In this research report the estate implications for a marriage or civil partnership, entered into in terms of the Civil Union Act, are identified by determining the impact thereof and whether or not there are any differences with regard to the estate implications of a traditional marriage.
The Civil Union Act came into effect to give legality to the relationship between homosexual couples by providing the option to conclude a marriage or civil partnership. Both of these institutions thus have the same legal consequences.
According to Section 13 of the Civil Union Act the implications of the Marriage Act also apply to the Civil Union Act. The feasibility of this principle is not taken into account regarding estate implications. Since a marriage and civil partnership in terms of the Civil Union Act differs from a traditional marriage, it leads to uncertainty with regard to the application of this principle. This uncertainty and estate implications are the topic of this study.
The total effect of the Civil Union Act is not discussed in the Civil Union Act, but rather consists of references to other legislation. Consequently the specific estate implications for a marriage or civil partnership, entered into in terms of the Civil Union Act, are discussed with specific focus on marriage regimes, maintenance, purchasing of household necessities, donations and tax benefits. Both the position before and after the Civil Union Act are considered.
Firstly marriage regimes are discussed since it is the first step in identifying estate implications for the marriage or civil partnership. Maintenance is considered a direct result of a marriage and is referred to in many laws. It is therefore necessary to discuss the content of the legislation and whether or not it is compatible with the Civil Union Act. The buying of household necessities, donations and tax benefits has a unique effect on a marriage and the focus in this study is on the effect it has on a marriage and civil partnership entered into in terms of the Civil Union Act. The Swiss Missionaries' educational endeavour as a means for social transformation in South Africa (1873-1975)Masumbe, Benneth Mhlakaza Chabalala 06 1900 (has links)
This research traces the developments in Europe that led to a rush for foreign missions i
different parts of the world, with specific reference to South Africa. It describes the operations
of the Swiss missionaries in South Africa from 1873 to 1975. This study also evaluates the motives
for the evangelization of the African masses, and contradictions th existed in the relations that
missionaries had with proselytes during the period under review. The sterling contributions of
black evangelists in this period are demonstrated. It cannot be denied that the Swiss missionaries
did a lot of good to the indigenous populac of South Africa-the importance of their services at
Lemana Training Institution (1906) and Elim Hospital (1899) are indelibly inscribed in our
historiography. They should also applauded for their response to the plight of the Shangaans, who
had for reasons unkno
to the researcher been by-passed by other missions during the "scramble for mission fields". But
the missionaries also had their shortcomings, for instance their failure to ind the state to remove
capital punishment from the statute books. They may nonetheless stil continue to be used by the

Text in Afrikaans / Pendelhuwelike is aan die toeneem en het verskeie invloede op die jong kind in die gesin. Die primêre doel van die studie was om emosionele en sosiale intelligensie as basis te gebruik om die invloed van ʼn pendelhuwelik op ʼn jong kind tussen 7 en 11 jaar te bepaal. ʼn Gemengde navorsingsontwerp is as empiriese ondersoek gedoen. Vyf deelnemers het deelgeneem in drie sessies elk. Die data-insamelingsinstrumente was: waarneming en veldnotas; projeksiemedia; ʼn vraelys, en ʼn semi-gestruktureerde onderhoud met elk van die betrokke moeders. Die meting van emosionele en sosiale ontwikkeling met behulp van die vraelys toon dat, ongeag van die afwesigheid van die deelnemers se vaders, en die konflikte, vrese en behoeftes wat hulle ervaar volgens die projeksiemedia, die deelnemers se emosionele en sosiale ontwikkeling oorwegend gemiddeld tot hoog is. Die uitkomste bied hopelik ʼn insiggewende bydrae hoe pendelhuwelike vyf jong kinders se emosionele en sosiale ontwikkeling beïnvloed het. / Commuter marriages are increasing and have various influences on the young child in the family. The primary aim of this study was to determine the influences of a commuter marriage on a young child between 7 and 11 years, using emotional and social intelligence as a basis. A mixed method empirical research design was used. Three sessions were conducted with five participants individually to obtain data through: observations and field notes, projection media, a questionnaire, and a semi-structured interview with each mother. The measurement of emotional and social development through the use of the questionnaire shows that, despite the absence of the participants’ fathers, and the conflicts, fears and needs they experienced according to the projection media, the participants’ emotional and social development are predominantly average to high. The study hopefully provides a significant contribution to the understanding of how commuter marriages influenced five young children’s emotional and social development. / Psychology of Education / M. A comparative legal analysis of the effects of divorce on marital propertyMakola, Thulelo Mmakola 01 1900 (has links)
The movement of people from county to country brought about an increase in international marriages. However, South African private international law rules with regard to the proprietary consequences of marriage are not on par with their foreign counterparts. The prejudicial rule which governs proprietary consequences of marriage has raised difficulties for our courts in past and recent cases. The advent of a new constitutional dispensation in South Africa forbids discrimination based on sex, gender and marital status. Furthermore, the question is asked whether parties to a marriage with a foreign matrimonial domicile may rely on section 7(3) of the Divorce Act 70 of 1979. The classification of redistribution orders in private international law matters has given rise to uncertainty.
The objectives of the study are to suggest workable alternatives to the current connecting factor for proprietary consequences of marriage in South African private international law and to investigate the availability of redistribution orders to spouses applying for divorce in South Africa. / Private Law / LL.
