Le règlement n°2015/848 est-il applicable aux procédures d’insolvabilité présentant un lien avec un État tiers comme la Suisse ? D’un côté, la CJUE répond par l’affirmative concernant le principe vis attractiva concursus. D’un autre côté toutefois, le règlement n°2015/848, plus encore que le règlement n°1346/2000, a été conçu par le législateur européen pour les situations intra-européennes. La décision Schmid (CJUE, 16 janvier 2014, C-328/12) est une boîte de Pandore, car très peu de dispositions pourront en réalité être étendues à l’international. Le chapitre IV assure p. ex. l’égalité de traitement aux seuls créanciers étrangers européens.Comment les autorités suisses vont-elles réagir ? Le chapitre 11 de la LDIP suisse a récemment été révisé, afin de simplifier la reconnaissance des décisions étrangères de faillite. La réciprocité n’est plus requise, et un nouveau chef de compétence internationale indirecte a fait son apparition : le COMI du débiteur. De plus, la faillite ancillaire devient optionnelle. Cela étant, la protection des créanciers locaux reste la priorité : le juge suisse luttera toujours contre les discriminations subies par les créanciers locaux, et refusera la reconnaissance des décisions annexes rendues contre un défendeur domicilié en Suisse. L’applicabilité des règles européennes aux situations relatives aux États tiers serait par conséquent incohérente, et risquerait de paralyser l’entraide internationale avec la Suisse. / Is Regulation 2015/2018 applicable to insolvencies linked with third States such as Switzerland ? Moreover, the opening of an ancillary proceeding in Switzerland becomes optional. However, the protection of local interests still comes first : no to discriminations of local creditors, and no to recognition of insolvency-related decisions if the defendant lives in Switzerland. Applying Regulation 2015/848 to insolvencies linked with third States would thus be incoherent, and cooperation with Swiss authorities may come to an end.

Crystallographic analysis of twin variant selection and twin-twin junctions in commercially pure titanium / Analyse cristallographique de la sélection des variants de macles et des fonctions macles-macles dans un titane commercialement pur

Le titane et ses alliages sont très largement étudiés en raison de leur grande utilisation dans l'industrie chimique, les implants médicaux et les industries aérospatiales. Vu le rôle important dans la déformation plastique, le maclage a été largement étudié dans les métaux hexagonaux L'état de contrainte locale peut être modifié par maclage, ce qui influence les modes séquentiels de déformation tels que le glissement, le maclage et le maclage secondaire Ainsi, il existe une demande urgente pour comprendre le mécanisme associé à la déformation induite par maclage, utile pour le développement de modèles prédictifs qui peuvent décrire les événements ultérieurs induits par maclage, ainsi que leurs corrélations avec les microstructures. Dans ce travail, l'analyse cristallographique de la sélection de variantes de macles et des jonctions macle-macle (TTJ= twin-twin junction) est appliquée sur du titane commercialement pur. Un nouveau mécanisme de maclage séquentiel, où les macles {101̅2} sont stimulées par des jonctions macle {112̅1}-macle, est observée par EBSD quasi in situ. Un autre mécanisme de maclage séquentiel a été trouvé lorsque le maclage de compression {112̅2} contient une macle d'extension {101̅2} près des joints de grain à forte désorientation. L'accommodation est utilisée pour déterminer le variant de macle séquentiel lorsque le facteur de Schmid classique (SF) n'est pas suffisant. En outre, une analyse détaillée des 425 macles secondaires {101̅2} détectées dans les macles {11 2̅ 2} primaires révèle que les deux variants de macles qui présentent une désorientation spécifique par rapport aux grains parents sont les plus fréquentes. Il est possible de justifier la prévalence des macles secondaires avec un mécanisme de nucléation aidée par les dislocations prismatiques. Lorsqu'il est complété par une analyse SF généralisée, le critère peut prédire avec précision la sélection entre deux variants dans le groupe des macles secondaires les plus fréquentes. Lorsque plusieurs variants de macles sont actifs dans le même grain, des interactions macle-macle peuvent se produire. Les jonctions macle {112̅2}-macle peuvent être divisés en trois types selon la cristallographie des macles {112̅2}. Une analyse statistique de ces interfaces révèle qu'un seul type est le plus fréquent tandis que les autres types sont rarement activés. La fréquence des TTJ peut être évaluée en utilisant une analyse SF généralisée. Il en ressort que les interfaces macle-macle (TTB= twin-twin boundary) ne se forment que d’un côté de la macle. Concernant la formation de TTBs basée sur les interactions des dislocations de macle, les dislocations d'interface dans les TTBs observées ont une énergie de ligne inférieure à celles des TTB non observées. Une opération similaire est appliquée à l'analyse de {112̅1} TTJs / Titanium and its alloys have been extensively investigated due to their wide application in chemical industry, medical implants and aerospace industries. As a significant role in plastic deformation, twinning has been widely studied in hexagonal metals. The local stress state may be modified by twinning, which influences sequential plastic deformation modes such as slips, twinning and secondary twinning. Thus, there is also an urgent demand for understanding the mechanism associated with the twinning-induced deformation, which is useful for the development of predictive capabilities that can describe twinning and twinning-induced sequential events, and their correlations with microstructures. In this work, crystallographic analysis of twin variant selection and twin-twin junctions is applied in commercially pure titanium. A new sequential twinning mechanism that {101̅2} twins are stimulated by the {112̅1} twin-twin junctions (TTJs) is observed by quasi in-situ EBSD. Another sequential twinning mechanism that a {112̅2} compression twin adjoins a {10 1̅ 2} extension twin is found at high angle grain boundaries. Displacement gradient accommodation is used to determine the sequential twin variant while the classical Schmid factor (SF) is not sufficient. Besides, a detailed analysis of the detected 425 {101̅2} double twins inside primary {112̅2} twins reveals that the double twin variants that exhibit specific misorientation with respect to the parent grains are the most frequent. The prevalence of double twins is possible to justify with the prismatic-dislocation mediated nucleation mechanism. When complemented with an apparent SF analysis, the criterion can accurately predict the selection between two variants within the group of the popular double twins. When multiple twin variants are active in the same grain, twin-twin interactions may happen. {112̅2} TTJs can be divided into three types according to the crystallography of {112̅2} twins. A statistical analysis of {112̅2} TTJs reveals that one type is the most popular while other types are rarely activated. The frequency of TTJs can be evaluated by using an apparent SF analysis. The interesting finding is that twin-twin boundaries (TTBs) form in one side of the incoming twin as a TTJ forms. Corresponding to the formation of TTBs based on the interactions of twinning dislocations, interface dislocations in the observed TTBs have lower line energy than those in the un-observed TTBs. CoordenaÃÃo de AperfeiÃoamento de Pessoal de NÃvel Superior / A Abordagem Centrada na Pessoa (ACP), fundada por Carl Rogers, sà pode ser justificada a partir de um conjunto de valores e de uma Ãtica e nÃo somente como uma aplicaÃÃo de tÃcnicas e conhecimentos. AlÃm disto, a partir dos estudos de Figueiredo (1996) fica estabelecida a importÃncia do Ãthos como busca de um lugar para o Outro na constituiÃÃo das psicologias. Naquilo que se refere ao Lugar do Outro na constituiÃÃo da subjetividade, Freire (2002) investiga o lugar para a alteridade nas diversas psicologias modernas e afirma que, na ACP, o lugar para a alteridade radical levinasiana està vacante, assim como nas demais psicologias. O Outro, conforme postulado por LÃvinas (2008 [1961]), à precedente e transcendente ao Eu; nÃo sendo possÃvel totalizÃ-lo e compreendÃ-lo inteiramente, ele apresenta a dimensÃo do estranho na experiÃncia psicolÃgica. Este Outro nÃo à figura tÃo cara para as psicologias como aparenta ser. Por outro lado, Peter Schmid (1999) concebe que a Ãtica à a primeira questÃo a ser pensada quando se trata da ACP, quer de sua teoria, quer de sua prÃtica. Daà que este trabalho objetivou apresentar a obra de Peter Schmid à comunidade brasileira da abordagem rogeriana. A perspectiva deste autor està alicerÃada em um diÃlogo importante com as filosofias do diÃlogo e uma visÃo do humano como radicalmente pessoa, o que oferece outra forma de encarar a alteridade na teoria e prÃtica rogerianas. Tal mudanÃa apresenta uma profÃcua aproximaÃÃo com a filosofia Ãtica de Emmanuel LÃvinas. Como metodologia para o estudo, utilizou-se um quase-mÃtodo inspirado nas filosofias de LÃvinas (2008 [1961]) e Derrida (2008), em que buscamos, entre outras coisas, pÃr à mostra a polissemia dos discursos estudados. Concluiu-se que, apesar da perspectiva formulada por Schmid apresentar divergÃncias com a Ãtica levinasiana, ao fazer releituras dos principais conceitos da ACP, ela apresenta uma maior aproximaÃÃo com aquela e uma nova forma de lidar com a alteridade dentro do arcabouÃo da abordagem rogeriana. Espera-se, com este trabalho, fomentar um maior diÃlogo e produÃÃo acerca do cuidado clÃnico e psicoterapÃutico com a pessoa e o lugar oferecido para a alteridade na psicologia rogeriana. / The Person Centred Approach (PCA), founded by Carl Rogers, can only be justified from a set of values and ethics and not only as an application of skills and knowledge. Furthermore, from studies of Figueiredo (1996), it is established the importance of ethos as a search for a place to the Other in the constitution of psychologies. In what refers to the place of the Other in the constitution of subjectivity, Freire (2002) investigates the place to alterity in several modern psychologies and states that in PCA, the place for Levinasâ radical alterity is vacant, as in other psychologies. The Other, as postulated by Levinas (2008 [1961]), is precedent and transcendent to the I; not being possible to totalize and understand it fully; it shows the dimension of the strange in the psychological experience. This Other is not so dear figure to psychologies as it appears to be. On the other hand, Peter Schmid (1999) conceives that ethics is the first issue to be considered when it comes to PCA, either its theory or its practice. Hence, the present paper aims to present the work of Peter Schmid to the Brazilian community of Rogerian approach. The perspective of this author is grounded in an important dialogue with the philosophies of dialogue and a vision of the human as radically a person, which offers another way to face the alterity in Rogerian theory and practice. Such change presents a fruitful approach to ethical philosophy of Emmanuel Levinas. A methodology for the study, we used an almost-in-method inspired by the philosophies of Levinas (2008 [1961]) and Derrida (2007), in which we seek, among other things, to put on display the polysemy of the studied speeches. We conclude that, despite the divergences among the prospect formulated by Schmid with Levinasian ethics, doing readings of the main concepts of the PCA, it shows a closer relationship with that one and a new way of dealing with the alterity within the framework of the Rogerian approach. With this work, we hope to foment a greater dialogue and production on the clinical and psychotherapeutic care of the person and the place offered to otherness in Rogerian psychology.

Localization of a particle due to dissipation in 1 and 2 dimensional lattices

We study two aspects of the problem of a particle moving on a lattice while subject to dissipation, often called the "Schmid model." First, a correspondence between the Schmid model and boundary sine-Gordon field theory is explored, and a new method is applied to the calculation of the partition function for the theory. Second, a traditional condensed matter formulation of the problem in one spatial dimension is extended to the case of an arbitrary two-dimensional Bravais lattice. A well-known mathematical analogy between one-dimensional dissipative quantum mechanics and string theory provides an equivalence between the Schmid model at the critical point and boundary sine-Gordon theory, which describes a free bosonic field subject to periodic interaction on the boundaries. Using the tools of conformal field theory, the partition function is calculated as a function of the temperature and the renormalized coupling constants of the boundary interaction. The method pursues an established technique of introducing an auxiliary free boson, fermionizing the system, and constructing the boundary state in fermion variables. However, a different way of obtaining the fermionic boundary conditions from the bosonic theory leads to an alternative renormalization for the coupling constants that occurs at a more natural level than in the established approach. Recent renormalization group analyses of the extension of the Schmid model to a two-dimensional periodic potential have yielded interesting new structure in the phase diagram for the mobility. We extend a classic one-dimensional, finite temperature calculation to the case of an arbitrary two-dimensional Bravais lattice. The duality between weak-potential and tightbinding lattice limits is reproduced in the two-dimensional case, and a perturbation expansion in the potential strength used to verify the change in the critical dependence of the mobility on the strength of the dissipation. With a triangular lattice the possibility of third order contributions arises, and we obtain some preliminary expressions for their contributions to the mobility.
