The family is the basic unit in our society. When there is a breakdown in this unit, specifically in the marital relationship, the effect upon the husband, wife, and children can be devastating in terms of poverty, abuse, and cost to society. The frequent inability of the poor to obtain counseling and legal assistance in resolving family relationships perpetuates the social and psychological results of a poor marriage. This study is concerned with poor persons and their ability to receive both legal and counseling services for their family problems 0 Other concerns are with the questions of alternatives to divorce for the client, the effects of marital breakup on the children, and the possibility and utility for a social worker to have a role in the legal process.

O trabalho apresentado propõe-se a descrever e analisar os institutos da assistência jurídica (que tem como subtipo a assistência judiciária) e da justiça gratuita no Brasil, em benefício de pessoas pobres na acepção jurídica do termo, com enfoque nos conflitos individuais do trabalho. Abrange o estudo dos serviços de orientação jurídica pré-processual e o patrocínio das causas judiciais com isenção de honorários e de todo tipo de despesa oriunda dos processos. Para atingir esse objetivo, utiliza-se a compilação e análise crítica de informações extraídas de obras doutrinárias, de jurisprudência e de pesquisas de levantamento de dados realizadas por terceiros, tudo com base em material nacional e estrangeiro, com final apresentação de conclusões e proposições acerca das divergências doutrinárias e jurisprudenciais existentes. Demonstra-se que a assistência jurídica, a assistência judiciária e a justiça gratuita possuem antecedentes ainda na antiguidade e evoluíram até a conformação atual no direito brasileiro. O objetivo dessa evolução é proporcionar o acesso à justiça e a efetivação do princípio da igualdade, que são ao mesmo tempo fundamentos daqueles institutos. Para o mais amplo atendimento aos necessitados, não há exclusividade na prestação dos serviços de assistência jurídica nem limites nas isenções de despesas judiciais. Os benefícios e a lista de prestadores dos serviços são vastos. Além disso, o procedimento foi simplificado ao longo do tempo até a existência atual de presunção relativa de pobreza daquele que afirma essa condição. / The presented dissertation aims to describe and analyze the institutes of legal aid and exemption from court fees in Brazil, for the benefit of poor people in the legal sense, focusing on individual labor conflicts. It covers the services of free legal advice and advocacy with exemption from legal representatives fees and other charges relating to proceedings. To achieve this objective, it uses the compilation and review of information extracted from doctrinal works, case studies and data collection, all based on national and foreign material, with a final presentation of conclusions and proposals about the doctrinal and case study discussions. It demonstrates that the different systems of legal aid and exemption from court fees have evolved over time until the present existence in Brazilian law, always with the goal of providing access to justice and the realization of the principle of equality, which are also its foundations. To assist the needy to the fullest, there is no exclusivity in the provision of legal aid services or limits on the exemptions from charges relating to the proceedings. The benefits and the list of service providers are vast. Moreover, the procedure has been simplified over time until the existence of the presumption of poverty which states that this condition.

There is no point in an extensive list of civil, political and social rights, if there are no instruments to implement them in practice. The fundamental right to full and free legal aid is, in this context, the principal means of access to justice for those in need. It is through free legal aid that the economic and organizational hype can demand the realization of their rights before the Judiciary. In addition to legal action, full and free legal aid is designed to protect the rights of the needy in other areas, including through extrajudicial channels (through the use of alternative means of conflict resolution), and rights education. In view of the essentiality of this right for the protection of the dignity of the human person, the present work seeks to relate it to the existential minimum, that is, to an intangible content of rights necessary to guarantee a minimum standard of dignity. Thus, as a right integral to the existential minimum, the fundamental right to legal aid must be treated as a priority public policy, which is not subject to the “under reserve of the possibilities” argument. Therefore, the proper structuring of the Public Defender, which is the institution constitutionally designed to effect the fundamental right to legal aid, should receive the same priority attention by the constituted powers / Mais que proclamar direitos, o maior desafio das sociedades democráticas atuais é garantir a sua efetividade. De nada adianta um extenso rol de direitos civis, políticos e sociais, se não existirem instrumentos destinados a concretizá-los na prática. O direito fundamental à assistência jurídica integral e gratuita é, nesse contexto, o principal meio de acesso à justiça destinado aos necessitados. É mediante a assistência jurídica gratuita que os hipossuficientes econômicos e organizacionais podem exigir a realização de seus direitos perante o Poder Judiciário. Disenfranchised heritage. Ancestral graves and their legal protection in South Africa

This thesis begins by providing an account of the ancestral grave relocations of the Sekuruwe community in Limpopo province, South Africa. Sekuruwe claims that the manner in which their graves were relocated disrespected their cultural norms, and infringed their constitutional rights. Over three years of investigation, it was proved that the mine which relocated the graves acted negligently by badly damaging human remains, confusing graves and loosing skeletons. The thesis investigates Sekuruwe‟s case within three theoretical frameworks: Systemic oppression, legal claims to culture, and Ethnicity Incorporated. The role of heritage legislation is highlighted throughout the thesis, and the inadequacies of legislation pointed out with reference to the different theoretical approaches. The aim of the thesis is to understand the way in which Sekuruwe‟s claims of cultural insensitivity are in fact claims of injustice, which are argued through the bodies (and graves, and spirits) of the dead. I aim to understand the way in which these claims of injustice are structured by heritage legislation.

The undefended accused on trial : justice in the lower courts.

Due to the party-orientation and professional nature of the adversary mode of criminal procedure, the principles of a fair trial are best observed where the accused is represented by a lawyer. Given the advantages to be gained from legal representation, the principle of equal justice requires that all accused should have access to legal assistance and thus that legal aid should be provided for indigent accused. The South African legal aid scheme cannot yet provide assistance to all indigent accused because of the large number of these accused, the shortage of manpower and the lack of funds. There are, however, few legislative provisions to safeguard the rights of the vast majority of accused, arraigned in the lower courts, who remain undefended. The Supreme Court, in order to ensure that these accused are fairly tried, has imposed the following types of duties on judicial officers: (a) a duty to facilitate the accused's participation in the proceedings by advising him of his rights and duties and assisting him in their exercise; (b) a duty to control the prosecutor in the exercise of his powers; and (c) a duty to conduct an enquiry before arriving at administrative-type decisions. These duties are, however, inadequate to achieve the Court's, objective because, firstly, not all, rights are made accessible to the accused, and secondly, the duties are inadequate to ensure that the accused's guilt is reliably established. The failure of the legislature and the Supreme Court to incorporate the principle of equal justice into the legal process, has resulted in court proceedings that are characterized by unjust practices and outcomes. To ensure the more equitable prosecution of undefended accused it is suggested that an activist judicial officer should be responsible for the enforcement of all the principles of a fair trial (which would be concretized in clear legal rules) in an impartial manner, with his decisionmaking routinely supervised by the Supreme Court. / Thesis (LL.D.)-University of Natal, Durban, 1986.
