Ústavní zvyklosti v České republice / Constitutional conventions in the Czech Republic

This diploma thesis focuses on constitutional conventions in the Czech Republic. Its aim is to analyze their role in the Czech constitutional system. The work focuses on five areas where the influence of constitutional customs is often spoken. Priority is given to exploring the places where several constitutional institutions are interwoven because it is precisely on them that the power of constitutional conventions is best documented. It focuses in particular on how the practices have been observed in the past and how other constitutional actors have responded. The thesis examines the influence of introducing the direct election of the president to constitutional conventions. A directly elected president may feel more legitimate, and in order to gain a stronger position for himself, he may tend to violate some constitutional conventions or try to introduce new ones. As a result, the finding that the Czech constitution is still a relatively new document and that there was not enough time to fully establish most of the constitutional conventions. However, some constitutional conventions are already becoming an integral part of the constitutional order, whose strength will be decided by the following years. This study looks at the evolution of the management of the biofuel energy in the transport sector in the European Union. This sector represents a big challenge for environmentally friendly and sustainable production and consumption of energy. In the past ten years biofuels have emerged as a burgeoning solution but have also received criticism from some quarters. The study analysis the European Commission's functions in the management of the biofuel market in Czech Republic through a single case study. The research is based on the Principal-Agent theory elaborated by the broader theory of rational-choice institutionalism. It argues that Czech Republic biofuel market may be driven by the European Commission if functions that enhance credible commitment, higher efficiency and information were delegated to it by the member states. Through the congruence method the study compares the expectations of the Principal- Agent theory with the real case situation. Under the European legislation, between the Directive 2009/28/EC and the Directive (EU) 2018/2001, the study finds that the European Commission has some significant function in the management of the sustainability of biofuels in the Czech Republic but has very limited power to directly influence the evolution of Czech biofuel production. The aim of this study is to analyze legitimacy of policy. Its fulfillment should emerge from detailed inquiry of the essential sense of social institutions. The work is divided into three chapters therefore. The first chapter deals with law as a basic system of order of social relations. It explains its fundamental social goal (reducing transaction costs of social action) and its influence on the development of civilization. It discusses in detail the property rights as a fundament of any real legal system - both at the legal level and economic level (i.e. how the system of property rights coordinates social activities and allocates scarce resources, how it creates the elite, and when there is a fault efficiency of this process). The second chapter deals with the social obligations which are necessary condition for preservation of law. These obligations are labeled as taxes (as opposed to tributes that basis is not in the obligation to maintain the legal system and are only ransom inherently). Particular attention is paid to the fair distribution of these obligations (tax justice) and also to the impact of taxation on the development of civilization. In addition to the anticipated research direct election, as an factor of strengthening the president's legitimacy among others, the work will include analysis of the effects of Miloš Zeman first year in office and its relation to other constitutional institutions. This diploma thesis analyses the debates of the two candidates who passed to the second round of the Czech direct presidential election in 2013. Primarily focuses on the debates in the public service media - Czech Television and Czech Radio. To put into context the whole campaign will briefly examine the debates on commercial TV stations as well. The thesis applies content analysis as the methodology. It measures how often both candidates (Miloš Zeman and Karel Schwarzenberg) mentioned their officially declared programme theses in a total of six debates on television and radio. The campaign is also presented more broadly in order to put the analysis into a wider context. Only programmes officially designated will be considered for the analysis so as to secure its accuracy. A quantitative analysis of the content will be applied in order to measure the frequency of programme theses in the debates researched. The principal goal of the thesis is to confirm or disconfirm the hypothesis that programme theses do not play such an important role in a political campaign in general, nor in candidate debates. I focus on the aspect of how different debates were and in which type of media presidential candidates presented the higher number of their programme theses.

People in contemporary world should be able to respond quickly to constant changes, evaluate new situations and be able to make the right decisions. The widespread myth is that success means to raise money as quickly as possible to guarantee the freedom and happiness. But a real success is a contented life, which is a long way over such values as for example certainty that we are doing the work that we like and which fills us with satisfaction. Election and removal of members of the governing and supervisory boards of a joint stock company from a com- parative perspective The diploma thesis deals with the ways of the appointment and removal of the members of the governing and supervisory boards of a joint stock company in the Czech Republic and in Great Britain. It focuses on three main areas: the appointment, removal and the eligibility of members of the governing and supervisory boards of a joint stock company. The aim of the thesis is not only to describe the Czech and British legal provisions on these topics, but also to compare and evaluate them. Within the scope apart from other things it attempts to answer these questions: whether the new Czech Companies Act which will come into force on the 1st January 2014 has been influenced to some extent by the British Companies Act 2006 or whether British pattern did not offer any inducement to any change. The thesis consists of seven chapters. The first three chapters analyse legislation of the Czech Republic. The thesis being hereby presented is concerned with the problematics of family strategies´ aplications in peasants´ families in the village of Vítkov, dated 1700-1850. The work itself is based upon analysis of evidence- and insurance resources, that means mostly registry and cadastral books, urbars and census of subjects. Methodologically, this work proceeds from historical demography and its connection with micro-history and genealogy. Transfers of peasants´s grounds and application of their rights of hertitage become the main subject of research. Secondly, this thesis focuses on peasants life partners choices, families´ maritial strategies and migration. In addition, there are ways of employment drafted for those rural families´ members who had no claim to taking over a paternal ground, thusly achieving to give evidence of how different the family strategies in two contiguous parts of South Bohemia would once have been. The substantial asset of this thesis supposed is to confirm the benefits of joining both historical demography and genealogy whist studying Czech rural areas including possible use of specialised genealogical software.
