Previous issue date: 2009 / The Social Assistance Unified System (SUAS) and the promotion of productive inclusion in Brazil are developed within a society where basic needs and work with dignity are more and more scarce. In a context of productive restructuring, the challenges produced by the relationship between these policies are countless and deserve special attention. This study analyses the historical process involved in the construction of legal and theoretical apparatus and takes it as the basis for debate. The development and improvement of such public policies as well as their inherent contradictions are unquestionable. Clarifying and discussing these issues is what the documental analysis seeks to do. Seven basilary documents are considered in this purpose: the Brazilian Federal Constitution (1988), the Organic Law of Social Assistance – LOAS (1993), the National Policy of Social Assistance (2004), the Basic Operational Rule of the Social Assistance Unified System (2005) and the Guides for Work and Income Generation (2007, 2008, 2009). The study of such documents made it possible to summarize them, as well as discuss its debilities and potentials. In conclusion, we understand that this legal and bureaucratic apparatus is capable of describing, questioning as well as modifying the reality it regulates and is legitimated by. Therefore, clarifying such potentials may contribute to the refinement of the ways that leads us to the desired achievements. / O Sistema Único de Assistência Social (SUAS) e a Inclusão Produtiva estruturam-se em uma sociedade em que as necessidades básicas e o trabalho digno tornam-se cada vez mais escassos. Em um contexto de reestruturação produtiva, os desafios provenientes dessa relação são inúmeros e merecedores de especial atenção. Neste estudo, avalia-se o processo histórico sobre o qual repousa a construção de aporte legal e teórico tomando-o como base para as presentes reflexões. O avanço e o desenvolvimento de tais políticas públicas, bem como o acirramento de contradições a elas inerentes são inquestionáveis, pela análise documental busca-se desvendá-las. Com a intenção de substanciar o debate, analisam-se sete documentos basilares para tal discussão: a Constituição Federal (1988), a Lei Orgânica de Assistência Social (1993), a Política Nacional de Assistência Social (2004), a Norma Operacional Básica do Sistema Único de Assistência Social (2005) e os Guias de Geração de Trabalho e Renda (2007, 2008, 2009). O estudo dos documentos possibilitou a produção de suas sínteses, assim como um diálogo com suas debilidades e seus potenciais. Conclui-se que o aparato jurídicoburocrático, relacionado à realidade que ele normatiza e que o legitima, é capaz de descrevêla, questioná-la e modificá-la. Estima-se que a explicitação de tais potencialidades contribua para o aprimoramento dos caminhos que levam às conquistas almejadas.
