El presente artículo tiene como tópico analizar y comentar la ley n° 31572, Ley
del teletrabajo, tocando temas muy interesantes como la reversibilidad, la
desconexión digital y la negociación colectiva de trabajo. En el primer capítulo,
se revisa las definiciones sobre el teletrabajo y se ensaya ideas importantes
sobre la reversibilidad y el poder directriz del empleador, luego en el segundo
capítulo se señala la importancia de que la desconexión digital tenga un enfoque
de prevención de riesgos y laborales, y por último, en el tercer capítulo se
propone a la negociación colectiva de trabajo como el medio idóneo en caso el
reglamento de la ley comentada no establezca los puntos acotados en los
capítulos anteriores. / The topic of this article is to analyze and comment on Law No. 31572, the
Teleworking Law, touching on very interesting topics such as reversibility, digital
disconnection and collective labor bargaining. In the first chapter, the definitions
of teleworking are reviewed and important ideas about reversibility and the
directing power of the employer are tested, then in the second chapter the
importance of digital disconnection having a risk and labor prevention approach
is pointed out. , and finally, in the third chapter, collective labor bargaining is
proposed as the ideal means in case the regulation of the commented law does
not establish the points delimited in the previous chapters.
