To meet this mister, we dealt with the theoretical assumptions of classical liberal economic thought, Keynesianism, neo-liberal thinking(Hayek, Friedman) and reflects the adoption of these theoretical frameworks in the social and economic policies of Latin American countries, especially in Brazil as part of the 'Washington Consensus', from the 80's. In this context, we analyzed the clash between the written Constitution and the Constitution Real, which resulted in several amendments, staining liberalizing the constitution, but not dismantled the progressive project. / A dissertação discute o contexto político, histórico e jurídico que engendrou a nova Constituição Federal (1988), desde a análise do arcabouço político que marcou a sua promulgação até o estudo das emendas sofridas por esta Carta, em razão da adoção das diretrizes neoliberais. Para cumprir a este mister, abordou-se os pressupostos teóricos do pensamento econômico liberal clássico, o keynesianismo, o pensamento neoliberal (Hayek, Friedman) bem como o reflexo da adoção destas matrizes teóricas nas políticas sociais e econômicas dos países latino-americanos, especialmente no Brasil, no contexto do Consenso de Washington‟, a partir a década de 80. Nesse contexto, analisou-se o embate entre a Constituição escrita e a Constituição Real, do qual resultou em várias emendas, de coloração liberalizante, à Constituição, mas não desmantelaram o projeto progressista.
