Dissertacao_ComplianceCorteInteramericana.pdf: 1617485 bytes, checksum: b35e7ca9b6b9e0cf371cd5c11c286f40 (MD5) / CAPES - Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / O objetivo deste trabalho consiste em analisar o cumprimento das sentenças da Corte Interamericana de Direitos Humanos envolvendo casos de violação ao direito ao território de Povos Indígenas, com sentenças proferidas entre 2001 a 2005. O estudo dos casos Mayagna (Sumo) Awas Tingni Vs. Nicarágua e Yakye Axa Vs. Paraguai examina a construção jurisprudencial da propriedade comunal, o instituto da compliance/cumprimento no Sistema Interamericano de Direitos Humanos e a fase de supervisão de cumprimento das sentenças realizada pela Corte Interamericana de Direitos Humanos. Procura-se verificar se e como os mecanismos desse sistema interferem no nível de cumprimento dos casos. O teste empírico, como metodologia, relaciona uma análise quantitativa e qualitativa do cumprimento das ordens de reparação das sentenças. Os achados permitem considerar o desenvolvimento do mecanismo de supervisão do Sistema Interamericano e reavaliar sua atuação na afirmação dos Direitos Humanos dos Povos Indígenas. / The objective of this study is to examine compliance with the judgments of the Inter- American Court of Human Rights cases involving violation of the territorial rights of Indigenous Peoples, with awards made between of 2001 to 2005. The study of cases Mayagna (Sumo) Awas Tingni vs. Nicaragua and Yakye Axa vs. Paraguay examines the jurisprudential construction of communal property, the Institute of compliance with the inter-American human rights system and the supervision stage of compliance with the judgments made by the Inter-American Court of Human Rights. Seeks to determine whether and how the mechanisms of this system interfere in cases compliance level. The empirical test as a methodology, relates a quantitative and qualitative analysis of compliance with the judgments repair orders. The findings allow us to consider the development of the monitoring mechanism of the system and re-evaluate their effectiveness in the affirmation of Human Rights of Indigenous People.
