Inadmissibility of Evidence in Criminal Proceedings Abstract The main goal of this work is to find out exactly how the conditions of admissibility of evidence in criminal proceedings are determined by law. This issue is explained in detail not only in the so-called Rath Case, where there was a conflict of views on the requirements of the application for spatial interception, specifically in the decisions of the High Court in Prague of October 17, 2016, file no. 6 To 106/2015 and the Supreme Court of June 7, 2017, File no. 6 Tz 3/2017-I.-693. First, the work deals with individual means of evidence and their possible defects, which may result in their inadmissibility at the court. Subsequently, the author explains the differences between the concepts of ineffectiveness, inadmissibility and illegality of evidence, which is defined only by legal science, but which are essential for understanding the issue of admissibility of evidence and possible correction of inconsistencies in the Czech legal system. It also offers insight into the issue of absolute and relative ineffectiveness of evidence and then deals with the American Doctrine of Fruit from the Poisoned Tree and the views of Czech experts in the field of law on this doctrine, or other methods of assessing secondary evidence. Parowan Valley Gaming Pieces and Insights into Fremont Social Organization

This thesis primarily addresses the implications of Fremont gaming pieces in the Parowan Valley. First, I review ethnographic gaming pieces and compare them to the Fremont worked bone pieces in order to support the idea that they were used by the Fremont in games similar to the ones recorded ethnographically. Then, I analyze a collection of Fremont gaming pieces from excavations at three Parowan Valley sites. I note drastic differences in the characteristics found on pieces inside the Parowan Valley and those form outside the Parowan Valley. It is also clear that gaming pieces are being produced in the Parowan Valley and used more frequently there when compared to outside of it. I suggest that this means large aggregations are taking place in the Parowan Valley in the late Fremont period.

Developing a Quantitative Understanding of U-Substitution in First-Semester Calculus

In much of calculus teaching there is an overemphasis on procedures and manipulation of symbols and insufficient emphasis on conceptual understanding of calculus topics. As such students to struggle to understand and use calculus ideas in applied settings. Research shows that learning calculus topics from a quantitative reasoning-perspective results in more powerful and flexible conceptions of calculus topics like integration. However, topics beyond introducing integrals and the Fundamental Theorem of Calculus, like u-substitution, have yet to be explored from a quantity-based perspective. In this study, I conducted a set of two clinical interviews where we discussed quantitative meanings of integrals, derivatives, and differentials and used those meanings to quantitatively develop u-substitution. This study suggests that given the scaffolding of the quantity-based tasks students can develop the u-substitution structure (substitution of the bounds, the function, and the differential) by applying quantitative reasoning. It also suggests that two-quantity quantitative relationships are critical to students' productive thinking about substitution. Finally, this study offers a theoretical and quantitatively grounded framework for understanding u-substitution.

Design For All: The Neutral Ground Market in Freret, New Orleans

This project is a celebration. Inspired by time spent in Baltimore, this thesis examines how standardized elements can be utilized to create Architecture and make astute, functional, contextually sensitive, and pleasurable design accessible for all. With the heavy, stuccoed buildings of New Orleans as precedent, the Neutral Grounds Market utilizes CMUs for both practical and aesthetic purposes. Drawing from a rich lineage of structural polychromy and through knitting CMUs together into a subtle pattern, the building speaks to its colorful context, despite the lack of CMU structures in the area. Weaving ethics and aesthetics, the site sits within a Food Desert and this thesis begins at the seam of three neighborhoods - Freret, Milan, and Uptown. Block by block varies tremendously within these neighborhoods, and the static images of both the opulence and desolation of New Orleans becomes clear here. Aiming to bring not only fresh food into the neighborhood, but to work realistically within the diverse backgrounds of the residents’ lives, the program integrates a Farmer’s Market with a Grocery Store so fresh food will constantly be available and can meet the needs of all the citizens. In addressing context as a matter of both the material, built environment and the personal, human milieu this thesis addresses the economic and the emotional as a pair, realizing the importance of each. This integrated program creates a new civic space which will bolster the vibrant growth already begun on Freret St. and throughout the neighborhoods. The fast changes of the last 20 years, with prominence the ascension of the technologies of information and communication, radically transformed products, processes, uses and people's life. These facts, together with the commercial and financial liberalization promoted a new managerial conformation. It has been understood that the innovations, especially the technological ones, are motors of the competition and of the industrial development. That demands great production flexibility from the companies, to be capable to compete and to stay in this dynamic process. The answer of the companies to the new competitive conformations has been given through innovations of products, processes and organization. However, for these incorporations the companies should possess competences to use the technologies and the available knowledge. On the other hand, the amounts of necessary resources, human and financial, are not always available. This way, the companies have been taken advantage of collaborative strategies to join competences that they still don't possess. The performance in productive arrangements with interactive performances facilitatates the diffusion and generation of innovations, since the local proximity and the common culture allow the transmission and change of knowledge. In this sense, we have searched for an answer, through an exploratory and descriptive method, for the diffusion and the generation of technological innovations in the industry of pieces of residential rectilinear furniture, contemplating the interactions between the companies and the institutions linked to the industry in productive arrangement. It was verified that companies and institutions have been demanding efforts concerning the technological innovation of the industry of pieces of rectilinear furniture residences of Bento Gonçalves (RS). The interactive performance in the environment of the productive arrangement permits a healthy atmosphere for the diffusion and the use of the new knowledge obtained from several sources, especially, through the participation in regional events, and also through national and international research actions and development. The results of this study contributes to detach the importance of the external atmosphere in the diffusion and in the generation of technological innovations, and the recognition of the companies to the advantages associated to the location in the area, to the existent partnerships among the agents and to the innovations adopted in the period. / As rápidas mudanças dos últimos 20 anos, com destaque a ascensão das tecnologias de informação e comunicação, transformaram radicalmente os produtos, processos, formas de uso e a vida das pessoas. Isto aliado à liberalização comercial e financeira promoveu uma nova conformação empresarial. Entende-se que as inovações, em especial as tecnológicas, são motores da competição e do desenvolvimento industrial. Isso exige das empresas uma grande flexibilidade de produção, para que estas sejam capazes de competir e se manterem neste processo dinâmico. A resposta das empresas às novas conformações competitivas tem se dado através de inovações de produtos, processos e organizacionais. Todavia, para estas incorporações às empresas devem possuir competências para fazer uso das tecnologias e dos conhecimentos disponíveis. No entanto, os montantes de recursos necessários, humanos e financeiros, nem sempre estão disponíveis. Deste modo, as empresas têm recorrido a estratégias colaborativas para agregarem as competências que ainda não possuem. A atuação em arranjos produtivos é tida como facilitadora da difusão e geração de inovações, visto a atuação interativa dos agentes, onde a proximidade local e a cultura comum permitem a transmissão e troca de conhecimentos. Neste sentido, buscou-se responder, através de um método descritivo, como ocorre a difusão e a geração de inovações tecnológicas na indústria de móveis retilíneos residenciais, contemplando as interações entre as empresas e as instituições vinculadas à indústria no arranjo produtivo de Bento Gonçalves (RS). A pesquisa se desenvolveu em duas etapas, onde na fase qualitativa foram entrevistadas as principais instituições que atuam no APL e, na fase quantitativa, os dados foram obtidos junto às empresas produtoras. Na tabulação dos dados utilizou-se o software SPSS 10.0 e, na análise, fez-se uso da estatística descritiva e de testes não-paramétricos. Constatou-se que empresas e instituições têm demandado esforços no tocante à inovação, porém ainda de forma incremental e baseada na cópia dos produtos e processos já existentes no mercado. A atuação interativa é reconhecida pelos agentes como importante fator competitivo, haja vista o reconhecimento das vantagens associadas à localização na região, às parcerias existentes e às inovações adotadas no período. Os resultados deste estudo contribuem para destacar a importância do ambiente externo na difusão e na geração de inovações tecnológicas, haja vista o reconhecimento das empresas às vantagens associadas à localização na região, às parcerias existentes entre os agentes e às inovações adotadas no período.

Le visuel et le sonore en matière de composition musicale : un rapport homologue

Le visuel, et notamment la théâtralité, les gestes, la vidéo et la danse, pourraient-ils être traités en tant que matière connexe au son dans la composition musicale ? Quelles sont les stratégies à notre disposition pour intégrer de manière pertinente l’image et le son ? Qu’est-ce qu’implique l’intégration du visuel dans la création et l’interprétation d’une oeuvre musicale ? À partir de ces questionnements, sept pièces ont été composées dans le cadre de ma maîtrise entre les mois de septembre 2014 et août 2016. Ce mémoire décrit les principales étapes de conception de ces pièces ainsi que leur processus de composition dont le but était la recherche de solutions et de stratégies visant un rapport homologue entre le visuel et le sonore dans le processus de création musicale. Le premier chapitre dresse un portrait des artistes et compositeurs qui ont travaillé sur le rapport entre le son et le visuel. Quelques stratégies de ces compositeurs ont été utilisées lors du processus visant la création d’une composition musicale capable d’intégrer le visuel en tant qu’élément essentiel. Le deuxième chapitre présente des pièces dans le cadre desquelles je me suis penchée sur le lien entre la musique et la vidéo, la gestuelle ou la danse. Le troisième chapitre aborde une série de quatre pièces composées dans le but d’exprimer, à travers la musique et la mise en scène, des questions liées à notre quotidien. Le dernier chapitre présente finalement des conclusions qui ont émergé à la suite de mon processus de composition et, dans certains cas, à la suite de la performance des pièces. / Is it possible to treat visual material, in particular theatre, physical gestures, video and dance, as an equal element to sound in musical composition? What strategies are available to us to incorporate, in a relevant way, image and sound? What does the interaction between sound and visual material in the creation and the performance of a musical piece imply? Guided by these questions, I composed seven pieces as part of my Masters, between September 2014 and August 2016. This paper describes the main stages of these pieces and their composition process, which aimed to find solutions and strategies for a homologous relationship between the visual and the sound in the process of musical creation. The first chapter draws a portrait of artists and composers who worked on the relationship between sound and visual. Some strategies of these composers were used during the process of creating a musical composition capable of integrating the visual as an essential element. The second chapter presents the pieces which I have investigated the link between music and video, gesture and dance. The third chapter addresses a series of four pieces composed for the purpose of expressing, through the relation between music and staging, issues related to our daily life. Finally, the last chapter presents conclusions that emerged as a result of my writing process and, in some cases as a result of the performance of the parts.
