The topic of this thesis is "Property consequences of the divorce of marriage". I have chosen this topic because of the high number of divorces that are filed for. This thesis characterises the two main property consequences of divorce, the settlement of community property of spouses and the settlement of common household of spouses. The purpose of the thesis is to compare the current legislation, contained in the Civil code from 1964 with the proposal of the new Civil code, analyse the advantages and disadvantages of both acts and express my opinion on it. The thesis is composed of eight chapters. Chapter One is introductory and defines the purpose of this thesis. Chapter Two defines the term "divorce", its three types and consequences of divorce. Chapter Three illustrates the conception of property relationships between spouses in the past. Chapter Four defines the term "community property of spouses", its consent, extent and modification. The most important and key chapters are Chapter Five and Chapter Six. Chapter Five is subdivided into seven parts and it deals with the settlement of the community property of spouses. This thesis deals with the inheritance procedure with a focus on the settlement of the common property of the spouses. The first chapter of the thesis is an introduction. The second chapter is called The inheritance procedure and deals in general with the course of the inheritance procedure. This chapter introduces the legislation that forms the basis for the inheritance procedure and the settlement of common property of the spouses. The work briefly describes the purpose of the inheritance procedure. An attention is also paid to jurisdiction, participation and tutelage. In the subchapter proceeding of inheritance, the thesis deals with ways to clarify the estate of the testator and to determine the inheritance rights. It is also about drafting a preliminary investigation report and ceasing the proceedings. At the end of the second chapter there is included a part dealing with cases of additional inheritance procedure proceedings. The topic of this Master thesis is Matrimonial property law, that is encoded within the Act no. 89/2012 Sb., Civil Code. The aim of this thesis is to analyze and describe current matrimonial property law regime, mainly the community property regime. The focus is on defining the legal framework of the community property regime and its modification options, such as community property contract or court decision. It also provides a look at the possibilities of protection and defense of the so called debt- free spouse. The text of the thesis is divided into seven chapters, introduction and conclusion. The first chapter provides a definition of some basic terms, such as the matrimonial property law and community property regime. The second chapter focuses on the legal provisions of the community property regime, meaning the general regime. It describes the scope of the community property regime, the assets and liabilities within and out of the scope of the community property. This thesis is primarily based on analysis of practice of the courts and papers, which afford the deeper insight into the relatively short legislation. Certainly could be adopted more particular legislation of the settlement of community property of spouses, decisions on such matters but may not look like as a "juristic machine", which is limited by the particular provisions of law. A key role is played by the legal conclusion of an experienced lawyer who, after analysis of the situation, adjudge in the spirit of the flexible provisions of the law. During the work on this thesis, I therefore had to deal with the different views on the problem and with the obsolete ideas. The work responds to a relatively large number of interpretative differences with the declaration of my own opinion on the problem supported by the relevant arguments. Today we face a very anxious fact that the number of marriages since 1989 is sharply decreasing. This issue is further analyzed in the first chapter where I pointed to some stimuli, which could weaken this trend. It could be very beneficial to realize a sociological research on the factors that cause this adverse trend. Summary/ Resumé Title of the diploma thesis: Issues and Particularities of Maintenance Obligations within the Czech and Italian Legal Systems My diploma thesis deals with maintenance obligations as the title itself says. Maintenance obligations is a very wide topic in family law so I have focused the thesis on the more specialized areas. Before describing the structure of the thesis I would like to try to explain the motive for choosing this topic. I have studied in Italy in the scope of the international programme for students, and have also gained work experience there. I wanted to try to improve not only my knowledge of Italian language itself but also my theoretical knowledge of foreign law. A comparative thesis seemed to fulfil these demands of mine. Maintenance obligations is a current topic of interest. We all are the subjects of this obligation and other duties connected to it for our entire lives even if such obligation is imposed on us against our will. A couple of weeks before the end of the last year there was a media case, the Italian ex prime minister was sentenced to pay an astronomical amount of maintenance to his ex wife. Informal caregivers' conceptions of daily life with a spouse having chronic obstructive pulmonary disease

The overall aim of this thesis was to explore informal caregivers’ daily life with particular focus on those living with a spouse who has Chronic Obstructive Pulmonary Disease (COPD) in different grades, mild to severe, based on the ill person’s main concern. The study design was explorative, comparative and descriptive. The thesis included a literature review of 45 scientific articles and semi-structured interviews with 23 patients suffering from COPD, and 21 women and 19 men living with a spouse suffering from COPD. Data were analysed using content analysis, grounded theory, and phenomenography. Main findings: Men and women living with a spouse suffering from mild COPD did not experience changes in their daily life, and were not in need of support. It was when the COPD gradually escalated that their daily life was affected and they needed support. The caregiving women conceived that their daily life was socially restricted, they had changed roles, changes in health and changes in the couple’s relationship. The caregiving men’s daily life was conceived as burdened, restricted and the partner relationship was affected. The men’s attitude was to continue with their own life and own activities, and their approach to their caregiving situation was to view themselves as “Me and my spouse”. The main concern for people suffering from COPD was feelings of guilt due to self-inflicted disease associated with smoking habits. The thesis shows that there are differences in informal caregiving between males and females. Conclusion: This thesis shows that there are differences in male and female caregiving for a spouse suffering from COPD. The caregivers conceive and handle the caregiving situation in different ways. It is central that health professionals and municipality consider this along with the individual needs that are related to the development of the COPD. There is a need to identify the person who suffers from COPD and their spouses from the first contact onwards, to regularly follow the development of their situation and need of support.

This diploma thesis deals with a comparison of two civil codes. Statute number 40/1964 Sb. and statute number 89/2012 Sb. The law science speaks generally in connection with passing of statute number 89/2012 Sb. about recodification of private law. The term of recodification does not mean only adjustment of legal text in more elegant and especially more systematic way, but also removing of some problems in the legal order. The civil code from 1964 was created in another social circumstances and therefore the legal public hoped with passing of statute number 89/2012 Sb. for removing of some defects in civil law. These defects were caused by the selected method, the law should have adapted through this method to new social circumstances. This diploma thesis compares family law (as institute) according to legal order, which was in force before and after the day of 1. January 2014. The conception of family law before this date, so according to the civil code from 1964, arose at the time of intellectual peak of socialism and the task of this thesis is to find, where the family law was moved by the new civil code. Factors affecting the nutritional status of pregnant women

This paper attempted to determine the effect that gastrointestinal discomforts, socioeconomic status, dietary knowledge and beliefs about foods to omit during pregnancy had on the nutritional status of pregnant women. Hemoglobin, upper arm muscle circumference, weight for height and eating patterns measured nutritional status. Twenty women in their second trimester of pregnancy, active duty or the dependent wife of an Air Force E-4 and below, were surveyed. Questionnaires and anthropometric measures were used. Pearson Product Moment Correlations and a canonical correlation were accomplished. Data analysis indicated a significant negative correlation between eating patterns and gastrointestinal discomfort. There was a significant positive correlation between beliefs about foods to omit and eating patterns. Significant negative correlations existed between dietary knowledge and military status, monthly grocery bill, and number of people fed.
