Eismo įvykių tyrimo metodika ir tobulinimo perspektyvos / Investigation methods and their development in traffic accidents

Šiame darbe yra išanalizuotos ir pateikiamos eismo įvykių baudžiamoji teisinė ir kriminalistinė charakteristikos, kurių žinojimas yra būtina sąlyga, siekiant tinkamai kvalifikuoti, vertinti šią nusikalstamą veiką, sėkmingai planuoti tyrimą. Išnagrinėjus eismo įvykio atskleidimo ir jų tyrimo planavimo ypatumus pateiktos pagrindinės tipinės tyrimo situacijos ( a) vairuotojas, transporto priemonė ir nukentėjusysis yra įvykio vietoje arba dėl tam tikrų priežasčių jų nėra įvykio vietoje, tačiau apie juos turima informacijos, b) nukentėjusysis yra eismo įvykio vietoje, o transporto priemonės ir vairuotojo nėra, c) nukentėjusysis ir transporto priemonė yra eismo įvykio vietoje, tačiau nėra vairuotojo) ir pagrindinės tipinės tyrimo versijos ( a) eismo įvykis įvyko dėl to, jog transporto priemonės vairuotojas pažeidė KET reikalavimus ar transporto priemonės eksploatavimo taisykles, b) eismo įvykis įvyko dėl nukentėjusiojo grubaus neatsargumo, c) eismo įvykis įvyko dėl to, jog nukentėjusysis pažeidė KET reikalavimus, d) eismo įvykis įvyko dėl atsitiktinio aplinkybių susiklostymo, kurio eismo dalyviai negalėjo numatyti). Konkretūs tyrimo veiksmai, jų atlikimo ypatumai priklauso nuo susiklosčiusios tyrimo situacijos ir iškeltų tyrimo versijų. Tiriant šią nusikaltimą veiką dažniausiai yra atliekami tokie proceso veiksmai: eismo įvykio vietos, transporto priemonės, nukentėjusiojo (lavono) bei kitų objektų (nukentėjusiųjų drabužių, dokumentų) apžiūros (tyrimai), liudytojų, nukentėjusiųjų... Knowing these characteristics is very important, because it helps to qualify and assess correctly this criminal act and to plan an investigation. Having explored specifics of disclosure and investigation planning of traffic accidents, there are laid typical situations of investigation ( a) the driver, the vehicle and the victim are at the scene of the traffic accident or in case they are no, but investigators have information about them; b) the victim is at the scene of the traffic accident, but the are no the vehicle and the driver; c) the victim and the vehicle are at the scene of the traffic accident, but there is no the driver) and main typical versions of investigation ( a) the driver’s breach of Rules of the Road Traffic or vehicle exploitation was the main cause of the traffic accident; b) the victim’s negligence was the main cause of the traffic accident; c) the victim’s breach of rules of the road was the main cause of the traffic accident; d) incidental circumstances were the main cause of the traffic accident). The evaluation methodology of taxonomic structure of perennials for the needs of horticulture and landscape architecture defines a new way of description and selection of the best quality varieties of perennials for use in practice. This methodology originated from a previously published evaluation methodologies of taxonomic structure of perennials and it has been enriched with new features. These features include the new system of capturing of development of variety during the time of year and the system of overall evaluation of varieties using the defining parameters (not only the subjective evaluation). This methodology is the main output of this thesis. The methodology was tested on a range of the genus Hemerocallis L. in the complex of Faculty of Horticulture in Lednice, Mendel University in Brno. According gained experience from the field the methodology has been improved and amended. The methodology was developed to combine the efficiency and accuracy of selecting varieties with good economy of evaluation. It is also useful for a wide range of taxa (after modification). If the methodology will be applied in the future, it will be possible to use it to select the most suitable varieties for the landscape architecture objects.

I was chosen the topic of my thesis "The metodology of drug criminality investigation" becuase I am very interested in this issues and I consider drug use and abuse as very present global problem. The thesis is divided into two parts. The general part contain six chapters. I begin with the introduction into the problem including used terminology and slang expressions too. Then I describe particular drugs and their consequences. The following charter is connecting of drug abuse with crime and developement and situation in the Czech republic before the year 1989, after this year and the present state. Chapter five is constituted by structure of internal body causing in the drug problems area. In the ending of the first part I present the progress of our legislation in the drug crime including the outline of legislation state in the EU states. The second part is formed by the metodology of drug criminality which is devided into ten chapters. The first chapter contain the description of general metodology of crime investigation. Chapter two is formed by the criminal characteristic including typical way of commiting and offender description. The diploma thesis deals with the "Methods of investigation of murders (selected topics)". Within the theoretical part, the first charter describes the legal point of view of criminal acts against the life with the emphasis on murders. The following chapter is dedicated to general features of the methods of investigation of individual kinds of criminal acts. Criminology and its system were specified, together with the terms such as the methodology of investigation. Furthermore, the components of individual methodologies were defined. The deeper description of selected components of the methods of investigation represents the fundamental and comprehensive part of the thesis. The statistics and prognosis which present the numbers of murders, their trends and their homicides of the last decade are included. The statistics present the relations between homicides and the levels of their acquired education, the percentage of homicides with academic education and the percentage of women among homicides. The final part of the thesis deals with criminal case studies. The murders committed in passion and motivated by human conflicts were selected. 1 Summary The presented thesis deals with methods of investigation of robberies. It comprises all essential parts of such methodology and therefore aims to provide a complex view on the subject. Moreover, the work offers a deeper insight into some particular methods of investigation and emphasizes psychological aspects of investigation as well as of crime prevention. Comparison with foreign author's view on the subject is also included. The work consists of ten chapters dedicated to separate components of investigation. Chapter one presents the subject of investigation - robbery, its place in Czech law and legal definition set out by the Criminal Code. Chapter two provides criminalistic description of a robbery from different points of view and includes a relatively large part concentrating on foreign literature and robbery categories presented therein. Chapter three lists typical evidence which can be found on the crime scene and points out psychological aspects of formation of witness's memories of the crime. Methods: In our thesiswe used a method of analysis and study of documents, historical method and the method of compilation and comparison. The method of analysis was applied in the analysis of various aspects of discipline kumite and method of compilation and comparison in the comparison of traditional and modern teaching methods. Method photographs and video footage was used for multimedia processing the issue with output in the form of a DVD. Results: The result of this study is a modern concept of teaching sport match which follows the changing trends in the development of karate raised working towards Olympic sport. The methodology of investigation of crimes against life (selected problems) Abstract The topic of this thesis is the methodology of investigation of crimes against life. Due to the fact that this is undoubtedly a very wide topic and the investigation of all crimes against life follows the same principles using similar methods, this diploma thesis is focused on the method of a murder investigation as the most serious crime against life, if not the most serious criminal action of them all. The first chapter of my diploma thesis is devoted to the substantive regulation of all crimes against life according to § 140 to 144 of the Criminal Code. In this part of the thesis, I describe the obligatory signs of their facts, ie. their object, subject, objective side, and a subjective aspect. In the second chapter of this thesis, I deal with the criminalistics characteristics of the crime of murder, whose typical components are the way of committing, the personality of the perpetrator and the victim as well as the motive. As part of the thesis, I use examples from practice, namely cases of serial murders on which these typical characters can be shown.
