Los requisitos comunes de los crímenes de guerra en el derecho chileno

Tesis (magíster en derecho con mención en derecho penal III) / El objetivo buscando mediante la dictación de la ley N° 20.357 era evitar que la Corte Penal Internacional pudiese ejercer su jurisdicción sobre conductas constitutivas de crímenes de guerra acecidos en el territorio nacional. Para ello, todo lo punible bajo el Estatuto de Roma debía también ser penado en la norma nacional. El presente trabajo busca analizar, desde la perspectiva de los requisitos comunes de los crímenes de guerra, si el objetivo buscando se obtuvo, o si por el contrario, se dejaron espacios a nivel normativo que permitirían la intervención de la Corte. En ese contexto, la presente investigación buscará determinar e interpretar los requisitos comunes de los crímenes de guerra en la ley N° 20.357, comparándolos con aquellos contenidos en el Estatuto de Roma, para luego analizar quien, de acuerdo con los resultados obtenidos, poseería jurisdicción sobre un hecho constitutivo de delito o crimen de guerra acaecido en territorio nacional, o en el extranjero cometido por un connacional.

The thesis deals with pregnancy and childbirth among Roma women in the context of transcultural care. In the theoretical part, three main topics relevant to the subject of the thesis are addressed: (i) transcultural care and its development both abroad and in the Czech Republic, (ii) the Roma way of life with a special focus on those aspects affecting the way of perceiving and experiencing the pregnancy and childbirth by Roma women, and (iii) recent trends in providing care to pregnant and labouring women. The empirical part includes a qualitative research into how Roma women perceive and experience pregnancy and childbirth, and what characteristics from the perspective of midwives make them different from the majority society women. Using qualitative research based on interviews with Roma women and midwives I gained valuable data upon which I have identified cultural differences which may affect Roma women's access to prenatal care, the manner of pregnancy planning, and the perception of pregnancy or parturition itself. Based on these findings, I have analysed the applicability of the transcultural care model to Roma women. Transgenerační transmise romských hudebních znalostí a dovedností v Klenovci a Kokavě / Transgenerational transmission of romani musical knowledge and skills in Klenovec and Kokava

This thesis analyses transgenerational transmission of musical knowledge and skills, (i.e. methods of musical teaching and learning) in the community of Romani musicians in Klenovec and Kokava in Central Slovakia. The thesis questions widespread myth about innate musicality of Roma and suggests an alternative explanation for postulated musical excellence of Roma through differences in their musical education. In the first part of the thesis, the question of musical-talent heritability both in social and natural science is being discussed. It concludes that despite of long discussions and recent hints in the field of genetic, we cannot consider an inborn genetic component for Romani musicality. In the second part, theoretical differences in music-educational systems are discussed (Merriam, Van den Bos, Turino) and the majority's institutionalised system of musical education of the Czech Republic and Slovakia is presented. The third part is a comparison of the institutionalised system with traditional methods of musical learning and teaching inside musicians' community in Klenovec and Kokava. This thesis Position of Roma minority in the First Czechoslovak Republic focuses on position of ethnic and national minorities in the First Czechoslovak Republic between 1918 and 1938, specifically on position of Roma minority. Many scholars have already focused on the topic of position of minorities in the First Czechoslovak Republic, but only few focused their work on position of Roma minority. This topic still remains quite unexpolred. In the first part of my thesis, I will focus my research on disprooving claim, that we can consider Czechoslovakia as consociational democracy, by apllication of four basic consociational mechanisms on the political system of the First Czechoslovak Republic. In the second part of my research I will focus on position of Roma minority in Czechoslovak society by analyzing origins of Roma minority, laws focused on Roma minority and position of political parties and majority society towards Roma minority.

The diploma thesis: "Purity and Danger: The Perspective of Compliance with Ritual Purity in the Contemporary Roma House" deals with the boundary definitions of Roma groups and identities. This examination takes place via the narration of the Roma themselves and by observing the ritual practices in Roma households. The main tool that the Roma use in determining their group boundaries is the concept of cleanliness and impurity. It appears both in their narratives and in their ritual practice. This thesis describes the definition of a specific group of Roma women against many other groups of Roma and against the majority society. By doing so, we can examine their values, and the importance of the concept of purity in their lives and at the same time where their concept of purity comes from and how they work with it every day. Furthermore, it describes the environment, habits and clothes worn by women and their children, their hobbies and the way of their everyday life. Another important topic emerging at work is what roles men and women have in their group, and how the duties, or the spaces associated with their daily lives, are shared between the sexes. Roma professionals in the Czech Republic: Career trajectories and experiences

This thesis explores career trajectories and experiences of Czech Roma professionals in order to understand the relation between their ethnic affiliation and career development in terms of obstacles, strategies and relationships that enabled them to succeed in becoming professionals. The study produces knowledge that fills the empirical research gap about Roma professionals in the Czech Republic. Thematic analysis was used to analyze seven semi-structured interviews. The analysis concludes that the Roma professionals face obstacles that include the lack of cultural capital in families, gender-related obstacles, ‘Roma bubble’ and finally the racial prejudices and workplace incivility. However, the projects supporting Roma and a range of supportive relationships have the exceptionally important role in overcoming those obstacles. The study also contributes to the theoretical discussion about the link between social mobility of minorities and their identification. It shows that the processes of selective and consonant assimilation take place at the same time.

Registration as a biopolitical tool : An exploratory case study of stateless Roma

Taking up the persistent phenomena of statelessness across the world, this thesis explores the nexus between stateless Roma and registration practices. The current issue of lack of registration perpetuates statelessness, however, is largely under researched. This fact warrants a thorough examination of registration historically, studying the processes onto which the practice depends today. Using theoretical concepts such as nation-birth link, biopolitics, and inclusive-exclusion this thesis argues when studying the case of stateless Roma, an oscillating pattern of registration is revealed between nonregistration and registration. This is understood as exclusionary and racialised techniques to control, surveil, and regulate the behaviour and movement of the ‘outsider’ – registration is a biopolitical tool of drawing these lines. The study uses an exploratory research design coupled with a genealogy-inspired method which allows us to critically examine and uncover the processes onto which the stateless phenomena depend.

PhDr. Miloš Kučera, Ph.D. ABSTRACT: The dissertation thesis presents the results of ethnographic research conducted between 2005 and 2012. The theoretical part provides an analysis of the cognitive process and looks for causes of prejudiced thinking. The practical part presents a number of topical articles with the intention to present the issues relating to the education of Roma in the Czech Republic from different perspectives. The first article deals with the Czech legislation and with the position of the Czech government. The rest of the practical part is divided into two sections - the first section presents two sets of outputs from researches conducted in an urban Roma community.
