Previous issue date: 2006-07-28 / A proposta deste trabalho é analisar as ameaças aos direitos fundamentais e à
própria democracia em situações de crise. Cumpre ressaltar que a crise pode
apresentar-se de diversas formas: às vezes crise política, em outros momentos,
econômica, às vezes crise de segurança, podendo ser, inclusive, crise
constitucional. Desde o fim da ditadura militar, a cada nova crise, ressurgem
algumas discussões, como por exemplo: nossas instituições são sólidas? A
democracia corre algum risco? É possível a retomada de um novo golpe militar, os
direitos fundamentais conquistados sofrem algum risco? Pretende-se analisar o
tratamento dado pela Constituição aos direitos fundamentais durante os
denominados períodos de exceção. Além disso, verificar como o Estado, enquanto
guardião dos direitos fundamentais tem atuado nos momentos de instabilidade que
não são tidos como períodos de exceção, até porque não se enquadram nos
pressupostos constitucionais, mas que trazem insegurança e instabilidade, como é o
caso do crime organizado, do governo paralelo e da crise política. Trata-se de um
tema fascinante e abrangente, de importância capital na vida do indivíduo,
isoladamente considerado ou da sociedade. / The purpose of this paper is to analyze the laxity of the fundamental rights and
democracy itself in situations of crisis. It is worthy mentioning that the crisis can be
presented in various forms: sometimes political crisis, in some moments economic
crisis, sometimes security crisis and even constitutional crisis. Since the end of the
military dictatorship, when a new crisis appears some questions come up, for
instance: Are our institutions solid? Is democracy at risk? Is it possible the retaking
of the military dictatorship? Are the fundamental rights conquered at risk? This paper
intends to analyze the treatment given by the Constitution to the fundamental rights
during the periods of exception. Furthermore, it intends to verify how the State, while
guardian of the fundamental rights, has acted in the moments of instability that are
not understood as periods of exception because they are not arranged in the
constitutional presuppositions but they bring insecurity and instability, like the case of
the organized crime, parallel government and political crisis. It is a broad and
fascinating theme of extreme importance in the individual’s life, whether isolated or
inserted in the society.
