O objetivo desta pesquisa é explicar os mecanismos sociais das decisões judiciais. Em particular, a investigação centra-se no processo de tomadas de decisões de operadores do Direito no sistema de justiça juvenil em São Paulo. Busca-se, assim, verificar quais são os fatores determinantes da aplicação da medida socioeducativa de internação para adolescentes acusados de cometimento de ato infracional e o modo pelo qual se dá esse processo decisório. Desde a promulgação do Estatuto da Criança e do Adolescente, em 1990, o sistema de justiça juvenil brasileiro passou a operar em um novo registro: as medidas socioeducativas passaram a se restringir a autores de infrações penais; e a medida de internação, em particular, a crimes cometidos com violência e/ou grave ameaça à pessoa. Mas a gravidade do ato infracional é de fato o principal preditor das decisões judiciais na justiça juvenil? Ou haveria outros fatores explicativos, como aqueles relacionados às características sociais dos adolescentes, às relações de poder inscritas nas interações sociais ou mesmo à estrutura organizacional dos tribunais? Na busca pela explicação dos mecanismos sociais dessas decisões judiciais, esta pesquisa propôs um desenho multimetodológico, integrando técnicas quantitativas e qualitativas para investigar os mecanismos das decisões e verificar os determinantes da aplicação da medida socioeducativa de internação em São Paulo. Assim, em um primeiro momento, as hipóteses citadas foram testadas por meio de modelos logísticos binomiais tendo a decisão sobre a internação como variável dependente em um cenário multivariado. Os resultados encontrados indicam um alto grau de proporcionalidade entre crime e pena, tendo os atos infracionais considerados mais graves os mais significativos efeitos sobre a probabilidade de internação; mas indicam, também, a reprodução de relações de poder - adolescentes usuários de drogas e que não trabalham nem estudam, mantidas as outras dimensões constantes, também têm maior chance de receber a medida socioeducativa de internação. Em seguida, a fim de explicar os mecanismos dos efeitos do tratamento estimados anteriormente, foram acompanhadas semanalmente as audiências de apresentação e de continuação e as oitivas informais no Fórum Brás, em São Paulo. Ao mesmo tempo em que se concluiu que as oitivas informais, centrais no processo decisório, ocorrem cerimonialmente e que as decisões são tomadas via documentos, o que explica o mecanismo de proporcionalidade encontrado anteriormente, pôde-se concluir que eventualmente os Promotores de Justiça \"voltam atrás\" de suas decisões quando há um rompimento na definição da situação, o que explica o mecanismo dos efeitos das características individuais dos adolescentes. / This research aims at investigating the social mechanisms of judicial decisions. It particularly focuses on the decision-making process of legal actors in the juvenile justice system in São Paulo. Thus, the research aims at verifying the determinants of the confinement disposition for juveniles who have been accused of a crime and the way which this decision is made by. Since the Child and Adolescent Statute was promulgated in 1990, the Brazilian juvenile justice system started working under new guidelines: dispositions are now restricted to offenders; and the confinement disposition is restricted to offenses committed with violence and/or with a threat to a person. But is the seriousness of the crime indeed the best predictor of judicial decisions? Or are there other explanatory factors, such as the ones related to the individual characteristics of the teenagers, to the power relations within social interactions, or even to the court organizational structure? Aiming at a mechanism-based explanation of these judicial decisions, this research has proposed a mixed-methods research design, integrating both quantitative and qualitative techniques to investigate mechanisms of the decision-making process and to verify the determinants of the confinement disposition in São Paulo. Thus, at first, the aforementioned hypotheses were tested with binary logistic models, presenting the decision concerning the confinement disposition as the dependent variable on a multivariable scenario. Results indicate a high degree of proportionality between crime and punishment, with the seriousness of the offenses having significant effects on the probability of confinement; but the results also indicate some reproduction of power relations - drug user youth and those who neither work nor study increase their odds of being more severely punished. After that, aiming at explaining the mechanisms of the treatment effects estimated beforehand, both judicial and informal hearings (at the State\'s Attorney office) were weekly observed at the juvenile court in São Paulo. While it was possible to conclude that the informal hearings are central to the decision-making process and occur ceremonially, with decisions being made by documents-consulting (which explains the proportionality mechanism), the research also found that the Attorneys often regret their decisions when there is a rupture of the definition of the situation. This explains the mechanism of the individual characteristics effects on juvenile sentencing.

Conceptualizing teachers' perceptions of Aboriginal student achievement : an exploratory study

ABSTRACT The primary purpose of this study was to explore teachers’ perceptions of Aboriginal student achievement in six Saskatchewan public community schools in urban, rural, and Northern settings. Three of the schools were elementary schools, and three were high schools. Data for the study were obtained by means of teacher semi-structured interviews, and a teacher survey designed expressly for this research. The research opportunity sought to “explore in the context of selected Saskatchewan community schools, teachers’ perceptions of Aboriginal achievement, the unique and contextualized features that govern Aboriginal learning, and the efforts of teachers to enhance Aboriginal student learning.” Historically, Aboriginal student achievement has been viewed through a deficit lens. To gain a positive perspective of this phenomenon, a constructivist paradigm, a social justice theory of change governed by an ethos of appreciative inquiry were employed using a Mixed Methods Research design. Specifically, a two phase exploratory methodology where a qualitative phase followed by a quantitative one was used to best inform the research perspective. A multi-case study approach for each school and division was deemed the most effective means of exploring teacher conceptualizations of the manner and conditions under which Aboriginal students best learn. A total of nine teachers were interviewed and 28 responded to the teacher survey instrument. Member checks of the interview data were undertaken and statistical data using both Excel for Windows as well as SPSS statistical programs were employed for survey data analysis. Owing to the small survey sample, the author advises that caution be used when considering the survey results. However, it is hoped that refinement of the survey tool and its use in later research will prove to be of benefit in understanding the phenomenon of Aboriginal student achievement. A peer data analysis panel was convened to thematically analyse the four open-ended questions contained in the survey. Findings for this study indicated teachers valued the work of collaborative teams, supportive school learning environments, differentiated instruction, assessment for learning, professional development, and culturally responsive instruction and curriculum and school/division alignment to enhance Aboriginal student achievement. The study found that perceptions of Aboriginal and non-Aboriginal teachers differed where Aboriginal student achievement was concerned. As well, participants felt that heightened Aboriginal student achievement could be fashioned by determined student engagement in their academic work. Finally, participants believed that parent and community engagement in schools and the academic life of their children would also enhance Aboriginal student learning outcomes. It is hoped that this study will serve as a point of initiation for more research into the phenomenon on a wider basis in order to generate greater understanding of the means by which Aboriginal students may flourish within public schools in Saskatchewan and potentially elsewhere.

Quality assurance policy and practice in higher education institutions in Ethiopia

The purpose of the study is to explore the current policy and practice of the national and institutional QA system in public HEIs in Ethiopia in order to determine how the quality of teaching and learning might have been enhanced through the QA system. Two organisational theories – contingency and neo-institutional theory – provide a theoretical lens to explain how internal and external organisational environments affect the implementation of QA in the HEIs. The mixed-methods research approach was used in the study, including document analysis, semi-structured interviews and questionnaires. Three public universities were chosen as data source. At macro level, the HERQA was also included to examine the effect of the institutional environments on internal quality assurance practices. The findings revealed that there is little evidence of self-initiated quality enhancement activities in the public HEIs. They do not have adequate structures, systems, and written policies to assure quality. The quality assurance efforts were implemented without a clear sense of direction and purposes and therefore lacked effective coordination. The self-evaluations were symbolically took place at the higher levels of the universities and that the results of the evaluations were rarely used in a structured way in improvement of teaching-learning, faculty decision-making and planning processes. It is far from clear that whether the internal quality assurance contributed to the teaching and learning or transformed the student learning experience. It can be concluded that the HERQA’s quality assurance policy and practices seems to be de-coupled from internal initiatives to improve quality in the higher education institutions. It is recommended that HEIs should develop QA policy, mobilise resources for institutional quality improvement, establish full-fledged QA structures at all levels, and furnish the structures with necessary human resources. The HEIs should initiate and undertake effective self-assessment of their activities, own it and work towards achieving their own stated objectives. It is important that the HERQA should develop accreditation procedures, particularly at programme level, for the public HEIs. The HERQA should consider playing more active roles in communicating with HEIs regularly about QA; pay more attention to a follow-up of the audits, the punctual development and delivery of the SEDs. The HERQA should be more independent, have more autonomy and sufficient resources to become a viable professional agency informing the HE sector on the quality of its performance. / Educational Management and Leadership / D. Understanding Pro-Environmental Behaviour as Process: Assessing the Importance of Program Structure and Advice-Giving in a Residential Home Energy Evaluation Program

Despite recognition that reductions in fossil-fuel usage are necessary to reduce environmental harm, energy consumption continues to rise globally. There is a growing need to understand how to effectively influence individuals to reduce their energy consumption, particularly of fossil-fuels. Pro-environmental behaviour is the subset of consumer behaviour that is oriented towards reducing environmental impact compared to other options. It is widely agreed that due to a multiplicity of influencers, pro-environmental behaviour is best analysed using an integrated approach that allows the inclusion of different disciplinary perspectives, and seeks to identify the most important influences in the system under study. This dissertation sought to address the broader challenge of how to better design programs and policies that result in behaviour that is more sustainable. The objective of this dissertation was to assess the importance and effects of program structure and advice-giving on the pro-environmental behaviour of participating in a home energy evaluation program that encouraged homeowners to implement energy efficiency retrofits. Program structure was defined as the combination of the price of the evaluation, the financial reward structure, the level of government support, and the focus on influencing eight specific decisions within a specified timeframe. Advice-giving occurred during the initial evaluation with a home energy advisor and with the delivery of the report that contained a set of recommendations. A convergent mixed methods research design was employed to assess the relative importance of the two factors on participation and advice-following, where advice-following was considered as the matching of decisions to recommendations. The quantitative dataset was made up of files that detailed the 13,429 initial and the 6,123 follow-up evaluations conducted by advisors of the Residential Energy Efficiency Project (REEP) in the Region of Waterloo between 1999 and 2011. The qualitative data were gathered through 12 interviews with home energy advisors, eight of whom had worked for REEP and had conducted more than half of the home energy evaluations contained in the quantitative dataset. A natural quasi-experimental intervention that measured self-selection in response to varying program structure was employed to examine for variations in participation, material characteristics of houses, recommendations, and advice-following. To extend our understanding of the process of participation and decision making patterns, other analyses focused on relationships between the number of recommendations, the time between initial and follow-up evaluations, the number and types of decisions made, and the prioritization of decisions. The interviews assessed for differences in styles of advice-giving, and for their impact through comparison with the quantitative data that detailed the recommendations and decisions taken by the homeowners. The results of the effects of both factors were interpreted jointly and compared to previous studies about REEP or the EnerGuide for Houses and program as it was delivered nationally. This dissertation confirmed that an integrated approach to examining pro-environmental behaviour is supported as a useful framework for analysis. The findings support a process-based definition of pro-environmental behaviour as a useful model and form of integration. A convergent mixed methods research design is supported as a valuable and rigorous approach to examine the impact of various influences simultaneously. The delineation of multiple stages in the decision making process greatly enhanced the quality of analyses and findings. The two main factors of program structure and advice-giving affected advice-following. One factor influenced the other, as the program structure affected the receptiveness of homeowners as perceived by advisors, which affected advice-giving. The findings support the importance of both behaviourist and social learning approaches in influencing pro-environmental behaviour, and that their importance varies depending on the stage of the decision process. The findings show that behaviourist interventions, such as the program structure, were associated with variations in participation, and that different subsets of the population of houses from the Region of Waterloo were attracted to the different program structures. Indeed, in each program structure, the decision to return was influenced by different decisions. A critical finding of this study was that these programs were not sufficient to alter the path dependence of energy consumption or of energy systems as the program participants usually did not implement the most effective retrofits, and if they did, the retrofits did not achieve adequate depth of reductions to energy consumption in a timely manner. According to the home energy advisors, many homeowners had pre-conceived ideas upon entering the program of replacing their heating systems and windows. The interpretation of the qualitative and quantitative data showed that these intentions were often not altered, particularly in the case of windows, the decision that advisors believed to be the least effective of energy decisions.

The aim of this dissertation is to discover what kinds of books are the preschool children read by both their parents and their preschool teachers. The theoretical part defines the preliteracy of the readers and the preschool age, and describes the children's contact with books both at home and at kindergartens. Defines a book in the terms of a medium being in contrast to other communication means. The practical part is based on a mixed design of the research: the quantitative part uses the method of a questionnaire, and the qualitative part draws on the in-depth interviews, the respondents being the parents and preschool education teachers. At first, the questionnaires are compared. The decisive factors in parents and preschool educators selection of the books are characterized afterwards. The children are most frequently read storybooks and bedtime stories. Preschool teachers read out fables, parents do not. Furthermore, parents read out adventure literature. Thus, the parents and the school complement each other. Both at home and at school, children come into contact with prose as well as fiction. Adults prefer to read out older books, published mostly by Albatros Publishing, or they lend books in a library. It further aimed to determine if the relationship between these two constructs was moderated by their race/ethnicity or the number of languages they speak. Finally, it sought to identify preservice teachers' understanding of equity in science education, as well as how they planned to incorporate the equity concept into their future science teaching practices for diverse learners in early childhood classrooms. Data for this study were drawn from 380 preservice teachers who self-enrolled in a science methods course as part of a teacher preparation program. To measure the preservice teachers' cultural awareness and self-efficacy in equitable science education, two Likert-scale instruments, Cultural Diversity Awareness Inventory (CDAI) and Self-Efficacy Beliefs about Equitable Science Teaching and Learning (SEBEST), were employed. Qualitative data were collected by administering six open-ended questions. For quantitative results, statistically significant findings indicated that when the participants were more aware of creating a multicultural environment and instruction and/or when they were less biased and were more sensitive/knowledgeable about diversity of students and families, their expectations about science learning of students from diverse backgrounds would be higher. Furthermore, when the participants were more aware of creating a multicultural environment and instruction and/or when they felt more comfortable about confronting students or parents whose cultures and languages were different from their own, they tended to have a stronger sense of efficacy in teaching science to those students. In addition, when the participants were less biased and were also sensitive and knowledgeable about students' and families' diverse backgrounds, they were more likely to have a strong sense of science teaching efficacy. Along with these findings, participants' race/ethnicity was a statistically significant moderator affecting the relationship between their sense of science teaching outcome expectancy and awareness of creating a multicultural environment and instruction. When the awareness of creating a multicultural environment and instruction of both White and non-White participants were increased at an equal level, White participants' expectations for science learning of students from diverse backgrounds were higher than those of non-White participants. Measurement challenges were identified through the analysis process that compromised the validity of the quantitative findings. Thus, they should be interpreted with caution. For qualitative results, three predominant themes related to the participants' conceptualization of equity in science education were identified. First, the participants harbored alternative understandings of the definitions of equity in science education. One third of the participants understood equity as providing appropriate access and support based on the levels of students' needs whereas another one third defined equity as providing identical teaching services and resources to all students regardless of their backgrounds. They also conceptualized equity in science education as an issue independent of their future students' racial/ethnic backgrounds; instead, they regarded it as a subject associated with their students' English proficiency.
