobs elsewhere. Because of this prior knowledge, the company can intervene and put measures in place to retain those who were already looking to leave the company. The study also details characteristics that Black employees at Metropolitan consider to be important by certain biographical categories like job grade, age, education, gender and experience. The results further build on the existing literature of retention, especially in the South African environment in the era of transformation laws.

Investigating the concept of a game meat scheme to promote safe game meat on the South African market .

Environmental Health, Tshwane University of Technology, 2012. / Implementation of existing meat hygiene legislation can be costly to the game farm owner in terms of slaughter facilities and human resources. This can consequently force farmers and processors to operate outside of the law when delivering game meat to the market. In answer to this a Game Meat Scheme was negotiated between Wildlife Ranching South Africa, represented by the researcher and the Department of Agriculture, Forestry and Fisheries. Nevertheless, the Game Meat Scheme only offers a 5 year period of grace for legal compliance for game farmers producing for the local meat market. Concerns of Wildlife Ranching South Africa on the implementation of such and other legal procedures on game farms motivated the comparative research on regulated and non-regulated game carcasses. Dependent and independent variables were researched to compare game carcasses intended for the export market (aspiring to strict requirements), and game carcasses intended for the local market (no control measures). The swabbing sampling technique used by the researcher was verified against the excision method (used by the export market). The results of this study have further led to a proposed innovation in the testing and verification of current legislation culminating in the Game Meat scheme and a new Game Meat Guide that could lead to the development of practical guidelines for the hunting process on the farm.

Landscapes of dispossession : farm dwellers' experiences of relocation in the context of private game farming.

This thesis explores the material and non-material impacts of private game farming for a group of farm dwellers in KwaZulu-Natal. The thesis is located within the context of an increasing trend whereby farm dwellers are being relocated in order to provide farm owners with the economic opportunity that commercial game farming entails. The thesis emphasises the marginalised position of the farm dwellers and points to the fact that the farm dwellers themselves often have little control and knowledge regarding their legal rights. It further emphasises the lack of protection that this group receives from the authorities. Even though legislation has been implemented to address tenure insecurity, in reality this legislation has made little difference to the lives of farm dwellers. The thesis concludes that as a direct consequence of the relocation the farm dwellers were affected materially, but perhaps more important were their ‘invisible’ non-material losses. Their non-material losses include loss of self-esteem, increased social marginalisation and the cutting of their ties to their ancestral land. / Thesis (M.Sc.)-University of KwaZulu-Natal, Durban, 2011.
