Previous issue date: 2015-08-31 / This work is part of the Efficiency and Effectiveness research line of the Constitution and Fundamental Rights in the public law and private law, whose area of concentration lies in Constitutional Law Fundamentals of Public and Private Law, under the Program of Post- law degree (Masters and PhD) at the Catholic University of Rio Grande do Sul - PUCRS. Aims to demonstrate that the institute of intellectual property, through technological innovations, seeking the effective implementation of the principle of the social function provided for in the Federal Constitution as well as the consecration of the same post-industrial society. It is exploratory bibliographic research, theoretical and qualitative, with systemic approach method. As a result, it may be noted that the technological innovations developed within the universities, based on the principle of social function seek to meet the social interests of the community, referring to the principle of human dignity, as a form of consecration of fundamental rights in the State social and democratic rights. / O presente trabalho insere-se na linha de pesquisa Efic?cia e Efetividade da Constitui??o e dos Direitos Fundamentais no Direito p?blico e Direito Privado, cuja ?rea de concentra??o situa-se nos Fundamentos Constitucionais do Direito P?blico e do Direito Privado, vinculada ao Programa de P?s-Gradua??o em Direito (Mestrado e Doutorado) da Pontif?cia Universidade Cat?lica do Rio Grande do Sul ? PUCRS. Tem por objetivo demonstrar que o instituto da propriedade intelectual, atrav?s das inova??es tecnol?gicas, busca a efetiva concretiza??o do princ?pio da fun??o social, previsto na Constitui??o Federal, bem como a consagra??o do mesmo na sociedade p?s-industrial. Trata-se de pesquisa bibliogr?fica explorat?ria, de natureza te?rica e qualitativa, com m?todo de abordagem sist?mico. Como resultados, pode se destacar que as inova??es tecnol?gicas, desenvolvidas no ?mbito das Universidades, fundadas no princ?pio da fun??o social buscam atender os interesses sociais da coletividade, em alus?o ao princ?pio da dignidade da pessoa humana, como forma de consagra??o dos direitos fundamentais no Estado Social e Democr?tico de Direito.
