Le développement de la technique contractuelle entre l’Etat et les collectivités territoriales en France est l’occasion d’une réflexion sur l’évolution de leurs relations. La contractualisation des relations entre l’Etat et les collectivités territoriales (ou contractualisation territoriale) est devenue aujourd’hui le symbole d’une décentralisation inachevée, à mi-chemin entre un modèle fondé sur des principes jacobins et un autre modèle fondé sur le partenariat ou l’idée de co-administration. La contractualisation territoriale apparaît comme l’opportunité de transcender cette difficulté. Elle repose essentiellement sur la mise en oeuvre de techniques de droit souple, à l’instar des conventions d’administration, dont la reconnaissance juridique n’est pas actuellement aboutie. Cette circonstance est de nature à dévoyer la contractualisation territoriale pour en faire un instrument de tutelle supplémentaire au profit de l’Etat. La contractualisation territoriale est ainsi détournée de son objectif initial : organiser les relations Etat-collectivités territoriales dans un cadre nouveau. En effet : la crise des finances publiques associée à une globalisation politique et juridique sans précédent nécessite une adaptation majeure des structures institutionnelles françaises dont la cheville ouvrière demeure la relation Etat-collectivités territoriales. La contractualisation territoriale apparaît comme le seul outil à même d’absorber l’ensemble de ces nouveaux paramètres afin de construire une relation Etat collectivités territoriales conforme aux principes sur lesquels elle est censée reposer. / The development of contractual technique between the State and local authorities in France is an opportunity to reflect on the evolution of their relationship. The contractualisation of relationship between the State and local governments (territorial contractualisation) has become the symbol of an unfinished decentralization, halfway between a model based on principles of the Jacobins and another model based on partnership or the idea of co-administration. Territorial contractualisation appears as anopportunity to transcend this difficulty. It is based primarily on the implementation ofsoft law techniques, as administrative agreements, even if the legal recognition is not currently accomplished. This circumstance is likely to mislead the territorial contracts for an instrument additional supervision for the benefit of the State. The territorial contractualisation is thus diverted from its original purpose : to organize the state - local government relationship in a new context. Indeed, the crisis of public finances associated with an unprecedented political and legal globalization requires a major adaptation of French institutional structures which remains the linchpin state - local government relationship. Territorial contractualisation appears to be the only tool able to absorb all of these new settings to build a state - local government relationship with the principles on which it is supposed to be based.
