Znalec - psycholog v trestním řízení / Expert witness - psychologist in criminal trial

anglicky The aim of this diploma is to describe the role of an expert psychologist witness in criminal trial and to define purpose of forensic psychological assessments. It also tries to answer current questions related to the field of psychological expert opinions. The psychological forensic expert witness is appointed in the same way as other legal expert witnesses. That means he has the same rights and obligations as them. The first chapter is therefore devoted to connoisseurship in general. It deals with the historical development of expert witnesses, current applicable legislation and upcoming legislative changes in this area. The second chapter approaches other expert witnesses in court too. It includes number of forensic experts in various fields and compares expert psychologists to psychiatrists, who often provide their opinions alongside psychologists'. The main part of the chapter is left to expert opinions. It clarifies terms such as personality, intellect, memory, motivation and dangerousness of the offender, that are the most commonly evaluated aspects. Conclusion of second chapter summarises the expert opinions in selected EU countries and the USA. The final chapter is devoted to the expert report as evidence in criminal proceedings. Psychoterapie v paliativní péči / Psychotherapy in Palliative Care

The master's thesis deals with the topic of the use of psychotherapy in the field of palliative care provided to adult clients. The theoretical part presents the current conception of care for the dying and defines the field of palliative care, including its availability. Attention is also paid to the characteristics of palliative care recipients, where the behavior and experiencing of terminally ill patients are outlined using models depicting the process of dying. This is followed by the definition of palliative psychotherapy together with a description of its involvement amongst other forms of support for the dying patients. At the end of the theoretical part there are presented structured psychotherapeutic interventions focusing on work with terminally ill clients, including information considering their effectiveness and possible application. The empirical part of the thesis consists of qualitative research of the psychotherapeutic process in working with adult dying clients from the perspective of palliative psychologists and psychotherapists. The diploma thesis titled "Selected aspects of domestic violence described in court files and psychological expert opinions" deals with forensic - psychological issues. The theoretical part defines domestic violence, its forms and types. There is also space for individual aspects of domestic violence, including treatises on victims and perpetrators of domestic violence, related myths and consequences. This chapter also covers the issue of how to help. A separate part deals with the court file, its content and composition. The expert opinion, its assignment and content is then devoted to the conclusion of the theoretical part. The empirical part, focused on the examination of selected aspects of domestic violence, was based on an analysis of court files containing the psychological expert opinion in cases of abuse under §198 and §199 of the Criminal code. The aim of thesis is to evaluate the current practice of assessing the credibility of testimony in criminal proceedings and reflect on its current issues. In particular, it is necessary to resolve the question of the extent to the competence of an expert-psychologist in assessing process and the establishment of basic criteria according to which the experts proceed. I have chosen this topic because it's connecting criminal law and psychology which is important for society and a highly discussed in this time. Assessing the credibility is one of usual requests for expert psychologists from investigative, prosecuting and adjudicating bodies and it is also the most common, but often the most difficult part of psychological expertise. The thesis is composed of four chapters. The first chapter deals with the history of assessing the credibility. The second chapter describes the psychological expertise in criminal proceedings in our country and consists of four parts dealing with experts, expertise and evidence and evaluation of evidence in criminal procedure. The aim of the diploma thesis is to describe the consequences of imprisonment from a psychological point of view and to compare it with the testimonies of convicts. Every convicted person who gets into a prison is exposed to psychological problems associated with imprisonment. These problems can be associated not only with pleading guilty and accepting a sentence connected with a commited crime but also with, a transition from civil life to life in prison, adaptating to life in prison, dealing with restriction of freedom and restrictions of contact with their loved ones and so on. The thesis has a theoretical part divided into three chapters, where data has been added from transcripts of interviews with four sentenced men. The first chapter focuses on the characteristics of serving imprisonment, including the functions and the purpose of imprisonment and on penitentiary psychology. The second chapter describes the adaptation of prisoners to imprisonment in view of the length and frequency of imprisonment as well as the personality of the convicted person. The third chapter focuses on the psychological aspects of imprisonment (the second life of prisoners, aggression, bullying, suicide, self-harm, abuse and use of narcotic and psychotropic substances, limiting social contacts). The aim of the diploma thesis is to describe the consequences of imprisonment from a psychological point of view and to compare it with data from interviews with sentenced persons.

The thesis deals with the profession of school psychologist. We are wondering if there are any reasons that prevent or encourage the introduction of psychologists into schools. The first part of the thesis deals with the concepts of school psychology and school psychologist from the present and historical point of view. We are dedicated to the legislative anchoring of this profession and its ethical standards. We uncover the complex network of the school psychologist, including aspects that can be partaking of teachers' expectations of school psychologists. The second part of the thesis deals with the questionnaire survey which was carried out at the school, where the institution of the school psychologist is already established and where it is not. The data analysis was conducted the analysis. Through her, we found five areas of interest which affect expectations. The first area concerns the role of the school psychologist. The second area concerns of his work. The third is the idea of teachers about the " ideal " school psychologist. Esta pesquisa busca explorar a relaÃÃo entre narrativa e transformaÃÃo na psicoterapia, atravÃs do significado que clientes da ClÃnica Escola de Psicologia da UFC, que jà vivenciaram experiÃncias traumÃticas, atribuem: ao processo psicoterÃpico, Ãs mudanÃas percebidas, ao terapeuta inserido no processo de transformaÃÃo e à importÃncia de se narrar no setting terapÃutico. AlÃm disso, consideraram-se as implicaÃÃes culturais nas histÃrias pessoais, percebendo, assim, a narrativa nÃo sà como uma produÃÃo individual, mas tambÃm histÃrica e relacional. O referencial teÃrico utilizado foi o da Psicologia Narrativa, que postula que a experiÃncia humana se faz inteligÃvel quando transformada em narrativa. No campo da psicoterapia, essas formulaÃÃes vÃo influenciar as terapias pÃs-modernas, tais como a Terapia Narrativa e a Abordagem Colaborativa. Observou-se que esses clientes chegaram à clÃnica com ideias preconceituosas a respeito da prÃtica psicoterÃpica, mas, ao longo do tempo, tornaram-se extremamente comprometidos com a terapia, reconhecendo o papel fundamental que esta desempenhou na mudanÃa de suas atitudes e significados atribuÃdos a suas realidades e a si mesmos. O terapeuta à visto, neste processo, como um facilitador que explora conteÃdos antes nÃo percebidos, mediando o diÃlogo do cliente com ele mesmo. A narrativa aparece na clÃnica como uma construÃÃo de sentido propiciadora de liberdade, levando a processos de ressignificaÃÃo, reautoria e reorganizaÃÃo da experiÃncia. / This research aims to explore the connexion between narrative and transformation in psychotherapy, through the meanings that the clients from the ClÃnica Escola de Psicologia da UFC, who have experienced traumatic experiences, ascribe to: the psychotherapeutic process, the perceived changes, the therapist as a part of this process, and the importance of narrating in the therapeutic setting. Furthermore, it is important to analyze the cultural implications into personal stories. This way, it is possible to perceive the narrative not only as an individual production, but also as a historical and relational process. The theoretical framework used was the Narrative Psychology that points out that human experience becomes intelligible when transformed into narrative. In the field of psychotherapy, this theory contributed to the emergence of the postmodern therapies, which have as important icons the Narrative Therapy and Collaborative Approach. Some of the most important authors used in this research were: Harlene Anderson, Harold Goolishian, Michael White, David Epston, John McLeod, Jerome Bruner, Kenneth Gergen and Marilene Grandesso. Within this broad field of studies, it is assumed that the construction of narratives, by its ability to generate meanings, is therapeutic in itself. This study was conducted through semi-structured interviews with three clients. The interviews were transcribed and subjected to thematic analysis. It was then observed that in the beginning, all clients had some prejudice about the practice of psychotherapy, and over time, they become extremely committed to the therapy, which played a key role in changing attitudes and meanings ascribed to themselves and their realities. The therapist is seen in this process as a facilitator who explores some contents that were not perceived before, mediating the dialogue between the client and himself. The narrative emerges in the psychotherapy as a construction of meaning that leads to a sense of freedom, and prompts processes of resignification, agency and reorganization of experience.

Stress is nothing exeptional and if it occurs, there are certain wals how to eliminate it. I present here some information which can be in my opinion suitable when coping with stressful situations in emergencies and eliminating the negative effects on human psyche. The text is conceived as a general view of this issue. For this reason, I did not incorporate any examples into the text, but I just suggested possible solution procedures. What steps should be taken to maintain the mental preparedness to stressful stimuli associated with solving an emergencys and its individual parts. The answer is not simple, but at least I tried it indicate it.

This graduation thesis is concerned with the role of a psychologist in the work team building. The organisation where I did the qualitative research work was Police of the Czech Republic. I wanted to confirm or rebut the assertion that the role of psychologist in police teams buliding is irreplaceable. I used methods of questioning, interview and observation. Police teams are created to solve some issues (e.g. drug-traffic) or a concrete crime (e.g. a murder). I found out that police teams are built by supervisors. They are choosing team members in accordance with their specialization, skills and experience. The police psychologists have no dealing with the team building. Police psychologists pick new policemen {--} they test their memory, reactions (this test examines functions of celebral cortex) and intelligence. New policemen also have to pass a test of personality. All these tests are necessary, because police work is extremely exacting. Next police psychologist´s task is policemen training. Psychologists teach them the assertivity, how to cope with stress and how to deal with a suicide. Very important part of police psychologists´ job is a consulting service, which can involve policemen, their wives and kids. Police psychologists offer the post-traumatic care as well. This care is established for policemen who used a gun, who are investigating death of a child or some grave murder. Police psychologists are working as investigation´s consultants, especially by investigation of self-murders, rapes, maltreatment with children. They help to ease the situation, to calm down the sufferer, they also help by the questioning and they instruct policemen how to behave to the sufferer.

This diploma thesis is comprised of a theoretical section and a practical section. The first theoretical subchapter introduces the CAN syndrome. The second theoretical subchapter focuses on the relevant international and national child protection legislation. The third subchapter "Child Interrogation" deals with the issue of the historical development of child interrogation techniques and methods, and the currently recommended interrogation techniques used to interrogate children in keeping with the Act on Criminal Judicial Procedure No. 141/1961 in the Czech Republic. The third subchapter also concerns with the character traits of the investigator, the qualification requirements of this profession and the fundamental methodology used to prevent a child's secondary victimisation. The fourth theoretical subchapter focuses on the specially designed interrogation room used, among others, for child interrogation. The theoretical part is based on reference literature and relevant legislation. The practical section includes the results of qualitative research.
