Previous issue date: 2010-07-28 / This dissertation aims to present an overview of the legal theory adopted by the enterprise in Brazilian Enterprise Law, and thereafter, further studies specifically the agrarian enterprise, mainly to assess what were the legal innovations that appeared with the validity of the Civil Code of 2002, as well as the corresponding consequences for the Brazilian Agrarian Law that currently has in undertaking its primary agrarian institute. / A presente dissertação visa apresentar um panorama geral sobre a teoria jurídica da empresa conforme adotada pelo Direito de Empresa brasileiro e, a partir daí, aprofundar os estudos especificamente da empresa agrária, principalmente para aferir quais foram as inovações jurídicas que surgiram com a vigência do Código Civil de 2002, bem como os correspondentes reflexos para o Direito Agrário brasileiro que, atualmente, tem na referida empresa agrária o seu principal instituto
