Previous issue date: 2016-02-15 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / Religious freedom is a complex issue as it involves not only the pursuit of sacred, but also the exercise of this right within a political community, so often living the faith within the state becomes a challenge. However, from the historical construction of the right to religious freedom it is possible to get a sense of the magnitude of the subject and especially the importance of protecting this right to the development and promotion of human life. This study, developed at the Center for Research in Philosophy of Law at the Catholic University of São Paulo PUC/SP is to present a legal, historical and philosophical journey in which religious freedom was being built indicating some ways for a person human, citizen and faithful, may freely exercise this right within states, thus aiming at a true effectiveness of law. Noteworthy is the fact that, for the protection of this right there are ways in which both religions as the State may, mutually, aiming to build collaborative action from a fair separation between the religions and states. Among these collaborative juridical way stands the Agreement Brazil/Holy See, the one that illuminates the possibility of building legal instruments capable of promoting the human person and his fundamental rights, mainly referring to religious freedom. The respective work therefore presents an itinerary solidification of religious freedom as a human and fundamental rights and highlighting the collaboration model between Brazil and the Holy See as an effective way in search of protection, aiming and promotion of the dignity of the human person, including for members of other religious faiths / A liberdade religiosa é uma temática complexa, que envolve não somente a busca pelo sagrado, mas também o exercício deste direito em meio a uma comunidade política. Por isso, muitas vezes viver a fé dentro do Estado se torna um desafio. Porém, a partir da construção histórica do direito à liberdade religiosa, é possível ter uma noção da grandeza da temática e, principalmente, da importância da proteção deste direito para a valorização e a promoção da vida humana. A proposta deste estudo, desenvolvido no Núcleo de Pesquisa em Filosofia do Direito do Programa de Pós Graduação em Direito da Pontifícia Universidade Católica de São Paulo PUC/SP é de apresentar um itinerário jurídico, histórico e filosófico no qual a liberdade religiosa foi sendo construída indicando alguns caminhos para que a pessoa humana cidadão e fiel possa exercer livremente esse direito dentro dos Estados, visando assim uma verdadeira efetividade do direito. Destaca-se o fato de que, para a proteção deste direito, existem vias as quais tanto as religiões quanto os Estados podem, mutuamente, construir visando ações colaborativas destinadas a proteção deste direito fundamental, a partir de uma justa separação entre às Religiões e os Estados. Entre essas vias jurídico-colaborativas, destaca-se o Acordo Brasil-Santa Sé que ilumina a possibilidade da construção de instrumentos jurídicos capazes de promover a pessoa humana e, seus direitos fundamentais principalmente os referentes à liberdade religiosa. O presente trabalho apresenta, portanto, um itinerário da solidificação da liberdade religiosa como um direito humano e fundamental e, destacando o modelo de colaboração entre o Brasil e a Santa Sé como uma via eficaz na busca da proteção, visando e promoção da dignidade da pessoa humana, inclusive para os membros dos demais credos religiosos
