Previous issue date: 2016-04-01 / The Arbitration Law (Law no. 9,307/96) has promoted important innovations to the Institute, which has impelled its use for the solution of controversies. Prior to such a diploma, only arbitral commitments would set the arbitral tribunal. This manuscript reports on the analysis of the arbitration clause and the arbitral commitment, i.e., species of the arbitral agreement, through which parties solve their disputes according to the arbitral jurisdiction. The arbitrability of the litigation will be analyzed, so that a possible arbitration agreement can be established in some branches of Law. The manuscript also addresses the transmission, extension and extinction of the arbitration agreement / A Lei de Arbitragem (Lei nº9.307/1996) trouxe importantes inovações ao instituto, o que impulsionou sua utilização como forma de resolução de controvérsias. Antes do advento desse diploma, somente o compromisso arbitral teria o condão de instituir o juízo arbitral. O presente trabalho analisa a cláusula compromissória e o compromisso arbitral, espécies da convenção de arbitragem, forma pela qual as partes exercem a sua opção de solucionar suas divergências perante a jurisdição arbitral. Será analisada a arbitrabilidade do litígio de modo a constatar a possibilidade ou não de se firmar convenção de arbitragem em alguns ramos do direito. O estudo aborda, também, a transmissão, a extensão e extinção da convenção de arbitragem
