Finding law about life: a cross-cultural study of indigenous legal principles in Nishnawbe Aski Nation

This is a cross-cultural study of Indigenous legal traditions in Nishnawbe Aski Nation (NAN), a political territorial organization in northern Ontario. By analyzing NAN’s resolutions (passed by NAN Chiefs-in-Assembly to direct NAN’s mandate), I identify legal principles. As law arises from worldviews, law’s function is to protect the values of that worldview. This study discusses two values (creation and interdependence) as analytic tools, used to recognise legal principles. Context grounds the conclusions, as they relate to specific people and land. Four legal principles are identified: earthbound need, sacred/natural supremacy, gifted responsibility and relational jurisdiction. These principles together reveal that law in NAN is focused on the protection of life. Overarching the results is a broader purpose, to take up the educative work previously shouldered by NAN alone. The duty to learn is more than political obligation, but as I argue, is a matter of life itself. / Graduate / 2019-05-11

Sospechas, juicios y conclusiones preliminares conducen en algunos casos a opiniones equivocadas sobre una acción criminal o suicida. Pero más allá de las pruebas evidentes, ¿qué se esconde tras esa muerte accidental, o a causa de un suicidio, homicidio o asesinato?, ¿qué móviles condujeron a atentar contra su propia vida, o a otras personas a hacerlo? La denominada Autopsia Psicológica proporciona herramientas para desentrañar misterios de una verdad que no siempre se encuentra a flote. Dentro del terreno de las evaluaciones psicológicas reconstructivas, se designa con el nombre de AUTOPSIA PSICOLOGICA al procedimiento, utilizado principalmente en el ámbito de la psicología jurídica y forense, que tiene por objeto proponer, desde el punto de vista de la salud mental, una hipótesis acerca del modo o forma de un deceso cuya naturaleza resulta equivoca o su causa desconocida, aun después de haberse practicado la autopsia médico legal. Optimising value and quality in the procurement of professional legal services : a corporate perspective

Purpose: Organisational clients engage with Professional Legal Service (“PLS”) providers for a variety of business and legal reasons. Value and quality are key elements to creating and enhancing mutually beneficial long term relationships around these services, yet there is very little guidance from the literature to demonstrate what practical actions and means should be employed by service providers and clients alike in order to create and / or improve value and quality in the specific context of PLS. This research identified the general nature of value and quality in the context of PLS and went on to recommend specific actions and means to create and improve value and quality. Design / Methodology / Approach: This research was an exploratory study in which practical actions and means to create and / or improve value and quality in the context of PLS were identified. Empirical data were collected by means of an experience survey in the form of semi – structured interviews conducted with practicing attorneys and in – house legal advisors of large corporate organisations. Results were interpreted by means of thematic analysis. Limitations: The research was limited to law firms of a minimum number of directors / partners and only publicly listed corporates. It is submitted, however, that the findings and recommendations are of broad application in the area of PLS and that size or legal status of stakeholder is immaterial, should such stakeholders wish to implement the ideas and recommendations proposed by this research. Findings: The research generated and recommended numerous practical actions and means that both the service provider and client can implement that will go to creating and improving value and quality in the delivery and procurement of PLS. In addition to the practical actions and means identified, the key findings indicated inter alia that service providers must take proactive steps in understanding the unique needs, business and industry of their clients in order to add value, while making a concerted effort to develop and manage personal relationships with clients so as to differentiate themselves in terms of quality delivery. The diversity and evolution of competition : an ideal proposed for regulatory design

This dissertation presents a concept of diversity as an ideal of international economic regulation. The theme of diversity refers to the differentiation of individual competitive strategies. The first advantage of such differentiation is argued to be as a means of stable and adaptive progress; increasing the number of possible techniques with which to meet as yet unforeseen challenges. As the first principle of diversity entails a method for systemic responsiveness, the second principle gives content to this method and states that social goals should serve as the incentives encouraging competitors toward differentiation. The advantage offered by the second principle is that social non-economic goals may be advanced in the present, as individuals attempt new routes to personal reward via the satisfaction of collective objectives that previously may have had little or no economic value. As an ideal of diversity contemplates a method of systemic incentives, rather than mandated outcomes, the location of innovation remains individual competitors. Accordingly, the ideal of diversity is justified and articulated from a basis in individual rights. Diversity is argued to be the optimal set of principles which individuals would select if given the ability to design a new competitive system. In joining a method of differentiation with the added social content of non-economic priority, diversity offers a unique blend of economic efficiency and equity; or of self-interest and concern for the welfare of others. Diversity allows an individual to think of their own pursuit of gain, but also and simultaneously further collective goals by selecting the priorities that should influence competitors toward differentiation. Other’s welfare becomes a route to individual success. The project progresses through three broad conceptual stages. First, international problems of market failure are considered in light of strategies and the economic impulses toward self and system defeating cycles of competition. Second, a redefinition of legal and economic progress is offered to meet conditions of unpredictability, and to arrive at an evolutionary method that encourages constantly competitive variation with which to meet society’s future challenges. Após a morte celular, dá-se início ao processo denominado de autólise, neste todas as células apresentam dissolução de sua integridade química física e morfológica, procedendo-se à difusão de íons de acordo com os seus gradientes de concentração nos diferentes tecidos corpóreos, fatores anatômicos locais, fatores bioquímicos, entre outros. Em vista deste fatos, buscou-se estimar o tempo decorrido de morte, por meio da análise de correlação de íons no humor vítreo e intervalo "post-mortem". Procedeu-se à coleta sistematizada de humor vítreo de 40 coelhos, submetidos a um mesmo mecanismo de morte (traumatismo crânio - encefálico seguido de decapitação), e retirada do humor vítreo em intervalos de 2/2 horas até 10 horas após a decapitação. Realizou-se a dosagem de íons por meio da técnica de fotometria de chama, submetendo os resultados à análise estatística. Concluiu-se que existe variação de íons em relação ao tempo decorrido de morte, porém, este aumento dos níveis de íons no humor vítreo respondem por apenas uma pequena porcentagem da variação de tempo, não propiciando uma técnica de estimativa objetiva / Abstract: This study were based on the estimation of the time since death by correlation ofvitreous eIetrolytes and "post-mortem" period. We obtained vitreous humour of 40 habbits, that died by the same way, violent death, and we performed timed removal of vitreous humour at na interval of 2 hours until the first 12 hours after death. We performed determination of eIetroIytes concentration by flame photometry, and the results was studied by statistical methods. Foram distribuídos 500 questionários a Cirurgiões-Dentistas (CDs) e suas auxiliares, em clínicas particulares, na região do governo de Piracicaba/SP, sendo que 148 (29,6%) CDs e 127 (25,4%) auxiliares os responderam. Obteve-se os seguintes resultados: nas respostas das auxiliares, verificou-se que 30 (23,6%) eram Atendentes de Consultório Dentário (ACDs), 94 (74%) eram Secretárias, 1 era Técnico em Higiene Dental (0,8%) e 2 eram Técnico em Prótese Dental (1,6%), podendo ser observado que 100% eram do sexo feminino; somadas, 55,9% possuíam nível de escolaridade do segundo grau completo; 74,8% foram treinadas pelo CD; 11,8% possuíam curso específico de ACD; 3,9% realizaram curso de atualização em odontologia a quatro mãos; 18,1% estão registradas no Conselho Regional de Odontologia (CRO); em 61,4% dos casos o CD está sempre presente no consultório quando as auxiliares estão trabalhando; nenhuma auxiliar sofreu advertência do CRO; 74,8% são registradas em carteira de trabalho; sendo 22,8% foram registradas como ACD. Através dos dados coletados dos CDs, constatou-se que: 76% possuíam auxiliares em seus consultórios, sendo que 52% eram de Secretárias; o principal fator para não contratarem ACDs (51%) era o financeiro; 40% não consideram necessário; 81% foram treinadas pelo CD e 76% desconhecem a resolução 209/97. Concluiu-se, ao final da análise dos dados, que, de maneira geral, os auxiliares extrapolam suas funções ou intitulam-se erroneamente como Secretárias, ACDs e THDs e que há a necessidade de maior divulgação do Centro de Especialidades Odontológicas e da Resolução 209/97 junto à equipe odontológica / Abstract: In the present study, it was analyzed the attributions and the legal implications of these Dental Auxiliary, on their use and their formation. 500 questionnaires were sent to Dental Surgeon and their Dental Auxiliary, in private clinics, in the area of Piracicaba/SP/BR. It was obtained the following results: 148 (29,6%) Surgeon Dentist and 127 (25,4%) Dental Auxiliary answered the questionnaires. The Dental Auxiliary's answers were verified that: 30 (23,6%) Dental Assistant, 94 (74%) Secretaries, 1 (0,8%) Dental Hygienist and 2 (1,6%) Dental Prosthesis. It was also observed that 100% were female and just 55,9% finished the high school. 74,8% were trained by the Dental Surgeon; 11,8% had some specific course of Dental Assistant; 3,9% had done some course "in dentistry to four hands"; 18,1% were registered in Regional Council of Dentistry; the Dental Surgeon was always present in the clinic when the Dental Assistant was working in 61,4% of the cases; no Dental Assistant had Regional Council Dentistry warning; 74,8% had legal register, being 22,8% registered as Dental Assistant. From the collected data of the Dental Surgeon were verified that 76% had Dental Auxiliary in their clinics, in which 52% were Secretaries; the main reason so that they did not want to hire Dental Assistant were: 51% financier and 40% do not consider necessary; 81 % were trained by the Dental Surgeon and 76% ignore the resolution 209/97. It was concluded at the end of the analysis that, in a general way, the Dental Auxiliaries extrapolate their functions or erroneously entitled as Secretary, Dental Assistant and Dental Hygienist. O objetivo do trabalho é avaliar a existência do agente etiológico HIV em cadáveres, no intuito de determinar se a pesquisa necroscópica é fator de risco de transmissão para a equipe. O estudo ocorreu na área de Odontologia Legal e Deontologia da FOP-UNICAMP e no SML de Volta Redonda - RJ onde realizou-se a coleta de sangue da câmara atrial cardíaca de 50 cadáveres que deram entrada no período de 18 de maio a 26 de junho de 2009. O procedimento para análise imunológica foi feito pelo teste rápido de HIV e pelo ensaio imunoenzimático (ELISA). Das 50 amostras coletadas, nove foram inadequadas para o teste. E das 41 amostras testadas houve um único resultado positivo para HIV no teste ELISA e no teste rápido. Há riscos de contaminação pelo HIV para a equipe do IML nos procedimentos de necropsia, desde que não se respeitem às diretrizes de biossegurança para os atos operatórios. Tendo este trabalho detectado a presença do HIV em 2,4% das amostras efetivamente examinadas. / Abstract: The carried through autopsy procedure in the Institute of Forensic Medicine (IML) is surrounded biological risks which need to be identified and studied to produce knowledge that justifies the use of biosecurity measures. The objective of this study is to evaluate the existence of the agent HIV in cadavers in order to determine whether the research necroscopic is a risk factor for transmission to the team. The study took place in the area of forensic dentistry and ethics of FOP-UNICAMP and SML Volta Redonda - RJ which held the blood collection chamber atrial rate of 50 corpses received in the period from May 18 to June 26 2009. The procedure for the immunological analysis was done by the rapid test for HIV and by enzyme immunoassay (ELISA). Of the 50 samples, nine were inadequate for testing. And of the 41 samples tested there was a single positive result for HIV ELISA and rapid test. There are risks of HIV infection to the staff of IML in autopsy procedures, provided they do not comply with the biosafety guidelines for surgical procedures.
