Previous issue date: 2013-08-30 / CAPES / REUNI/UFPE / O conteúdo televisivo constitui um importante referencial para o homem na produção de sentido e construção social da realidade. Da análise do ambiente regulatório brasileiro sobre o tema, percebe-se que a legislação fornece somente a saída judicial para a defesa de conteúdos que abusem da liberdade de expressão contra outros direitos fundamentais ou que contrariem as normas de classificação indicativa. Esta dissertação analisa o controle judicial do conteúdo televisivo, traçando um diagnóstico das Ações Civis Públicas impetradas pelo Ministério Público Federal contra conteúdos televisivos veiculados pelas cinco maiores emissoras comerciais brasileiras de canais abertos. Objetivou-se conhecer em que termos estão sendo propostas e julgadas estas ações em defesa da coletividade. Através de pesquisa empírica e de conteúdo, utilizou-se uma abordagem qualitativa para se analisar os seguintes dados: polos passivos e ativos das ações; programas contestados; tempo dos processos; doutrina, legislação e jurisprudência citadas nas ações; pedidos formulados e sentenças proferidas. A partir dos dados coletados, sobretudo do tempo do processo e das decisões prolatadas, concluiu-se que a via jurisdicional não constitui a melhor forma de resolução desses litígios. A morosidade processual se contrapõe à lógica imediatista da veiculação de conteúdo televisivo resultando na ineficácia do direito pretendido. Ainda, o grau abstrato e não enquadrável das formulações legais que regulam o conteúdo televisivo como, por exemplo, “valores éticos e sociais da pessoa e da família”, “moral pública” e “bons costumes”, requer uma resposta mais plural e democrática baseada em diversas mundividências, o que diverge do julgamento tradicional baseado nos fatos oferecido pela justiça. / The television content is an important model for the man in the production of meaning and social construction of reality. In analysis of the Brazilian regulatory environment on the subject, we find that the law provides only legal outlet for the defense contents that abuse the freedom of expression against other fundamental rights or contrary to the classification standards indicative. This dissertation examines the judicial control of the TV content, making a diagnosis of Public Civil Actions filed by federal prosecutors against television content served by five major commercial stations Brazilian open channels. The objective was to know on what terms are being filed and adjudicated these actions in defense of the community. Through empirical research and content, we used a qualitative approach to analyze the following data: pole passive and active actions; programs disputed; process time; doctrine, legislation and case law cited in the actions; orders and judgments required. From the data collected, mainly from the time of the process and the decisions, we conclude that the judicial process is not the best way to resolve such disputes. The processing delays opposes the logic of immediate placement of television content resulting in ineffective law intended. Still, the degree of abstract and not classifiable legal formulations that regulate television content such as, "ethical and social values of the person and the family", "public morals" and "morality", requires a more plural and democratic based on different worldviews that diverge from the traditional judgment based on the facts offered by justice.

The diploma thesis on the topic Changes in the programming scheme of the ČT 2 channel after the amendment to the Czech Television Act of 2011 examines whether this television channel was commercialized after the law changed the rules for placing advertisements and advertising messages on public service television channels. The ČT 2 channel was conceived as an alternative channel intended for a more demanding audience. From the logic of its focus, such a channel does not aim at high viewership. Nevertheless, the amendment to the law designated it for the sale of advertising time as the only full-format channel of Czech Television. The search provided a wealth of information regarding television broadcasting by law and the effects it has on public service television. Czech Television was included in the media system as a public service television. The work deals with the technique and principles of creating a television program and its individual components, which undoubtedly have an impact on the resulting media product, which is the program scheme of the channel. Professional publications of Czech and world media experts enabled the author to create his own definition of terms, the description of which clearly does not agree with the professional public. Sports television programming : content selection, strategies and decision making : a comparative study of the UK and Greek marketsTsoumita, Sotiria January 2013 (has links)
This thesis looks at the subject of sports television programming in two European markets, the UK, one of the biggest and most developed in the continent, and the Greek, one of the smallest in Europe. With the help of case studies over a period of eight years and qualitative interviews of television executives and professionals who are involved in sports television rights agreements, it analyses and compares the strategies and decision making of television organisations, the factors that affect their decisions and their success within the chosen markets. A distinction will be made between public service, commercial and pay-TV and the reasons why different sports may suit different channels and at different points in their development. The findings should help to appreciate that there is not one strategy that works universally better than another. Its outcome depends on the value of the content, the particular characteristics of the organisation and the external environment where it operates. Most importantly, the thesis highlights the importance and limitations of the TV sports content, its crucial role in the decision making process and the necessity of more academic research into the area of sports television by people in content-driven disciplines, i.e. journalism and the media.
