the housing at the city of Natal are fragile by facing actions and attempts to suppress
and changing (or omission in the implementation) of standards in furtherance of those
rights at the local level, which seems to reflect a situation that goes beyond the context
of the city. Based on integrated approach of the housing rights and the environment and
its protection of special spaces on the field of fundamental rights, the thesis seeks to
understand the weaknesses that affect the legal state duty under the
realization/implementation of fundamental rights to the environment and housing in
cities, focusing on the issues of flexibility of the founding legislation of special spaces
to the detriment of the attributes they protected and the lack of implementation of the
legal system that allows their effectiveness. So, it looks initially to understand the
environment and housing rights and their special protected areas in the brazilian legal
system, looking forward the evolution of its legal protection, as well as the weaknesses
that emerge in the field of their effectiveness. Analyzing the trajectory of the
environment and housing rights and their special protected areas in Natal, considering
its standards, attributes, protection indicators, weaknesses and negative evidence within
its legal protections and their enforcement by state entity, this thesis proposes to verify
the existence of forms to confronting the weaknesses founded in the maintenance of
legal protection and its implementation. At this point it discusses the legal basis and
safeguard instruments of protection, especially within the juridical field, as part of a
(re)discussion about issues of legislative and administrative discretion in the face of
objective legal state duty to realization/implementation of fundamental rights in the
urban space. With all these issues together the thesis does not ignore the scenario where
the dividing line between public and private (economic) are becoming ever more
tenuous in the field of state action and where the city stands as a special commodity to
the reproduction of real estate, according to the interests of capitalist logic / Alguns espa?os especiais protegidos em favor dos direitos fundamentais ao meio
ambiente e ? moradia na cidade de Natal se encontram fragilizados face ?s a??es e
tentativas de supress?o e modifica??o (ou omiss?o na implementa??o) das normas
concretizadoras desses direitos em ?mbito local, o que parece refletir uma situa??o que
ultrapassa o contexto da cidade. A partir de uma abordagem integrada dos direitos ?
moradia e ao meio ambiente e respectivos espa?os especiais de prote??o no campo
te?rico dos direitos fundamentais, o estudo busca compreender os problemas que
incidem no ?mbito do dever estatal de efetiva??o/concretiza??o dos direitos
fundamentais ao meio ambiente e ? moradia nas cidades, com enfoque nas quest?es da
flexibiliza??o da legisla??o instituidora de espa?os especiais em preju?zo dos atributos
por eles resguardados e da falta de implementa??o do sistema jur?dico que permite sua
efetividade. Para tanto, busca inicialmente compreender os direitos ao meio ambiente e
? moradia e seus respectivos espa?os especiais protegidos no sistema jur?dico brasileiro,
visualizando a evolu??o de sua prote??o legal, assim como os problemas que se
apresentam no campo de sua efetividade. Analisando a trajet?ria dos direitos ao meio
ambiente e ? moradia e seus espa?os especiais protegidos em Natal, considerando sua
normatiza??o, atributos, indicadores de prote??o e evid?ncias de fragiliza??o no ?mbito
de sua prote??o legal e de sua implementa??o pelos entes estatais, o estudo se prop?e a
verificar a exist?ncia de formas de enfrentamento desse processo de fragiliza??o de
direitos. Nesse sentido, aponta fundamentos jur?dicos e instrumentos de salvaguarda
dessa prote??o, especialmente no campo jur?dico, no ?mbito de uma (re)discuss?o da
quest?o da discricionariedade administrativa e legislativa em face do dever objetivo
estatal de efetiva??o/concretiza??o dos direitos fundamentais no espa?o urbano. Isso
tudo sem desconsiderar um cen?rio onde a linha divis?ria entre os interesses p?blicos e
privados (econ?micos) se revela cada vez mais t?nue no campo da atua??o estatal e
onde a cidade se coloca como uma mercadoria especial ? reprodu??o dos neg?cios
imobili?rios, conforme os interesses da l?gica capitalista
