Juridical institute of the guardianship council in the Civil Code of the Czech Republic The thesis deals with the legal regulations of guardianship council under of the new Czech Civil Code. The Czech legal system has not experienced the institute of guardianship council before, which brings an uncertainty into the interpretation of the respective provisions. The aim of this thesis is to analyse the most important provisions of the legal regulation, demonstrate impact of these provisions in practice, including eventual uncertainties and eventually to suggest a solution of the problematic parts of the regulation. Due to the author's personal membership of a guardianship council is the work enriched by the personal experience from a real existence of the guardianship council. Another part of the thesis is focused on the analysis of the French legislation and legislation of the Canadian province Québec. The Czech Civil Code explanatory report directly admits the inspiration in the above mentioned codices of France and Québec. Analysis and the consecutive comparison of the above mentioned legislation with the Czech one shall bring the interpretative basis for the application of the legal regulation of the guardianship council under of the Czech Civil Code. Aim: To evaluate the effectiveness of the legal compliance of the Denton County Probate Court Visitor's program in the year 2013. Rationale: Guardianship case management success is based on the presence of legal compliance of both guardians and the Court. When a guardian is legally compliant, a ward is receiving the statutorily minimum standards of care. Legal compliance equates (evidence of) the Ward receiving legally sufficient care. Research has not been vast; it has been consistent as to necessity of guardianship training, monitoring, and narrow focus of research. Evidence based research will assist in defining and developing appropriate court monitoring programs, which can add to the quality of care for elderly and disabled adults. Methods: 1,300 guardianship cases in the probate court. Of these cases, 910 had annual reports of the person filed, which 304 were reviewed using the Legal Compliance Audit. Eight (8) factors of compliance were reviewed with three (3) being Court actions and five (5) being guardian actions. Results: Exploratory study provides evidence based research of the necessary changes to develop the Denton County Probate Court Visitor's program. The guardians are more legal compliant than the Court.

Protecting the Castle: Applying Protection Motivation Theory to Explain the Use of Home Guardianship

Home guardianship measures provide individuals with a means to enhance and ensure the safety of themselves, their family, and their property inside their homes. However, research regarding the factors considered in the decision to employ home guardianship measures as well as the means by which individuals assess this information regarding potential threats and protective responses is limited and varied in its implementation. This study attempts to provide a theoretical framework for understanding the use of home guardianship measures with the application of a modified version of Ronald Rogers’ (1983) Protection Motivation Theory (PMT) model. This model assesses factors that directly contribute to the motivation to engage in protective measures as well as cognitive processes through which an individual assesses these factors. This study finds support both for the direct relationships between sources of information about potential threats or protective responses and the use of home guardianship measures, as well as support for mediating effects of these relationships. In conclusion, this study provides suggestions for future research to further examine the application of PMT to understand the use of guardianship measures.

Todavia, a Lei 12.016/2009, que regulou, em texto consolidado, o mandado de segurança individual e o coletivo, parece, quanto a este, ter restringido o alcance constitucional do remédio heróico, inclusive se afastando do denominado microssistema de tutela coletiva. A discrepância entre a Lei 12.016/09 e o denominado microssistema de tutela coletiva conduz, entretanto, à necessidade de hermenêutica constitucional que assegure a máxima efetividade ao mandado de segurança coletivo. O estudo justifica-se pela importância do mandado de segurança coletivo no cenário de tutela coletiva dos direitos, notadamente para proteger direitos fundamentais violados ou ameaçados de lesão por ato de autoridade pública, e propõe uma abordagem dos seguintes pontos: a) evolução das ações coletivas no Brasil; b) construção doutrinária dos interesses coletivos no Brasil; c) direitos difusos, coletivos e individuais homogêneos; d) partes e legitimidade nas ações coletivas; e) princípios informativos das ações coletivas; f) histórico do mandado de segurança; g) mandado de segurança na Constituição de 1988; h) Antecedentes do mandado de segurança coletivo; i) legitimidade do mandado de segurança coletivo; j) coisa julgada nas ações coletivas; l) mandado de segurança coletivo na Lei 12.016/2009. AN EXPLORATORY STUDY OF INCAPACITATED PERSONS WITH CRIMINAL BEHAVIORS SERVED BY KENTUCKY’S PUBLIC GUARDIANSHIP PROGRAM

State run public guardianship programs are legally mandated to provide custodial care for persons deemed incapacitated by the courts. Historically, the majority of state wards were elderly women residing in skilled nursing facilities. Today, those demographics are rapidly changing. This new incapacitated cohort has become less institutionalized, with a rising number of persons who have entered the program with criminal records and who continue to commit crimes. This exploratory study focuses on incapacitated persons (IP) with criminal behaviors in order to seek what intervention(s) might reduce their criminal activity. Relying on routine activity theory, differing levels of supervision were compared to those persons institutionalized 24 hours per day. The results of the study indicated that as levels of residential supervision decrease, criminal activities significantly increase. This study can assist administrators of public guardianship programs better understanding the supervisory needs of their incapacitated citizens as well as improve safety precautions for their respective communities.

It also undertakes research with the purpose of demonstrating the origin and evolution of urgent protection in foreign law, specifically in the legal orders from which the Brazilian guardianship of urgency was derived (Italian, French and Portuguese), with the purpose of discovering if the Brazilian legal order remained parallel or distanced from its origins. The first chapter describes the evolution of the protection of the guardianship of urgency in the national legal order, by means of the comparison of the legislative texts that were in force until the advent of CPC of 1939. The second chapter lends itself to studying the guardianship of urgency in the CPC of 1973, initially represented only by the precautionary process and by some special procedures (v.g. possessory injunction), being, from 1994, inserted the anticipation of guardianship for the common procedure. The third chapter is devoted to reporting the guardianship of urgency in the foreign law that, according to the doctrine, influenced the Brazilian, in order to demonstrate (at the end of the work) whether there has been a parallel evolution of the systems or if the systems have distanced. The fourth chapter lends itself to the investigation of the main exponents of both foreign law and national law, with regard to guardianship of urgency, adopting as a methodological proposal the separation of authors into two groups, taking into account that they had written before (when everyone were dedicated only to the study of precautionary measures) or after Law 8.952/94, which introduced the anticipation of guardianship in the Brazilian CPC (when they went to the study of anticipation of guardianship and its comparison with the system called precautionary). The fifth chapter lends itself to the study of the CPC of 2015 since the draft, through legislative discussions and culminating in the enacted text, as well are inquired controversial issues about the system of "temporary" guardianship of urgency in the manner in which it is promulgated, based on a unitary concept of precautionary guardianship of urgency, which includes conservative and satisfying techniques. The sixth chapter proposes a new approach to the guardianship of urgency system, from a new concept of guardianship precautionary/urgency, with possible changes de lege lata and suggestions de lege ferenda, in order to make the institutes more effective, in the light of its constitutional mission: provide justice promptly or, where this is not possible, prevent events from rendering ineffective the future judgment of merit / Este trabalho se propõe a estudar o caminho percorrido pela tutela de urgência no direito brasileiro, desde as Ordenações Portuguesas até o CPC de 2015. Também empreende pesquisa com a finalidade de demonstrar a origem e a evolução da tutela de urgência no direito estrangeiro, especificamente nos ordenamentos dos quais derivou a tutela de urgência brasileira (italiano, francês e português), com vistas a descobrir se o ordenamento brasileiro se manteve paralelo ou se distanciou de suas origens. O primeiro capítulo descreve a evolução da tutela de urgência no ordenamento nacional, por meio do cotejo dos textos legislativos que vigoraram até o advento do CPC de 1939. REPRESENTATION The thesis is focused on the institute of representation in general. It provides an explanation of basic attributes of representation and it's resolution methods. Given the scope of the thesis it was not possible to cover discourse about all forms of representation and therefore it is mainly focused on direct representation in substantive law. The work is based on current regulation contained in Law No. 89/2012 Coll., The Civil Code and it highlights the most significant changes which has occurred since the date of effectiveness of this Code in regulation of representation. It also refers to consequences of these changes and contentious issues which arise with the application of individual provisions. This work deals with contractual and statutory representation including representation of an entrepreneur and representation of legal entities, briefly describes representation in family law. There is also an elaborated issue of guardianship that has been affected by significant changes. It refers to guardian council and guardianship of legal entities that are newly adjusted in Czech legal order. There is also included characterization of preliminary declaration, supported decision making, representation by the member of the household.

Representation: This thesis on the topic of representation is focused generally on behalf of the Institute. It mainly deals with the rules contained in Civil Code, Act no. 89/2012 Coll. It desribes basic concepts and methods of resolution representation. Its interpretation focuses on the diferences between any forms of representation. In that case, it is not possible to write up the entire institution of the representation, which was one of the largest in the law. This work is therefore focused on the substantive representation, and especially on the conditions for the creation and termination of contractual representation and on guardianship and especially guardianship of individuals. The thesis contains also an outline of the historical development of the Institute's presence in our law, but again, considering the vastness of representation, it is not an exhaustive analysis, but merely mentioning the most significant sources. An element of this thesis is also an overview of the procedural representation in civil court proceedings. Adoption of the Civil Code Act no. 89/2012 Coll. had to institute represented a significant impact when to applicable law brought many new important sub-institutes, and greater clarity.
