Two roads - no exit : an in camera discourse on negotiations in North America todayMcIntyre, Donald G. 11 1900 (has links)
This work is an interdisciplinary exploration of negotiations between the nations that
make up Canada. It explores the disparity that remains between Aboriginals and non
Aboriginals in Canadian North America at a systemic level. It will show that the postcolonial
era is rampant with colonial doctrine and that these principles and policies
maintain a dogmatic system that can not allow for the continued existence of Aboriginals
as separate and distinct peoples. I will show my understanding and interpretation of an
old Indigenous system and suggest ways in which aspects of this ancient system may be
valuable in creating a coordination of world views that can allow for both factions to
exist and prosper. I will specifically address how the differing world views that exist
between Aboriginal and non-Aboriginal Canadians—and the inequality between these
two groups of peoples—has been and remains infused in the negotiation process that
these governments attempt to complete. The final aspect of this work will be a theatrical
production piece that allows (in some small way) the traditional Indigenous approach to
‘law’ to be given equal weight as the Supreme Court in Delgamuukw suggests. / Law, Faculty of / Graduate

An analysis of the transfer duty implications on the 'sale'of a trustLe Grange, Andries Johannes January 2013 (has links)
This dissertation is mainly a study of the nature of trusts and their daily operational limitations, which are frequently misunderstood and/or misused. My research question was whether a trust could be sold, and if so, what the tax implications of such a ‘sale’ would be. The overall approach was to perform a literature review and a critical analysis of current information available on South African trust law and the Transfer Duty Act 40 of 1949.
Many studies have been undertaken in the past on various aspects of my subject, but the subject has never been studied as a cohesive whole. These studies formed the basis of the literature review. To arrive at an answer, an analysis of the available literature and South African judgments was undertaken.
My concluding chapter gives an indication of whether a trust can be ‘sold’, what the current transfer duty implications are and what it is submitted they should be. / Dissertation (LLM)--University of Pretoria, 2013. / hb2014 / Mercantile Law / unrestricted

Development of a turbocharger compressor with variable geometry for heavy-duty enginesWöhr, Michael, Chebli, Elias, Müller, Markus, Zellbeck, Hans, Leweux, Johannes, Gorbach, Andreas 04 June 2019 (has links)
This article describes the first development phase of a centrifugal compressor with variable geometry which is designed to match the needs of future heavy-duty engines. Requirements of truck engines are analyzed, and their impact on the properties of the compressor map is evaluated in order to identify the most suitable kind of variable geometry. Our approach utilizes the transformation of engine data into pressure ratio and mass flow coordinates that can be displayed and interpreted using compressor maps. One-dimensional and three-dimensional computational fluid dynamics fluid flow calculations are used to identify loss mechanisms and constraints of fixed geometry compressors. Linking engine goals and aerodynamic objectives yields specific recommendations on the implementation of the variable geometry compressor.
