Sanções processuais por ato atentatório ao exercício da jurisdição : instrumento de efetividade das decisões judiciais

No. of bitstreams: 1 Renata Severino_Dissert.pdf: 1164163 bytes, checksum: c42e9294ca9b172947efd728c3b7076b (MD5) Previous issue date: 2007-08-09 / This study aimed at the system of the subject concerning applicable procedural sanctions as the result of contempt of court practice related to the non-compliance with judicial decisions and presentation of solutions to existing contradictions in the brazilian legislation and jurisprudence on the theme in order to help improve the procedural theory; to encourage the use by courthouses of procedural sanctions that stem from contempt of court; and to provide a base for legislation change of the articles which deal with the subject. The research was based on the use of primary and secondary sources as follows: research on bibliography, national and foreign literature as well as the use of a file: books, journals and internet articles; study of law that is applicable to the subject: jurisprudential research at the Supremo Tribunal Federal, at the Tribunais Regionais Federais and brazilian Court Houses, as well as in foreign courts: Supremo Tribunal de Justiça of Portugal; Court of Appeals of North Carolina (USA); Supreme Court of Canada; and High Court and Court of Appeal (Civil Divisions) in England and Wales. After the analysis of the pertaining doctrine, legislation and jurisprudence, we came to the conclusion that the contempt of court in Brazil is contradictory and insufficient, being necessary the standard of improvement of rules of the Code of Civil Procedure about the subject, since the effectiveness of the institute studied is of the utmost importance to the effectiveness of judicial decisions that, by its turn, is a must when it comes to the dignity of justice and guarantee of effective jurisdiction. / O presente estudo teve por objeto a sistematização da matéria concernente às sanções processuais aplicáveis em decorrência da prática de atos atentatórios ao exercício da jurisdição relativamente ao descumprimento das decisões judiciais e a apresentação de soluções às contradições existentes na legislação e na jurisprudência brasileiras sobre o tema, a fim de contribuir para o aprimoramento da teoria processual; estimular a utilização, pelos tribunais, das sanções processuais decorrentes de atos atentatórios ao exercício da jurisdição; e fornecer subsídios à alteração legislativa dos dispositivos que tratam do assunto. A pesquisa foi realizada a partir da utilização de fontes primárias e secundárias, quais sejam: consulta bibliográfica, na literatura nacional e estrangeira, com a elaboração de fichas: livros, revistas especializadas e artigos da internet; estudo da legislação aplicável à espécie; pesquisa jurisprudencial no Supremo Tribunal Federal, no Superior Tribunal de Justiça, nos Tribunais Regionais Federais e nos Tribunais de Justiça brasileiros, bem como em cortes estrangeiras: Supremo Tribunal de Justiça de Portugal; Corte de Apelação da Carolina do Norte (EUA); Suprema Corte do Canadá; e Corte de Apelação da Inglaterra. Após a análise da doutrina, legislação e jurisprudência pertinentes, chegou-se à conclusão de que o disciplinamento do ato atentatório ao exercício da jurisdição no Brasil é contraditório e insuficiente, evidenciando-se necessária a uniformização e aperfeiçoamento das normas do Código de Processo Civil sobre o assunto, visto que a eficácia do instituto estudado é imprescindível à efetividade das decisões judiciais que, por seu turno, é indispensável à dignidade da jurisdição e à garantia da tutela jurisdicional efetiva.

Based on literary study of deep drawing together with calculations, was designed drawing in instrument with holder. The drawing instrument make use of standardised components and it is solving forms to make up stand fitting to hydraulic press CYS 320, with nominal tensile force 3200 kN. Drawing punch and drawing die are produced from high alloyed steel 19 573 heat-worked according to drawing documentation.

The thesis handle design of part of anemostat in size of series 15000 pcs/year. Due to conus shape and dimensions of part was chosen out of quantity of manufacturing processes a technology of deep drawing without a thinnig of 1mm thick DC04 steel. The resulting solution is progressive tool which concatenate four operations of deep drawing process. The drawing tool make use of standardised components. The design contain progressive tool including drawing documentation. Hydraulic press CTH 400 with nominal force 4000 kN is used for mentioned procedure.

Návrh robotizovaného pracoviště pro zápustkové kování / Design of robotized workplace for die forging

The thesis deals with the design of technology for production of wheels to be manufactured by die forging 15 142 low-alloy steel at an amount of 500,000 items per year. Based on a consideration of the suitable methods of manufacture, die forging on a Jing Duann FP-1600G vertical forging press was chosen as the best, as documented by the necessary technological and design drawings. A die with inserts made of 19 552 steel was designed for this machine. In view of the volume of annual production, a fully automated workplace was designed consisting of three robots and a chain and pan conveyor. In the conclusion there was a technical-economic evaluation of costs for the material of the semi-finished products and price of dies for annual production.

The diploma thesis of the master's study in the field of M2I-K presents a design of a hollow rotating part made of metal sheet with a tapering bottom. Deep drawing technology was chosen as the best suited option for production without thinning the wall. Stainless steel was chosen as a source material for production parts in compliance to ČSN 172 40. The drinker is produced by three drawing operations where each operation is performed separately on a standalone press CTH 250 developed by ŽĎAS a. s. A sheet measuring 1500 x 3000 x 1 mm with diameter 428 mm was evaluated as the most economically viable for production of a semi-finished product – rondel. For one year production produced in a series of annual volume 100,000 pieces.

Pursuant to of the literary pursuit a problem of the deep drawing and calculation was designed progressive tool concatenate four operations. The lower ejectors are using for ejecting components. The drawing instrument especially made of non-standardised components and it is designed for use on a hydraulic press CTH 250, with nominal tensile force 250 kN. Drawing punch and drawing die are produced from alloyed instrumental steel 19 436 heat-worked according to drawing documentation. The technical and economical evaluation was focused on the forming cost, which is 2 922 893 CZK in total.

The thesis deals with the design and development of control algorithms and visualization system for controlling of eccentric press and its implementation into the press line. As a control system a SIMATIC s7-300 is used and for visualization the touch panel MP370 is implemented. The first part of the thesis describes a technology of the press line. This is followed by the design of hardware equipment and specification of control units. The thesis also provides insight into the creation of PLC program and explanation of specific functions. Finally, the development of visualization of the machine and description of application windows are demonstrated in the present work.

Výroba opěrného držáku objemovým tvářením / Production of supporting holder by solid forming

This diploma thesis has been elaborated within the Master's study of department 2307 that submits a production proposal of supporting holder by solid forming. The used material of the forging is steel ČSN 12050 with yearly production of 100 000 pieces. The forging has been performed using drop forging method by two operations at the crank forging press LZK 1000, with induction heating of semi-finished product and flash trimming at the trimming press LKOA 200. For this method have been performed required technological calculations, geometric design of the die and assigning production machines needed for this technology. A part of this study is an economical evaluation where have been stated production expenses and prices of the forging of assigned component.
